This Indenture made this fourth day of August in the year of our lord one thousand eight hundred and four Between Hezekiah Stout of County of Harrison and State of Virginia of the one part and Ezekiel Townsend of the County of Bath and State aforesaid of the other part Witnesseth that the sd Hezekiah Stout for and in consideration of the sum of one hundred and thirty pounds current money of Virginia to him in hand paid by the said Ezekiel Townsend at or before the sealing of these presents the receipt whereof is hereby acknowledge of him the said Hezekiah hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Ezekiel Townsend his heirs executors and assigns forever one certain tract or parcel of land containing twenty acres being part of a larger tract of one hundred and four acres lying in the County of Bath on Back Creek and bounding as followeth, Viz. Beginning at a spruce pine on the east side of the creek and running thence North fifty five degrees West forty poles to a (yew?) by a b( ) thence North Ten degrees East sixty six poles to two Sugartrees thence North eighty degrees West sixteen poles to a chestnut and Sugartree North ten degrees East eight poles to a hickory thence South fifty five degrees East seventy poles to a stake on the patent line thence to the Beginning together with appertainences therewith belonging to have and to hold the land herby conveyed and all and singularty the premises herby granted with the appertenances unto the sd Ezekiel Townsend his heirs and assigns forever to the only proper use and behoof of him the said Ezekiel Townsend and of his heirs and assigns forever other said Hezekiah Stout for himself his heirs executors administrators doth covenant and agree & with the said Ezekiel Townsend for his heirs & assigns by these presents that the said tract of land with the pappertenances unto the said Ezekiel Townsend his heirs and assigns from the claim or demand of the said Hezekiah Stout or any other person or persons whatsoever shall warrant and defend forever by these presents. In Witness whereof the said Hezekiah Stout hath hereunto set his hand and Seal the day and year above mentioned.
