Will: Martha Davis and Joseph Parks August County VA - Will Book 10 Page 38 WILL OF MARTHA DAVIS In The Name of God Amen, I Martha Davis of Augusta County and State of Virginia Being weak in Body but of sound mind and memory do make and ordain this my last will and Testament as for the worldly Estate with which God has Blessed me I devise and bequeath in the manner and form following Viz. It is my will that my Property that I have not disposed of myself before my deceas shall be equally divided by my Executors without making a sale between my Daughter Margret Smith my Daughter Martha Reives the Heirs of my Son James Davis my Daugther Euphora Donley the Heirs of my Daughter Sally Ewin my Son William Davis my Daughter Elizabeth Parks and my Son John Davis and I do hereby nominate constitute and apoint my Beloved Sons William Davis and John Davis Executors of this my Last will and Testament Revoking all others by me heretofore made in Testimony hereof I have hereunto set my hand and affixed my Seal this 26th day of December in the Year of our Lord one Thousand Eight hundred and Five. And first I Recommend my soul to Almighty God who gave it, and my Body to the Earth from whence it was taken to be Buried in a decent Christian like manner at the discretion of my Executors. As to my Worldly Estate wherewith it hath pleased God to Bless me, I Dispose of it in the following manner. Viz. First I give & bequeath unto my son James Parks the sum of five Shillings, to him & his Heirs forever. Secondly I give to my three Grand sons Joseph, Thomas & John Parks, Children of my son Thomas Parks dec'd the Sum of two Hundred and Twenty pounds to be Equally divided between them, and to be paid to them by my Executors as they Respectively arive to the age of Twenty one years, and if either of them shall die before they arive to that age, I give the same to be Equally divided between the surviving ones, to them & their Heirs forever. Thirdly I give to my son Joseph Parks the sum of five Shillings to him & his Heirs forever. Also I give to my said son Joseph in consideration of an allowance I make to him for my Board etc. the Sum of Ten pounds a year, commencing at the 15th day of September One Thousand Eight Hundred & four, and to continue so long as I may live, or continue to Board with him, as a full Compensation for the same, to him & his Heirs forever. Fourthly I give to my son William Parks the Sum of One Hundred & sixty pounds, to him & his Heirs forever. Fifthly I give to my son David Parks the sum of two Hundred pounds, to him & his Heirs forever. Sixthly I give to my Daughter Ann Wilson the Sum of sixty pounds, to her & her Heirs forever. Seventhly I give to my Daughter Rebecca Finley the Sum of One Hundred pounds, to her & her Heirs forever. Eighthly My Will and desire is, that after all my Just Debts, Specific Legacies & funeral Expenses is paid, The Residue of my Estate, be it of what kind so ever it may, Shall be Equally divided Between my three sons, Joseph, William & David, which I give to them and their Heirs forever. Ninethly & Lastly I Nominate and appoint my son Joseph Parks and my friend Joseph Cowan my Executors to Execute this my last Will & Testament.
