Between John Highland and Issabela his wife of the County of Bath and Mary K. Windle of the County of Shenandoah and State of Virginia of the first part and David Hunter of the County of Rockingham and State aforesaid of the second part. Witnesseth that the said John Highland and Issabela his wife and Mary K Windle for and in consideration of this sum of Two thousand one hundred and twenty dollars in hand paid them by the said David S. Hunter this receipt whereof is hereby acknowledged have granted bargained and sold and by these presents do grant bargain and sell unto the said David S. Hunter a certain tract or parcel of land lying in the County of Augusta on the waters of Naked Creek between the land of Frederick Krahn and Benjamin Bryan and conveyed by John Dennison to Issabela Highland and Mary K. Windle by deed licensing date 21st of July 1828 and recorded in the office aforesaid County and is bounded as follows. To Wit Beginning at four black oaks on a ridge Huffmans corner N 51? E one hundred and forty two poles passing a former corner to two white oaks Krahns corner N 35? W seventy four poles to a stake corner to Krahn S69?W forty three poles to three white oaks corner to Krahn N 33? W ten poles to a leaning white oak Krahns corner N 20? W thirty two poles to a white oak and gum corner to Krahn. N67?W twenty one poles to three white oaks Allisons corner with his line S471/2? W thirty four poles to a stake Bryans corner with his line S33?E ninety nine poles to a white oak stump corner to Bryan. East twenty four poles to the beginning. Together with all and singular the appertenances thereto belonging or in anywise appertaining. To have and to hold the said tract or parcel of land with it’s appertenances unto the said David S. Hunter his heirs and assigns forever to the only proper use and ____ of him the said David S. Hunter his heirs and assigns and the said John Highland and Issabela his wife Mary K Windle for themselves their heirs executors and administrators do covenant with the said David S. Hunter and his heirs and assigns that they the said John Highland and Issabela his wife and Mary K. Windle their heirs and executors administrators the said tract of one hundred and six acres with its appertenances unto the said David S. Hunter his heirs and assigns against the claim or claims of them the said John Highland and Issabela his wife and Mary K Windle their heirs and of all and every person or persons whatsoever shall and will warrant and forever deferred by these presents. In witness whereof the said John Highland and Issabella his wife and Mary K. Windle have herewith set their hands and seals the day and year first above ____ Mary K. Windle (seal) Issabela Highland (seal) John Highland (seal) Augusta County to wit David Griffith and John Y. Allison justices of the peace in the County aforesaid in the State of Va. Do hereby certify that Mary K. Windle a party to the foregoing deed personally appeared before us in our County aforesaid and being examined by us privately and a part from her husband and having to deed aforesaid fully explained to her. She the said Mary K. Windle acknowledged the same to be her act and deed and declared that she has willingly signed sealed and delivered the same deed that she wished not to retract from it. Benson justices of the peace in and for the County aforesaid and State of Virginia do hereby certify that Issabela Highland a party to the aforegoing deed personally appeared before us in our County aforesaid and being examined by us privately and apart from her husband and having the deed aforesaid fully explained to her she the said Issabela Highland acknowledged the same to be her act and deed and declared that she had willingly signed sealed and delivered the same and that she wished not to retract from it. Given under our hands and seals this 25th day of November 1835 Saml Lewis (seal) Wm R. Benson (seal) Bath County to wit. We Saml Lewis and William R. Benson justices of the peace in the County aforesaid in the State of Virginia do hereby testify that John Highland and Issabela Highland parties to a certain deed bearing date on the 12th day of September 1835 and hereto annexed personally appeared before us in our County aforesaid and acknowledged the same to be their act and deed and desired us to certify the said acknowledgment to the Clerk of the County Court of Augusta in order that the said deed may be recorded. Clerks Office Decr. 14th 1835 This Deed of Bargain and Sale from John Highland and Issabela his wife and Mary K. Windle to David S. Hunter was this day presented in the Clerks Office aforesaid and having been duly acknowledged by the said Highland and wife before two Justices of the peace for Bath County and by said Mary K. Windle before two Justices of the peace for Augusta County the said Issabela Highland and Mary K. Windle having been also privately examined and relinguished their dower before said Justices the same is admitted to record together with the certificates of said Justices thereon endorsed Teste Jefferson Kinney This Indenture made and entered into this 28th day of November in the year of our Lord one thousand eight hundred and thirty five by and between David S. Hunter of the County of Augusta and State of Virginia of the first part and Washington H. Dennison of the County of Bath of the second part and Jefferson Kinney of the County of Augusta of the third part. Witnesseth that the said David S. Hunter inorder to secure the payment of fourteen hundred and twenty dollars current money ? Virginia which he presently owes and stands indebted to said Washington H. Dennison and which he the said D.S. Hunter honestly desires to satisfy and pay in the following manner. Towit. Three hundred and fifty five dollars on the 20 of Dec. 1836 and three hundred and fifty five dollars on the 25th of Dec. 1837. And three hundred and fifty five dollars on the 20th of Dec. 1838 and three hundred and fifty five dollars on the 25th of Dec. 1839 which will more fully appear by references to ____ bond – signed by said David S. Hunter this day and payable to the said Washington H. Dennison. Now for and in consideration of the premises and the further consideration of