Will: David Dryden, [Sr] Dated 2 June 1772, Proved 18 Aug 1772 Source: Augusta Co., VA Will Book 4, Page 521 Contributor: Carol Vass ------------------------------------------------------------------ In the name of God Amen I David Dryden of the County of Augusta and the Colony of Virginia being sick and weak of body but of Perfect Mind & memory thanks be given to Almighty God Calling to mind the Mortallity of my body, knowing that it is appointed for all men once to die do make my last will and testament in the manner and form following, that is to say, Principally and first of all I recommend my soul to God who gave and my body to the dust from whence it came to be buried in a Christian-like decent manner & at the discretion of my Executor, nothing doubting but at the General Resurection I shall receive the same again by the Mighty Power of God and as touching such worldly estate wherewith all it hath pleased God to bless one with, I give & bequeath as follows, Impris: I give & bequeath to my beloved Wife Dorothy her maintenance of the land I now live during her life, one milch cow & ewe & a lamb & my large bible to be left to Nathaniel at her decease and both Bostons Works, and her chest. Item I give & bequeath Page 522 to my son Thomas Dryden one dollar and likewise my blue coat and jacket. Item I give and bequeathed to my son James one dollar. Item I give and bequeath to my son David one dollar. Item, I give and bequeath to my daughter Eliner eight pounds of the Estate. Item, I give and bequeath to my daugher Jane one dollar & two pewter dishes & three plates & one large Pot. Item, I give an bequeath to my daughter Elizabeth one dollar. Item I give and bequeath to my two sons Nathaniel and William the land whereon I now live to be equally divided bewixt them according to quantity and quality at the discretion of my Executors, also each of them a horse and saddle and likewise I give and bequeath to my son William one young bay filley, likewise I give and bequeath to each plow and taklings. I give and bequeath to my son Nathaniel one black mare, likewise the two old plow horses to be divided between them also I allow all my Just dedts and demands to be paid out of the remainder of my moveable Estate, likewise if any thing is remaining I give and bequeath it to Dorothy my wife and sons Nathaniel and William LASTLY I appoint Samuel Lyle and my son James sole executors of this my last will and testament and I do hereby Revoke and Disannual all other or former wills or testament by me made, Ratifying & confirming this and no other to be my last will and Testament. At a Court held for Augusta County August the 18th 1772 This last Will and Testament of David Dryden deceased Page 523 was proved by the Oaths of John Thompson & William Thompson two of the witnesses thereto and ordered to be Recorded on the motion of Samuel Lyle and James Dryden the Executors therein named who made oath accordint to Certificate is Granted therefor obtaining a Probate thereof in due form they having with Security entered into and acknowledged their Bond According to law. Teste KNOW all men by these Presents that we Samuel Lyle, Samuel Dryden, Daniel Lyle and Samuel McCorkrey are held and firmly bound unto James Doak and Samuel McDowell, George Moffett, Archibald Alexander Justices in the Commission of the Peace for Augusta County for and in behalf of the Justices of the said County and their successors in the sum of five Hundred Pounds to be Paid to the s.d Justices & their Successors which Payment will & truly to be made we bind ourselves and each of us and every of our heirs Executors & Administrators Jointly & Severally firmly by these Presents Sealed with our seals & dates this Eighteenth day of August 1772. THE CONDITION of this Obligation is such that if the above bound Samuel Lyle and James Dryden Executors of the last Will and Testament of David Dryden deced. do make or Cause to be made a true and Perfect Inventory of all and singular the goods Chattles and Credit of the s.d. deced. which have or shall come to the hands or Possession or knowledge of the s.d. or into the hands or Possession of any other Person or Persons for them and the same so made do exhibit or cause to be exhibited into the County Court of Augusta at such times as they shall thereunto be required by the s.d. Court and the same Goods, Chattles and Credits and all of them the Goods Chattles & Credit of this deced. which at any time after shall come to the hands or Possession of the said Samuel and James on into the hands Page 524 or Possession of any other Person or Persons for him do well and truly Administere according to law and further do make a true and Just account of his Actings and doings therein when hereto required by the s.d Court and also do well and truly Pay & deliver all legacies Contained and Specified in the s.d. testament as far as the said Goods Chattles and Credits with there upon --?--.