one dollar in hand paid the said David S. Hunter by the said Jefferson Kinney the receipt whereof is hereby acknowledged the said David S. Hunter hath granted bargained and sold unto the said Jefferson Kinney and by these presents do grant bargain and sell unto the said J. Kinney a certain tract or parcel of land lying and being in the County of Augusta adjoining the lands of John Y. Allison and others containing by estimation one hundred six acres be the same more or less and recorded as follows. Towit. Beginning at four black oaks on a ridge Huffmans corner. Thence N51?E one hundred and forty two poles passing a former corner to two white oaks Krahns corner. N35?W seventy four poles to a stake corner to Krahn. S69?W 43 poles to three white oaks corner to Krahn. N35?W 10 poles to a leaning white oak Krahns corner. N 20?W 32 poles to a white oak and gum corner to the same. N67?W 21 poles to three white oaks Allisons corner with his line. S281/2?W 55 2/10 poles to a pine stump corner to the same. S47 1/2?W 34 poles to a stake Bryans corner with his line S33?E 99 poles to a white oak stump corner to the same. E 24 poles to the beginning together with all and singular the appertenances thereto belonging or in any wise appertaining. To have and to hold the said 106 acres of land with its appertenances unto the said Jefferson Kinney his heirs executors administrators and assigns forever. Upon Trust nevertheless that the said Jefferson Kinney shall at any time after the 25th day of Dec 1839 when the said Dennison or his legal representative shall order or the said D.S. Hunter or his legal representative shall request and after thirty days notice having been given of the time and place of sale in some public newpaper published in the town of Staunton proceed to sell the said tract of land to the highest bidder for the best price that can be obtained in cash and out of the monies arising from the sale in the first place to pay and satisfy all reasonable charges attending such sale and those in debt aforesaid with the legal interest thereon accessing and the residue of the monies (if any) arising from such sale to the use of the said David S. Hunter his hiers, extr, admtrs or assigns or to such persons as is legally authorized to receive the same. In witness whereof the said David S. Hunter and Jefferson Kinney have hereunto set their hands and seals on the day and year first above written David S. Hunter (seal) Jefferson Kinney (seal) Augusta County Court Clerks Office Dec. the 14th 1835 This Deed of conveyence from David S. Hunter to Jefferson Kinney in trust for Washington H. Dennison was this day presented in the Clerks office aforesaid and acknowledged before A.K. StClair deputy clerk of said County Court by the said Hunter and Kinney and admitted to record Teste A.K. StClair D.C. AC ------------------------------------------------------------------------------------------- This Indenture made & entered into this 20th day of May in the year of our LORD one thousand eight hundred & forty five. Between George Wetsel & Sarah his wife of the County of Augusta & State Virginia of the one part & David S. Hunter of the County of Augusta & state of Virginia of the other part. Witnesseth that the said George Wetsel & Sarah his wife for & in consideration of the sum of twenty five dollars lawful money to them in hand paid by said David S. Hunter the receipt whereof is hereby acknowledged has granted bargained & sold & by these presents grant bargain & sell unto the said David S. Hunter his heirs and assigns a certain tract of parcel of land containing one hundred acres to the same more or less being part of the land conveyed by Thomas I. ____ Adam & Ruben Nelergall & by Ruben C. Whetsel lying in the County of Augusta in the North Mountain on the waters of the North River & bounded as follows. Beginning at two small hickorys between two black oaks and a white oak (maked as pointers)on the south side of a ridge N67?SW to a hickory white oak & chesnutoak on Craun's line on the west side of the North fork of broad run with Crauns line S191/4?E 67 poles to Bryans line on the same line S67?W 2381/2 poles to Bryans corner N17?W 67 poles to the Beginning. Together with all & singular the appertenances thereunto belonging or in anywise appertaining. To have & to hold the said tract of alnd with its appertenances ujnto the said David S. Hunter his heirs & assigns forever to the only proper use and ___ of him the said David S. Hunter his heirs and assigns forever & the said George Wetsel & Sarah his wife for themselves their heirs executors & administrators do covenant with the said David S. Hunter his heirs and assigns that they the said George Wetsel & Sarah his wife their heirs executors & Administrators the said tract of land with its appertenances unto the Said David S Hunter his heirs & assigns against the clain of claims of them the said George Wetsel & Sarah his wife their heirs and all and every person or persons whatsoever shall & will warrant & forever deferred by these presents. In witness whereof the said George Wetsel & Sarah his wife have hereunto set their hands & seals the day & date first above written George Wetsel (seal) Sarah Wetsel (seal) State of Virginia Augusta County to wit We Saml Harnsberger & E.G. Moorman justices of the peace in the county aforesaid do hereby certify that Sarah Wetsel the wife of George Wetsel parties to the within deed for the conveyance of real estate to David S. Hunter personally appeared before us in said county and being examinedby us firmly and apart from her husband and having the deed aforesaid explained to her acknowledged the same to be her act and deed & declared she had willingly signed sealed & delivered the same & she wished no to retract it Given under our hands & seals the 20th of May 1845 Saml Harnsberger (seal) E.G. Moorman justices of the peace in the county aforesaid do certify that George Wetsel party to the within deed hath duly acknowledged the same before us & desired us to certify the said acknowledgment to the Clerk of the County Court of Augusta in order that the said conveyance may be recorded Given under our hands & seals this 20th of May 1845 Saml Harnsberger (seal) E.G.
