These copies are 3 pages legal sized, copied on both sides of the paper. They appear to be loose documents, folded 4 times (into a 4x9½ bundle) with the title notation on the outside. They came from Ms. Jones with these three pages stapled together. Spelling, punctuation and capitalization follow the originals as closely as possible. Brackets are transcriber’s notes or uncertain words. [Front of first page]: This Indenture made the 18th day of May in the year of our Lord one thousand eight hundred and [forty] seven Between David Lange and Agatha Ann his wife of the County of Augusta and state of Virginia of the one part; and Benjamin Walton of the County of Bath and state aforesaid of the other part Witnefseth that the said David Lange and Agatha Ann his wife for and in consideration of the sum of One Dollar lawful money of Virginia to them in hand paid by the said the receipt whereof is hereby acknowledged have granted bargained and sold; and by these presents do grant bargain and sell unto the said Benjamin Walton his heirs and afsigns the whole of the undivided part and interest of the said Agatha Ann Lange in all the lands of her father Edmund P. Walton of which he was pofsefsed lying the County of Bath on or near the waters of Cedar Creek in said County and state of Virginia together with all and singular the appurtenances thereunto belonging or in any wise appertaining to have and to hold the said above mentioned part and interest with the appurtenances unto the said Benjamin Walton his heirs and afsigns forever to the only proper use and behoof of him the said Benjamin Walton his heirs and afsigns forever; And the said David Lange and Agatha Ann his wife for themselves & their heirs Executors and administrators do covenant with the said Benjamin Walton his heirs and afsigns that they the said David Lange and Agatha Ann his wife their heirs executors and administrators the said above mentioned part and interest with the appurtenances unto the said Benjamin Walton his heirs and afsigns against the claim or claims of them the said David Lange and [back of first page]: Agatha Ann his wife their heirs and all and every person or persons whatsoever they shall and will Warrant and forever defend by these presents In Witnefs whereof the said David Lange and Agatha Ann his wife have hereunto set their hands and seals on the day and year first above Written David Lange [seal] Agatha Ann Lange [seal] Signed sealed and delivered in presence of [blank] State of Virginia Augusta County To Wit We Wm Ramsey and Wm [Guy] Justices of the peace in the County aforesaid and state of Virginia do hereby certify that Agatha Ann the wife of David Lange parties to a certain Deed for the conveyance of real Estate to Benjamin Walton bearing date the 18th day of May 1847 and hereunto annexed personally appeared before us in our County aforesaid and being examined by [us] privily and apart from her husband and having the Deed aforesaid fully explained to her she the said Agatha Ann Lange acknowledged the same to be her act and Deed declared that she had willingly signed sealed and delivered the same and that she wished not to retract it Given under our hands and seals this 3rd day of July 1847 Wm Ramsey [seal] Wm Guy [seal] State of Virginia Augusta County To Wit We Wm Ramsey and Wm Guy Justices of the Peace in the County, aforesaid and state of Virginia do hereby certify that David Lange a party to the within Deed hath duly acknowledged the same before us on the 3rd day of July [This is the bottom of the page and looks as though it continues on another page]. [front of second page]: Know all men by these presents that we Mofes Walton and Sarah Walton his wife of the County of Alleghany and state of Virginia of the one part and Benjamin T. Walton of the County of Bath and aforesaid state of the other part; that we Moses Walton and Sally Walton hath bargained and sold unto Benjamin T. Walton our right and title in all the lands to which Mofes Walton was entitled to as one of the heirs of Edmund P. Walton deceased in the County of Bath which is the one eleventh of said Lands; there are five different surveys of said lands all containing five hundred and four Acres lying and being in the County of Bath and for the explicit locality of said lands is given said Edmund P. Walton title papers as follows One hundred and three Acres granted to Edmund P. Walton by patent on the 30th day of November 1838, one tract of 57 Acres granted by pattent to said Edmund P. Walton on the 10th day of September 1832, one survey of 94 Acres granted to said Edmund P. Walton by pattent on the 30th day of June 1843, one survey of 150 Acres conveyed to said Edmund P. Walton by Thomas Milhollin and Martha his wife on the 13th day of November 1827 and and [sic] of record in the County of Bath One survey of 100 Acres conveyed to said Walton on the 28th day of May 1830 by Thomas Milhollin and Martha his wife for and in consideration of seventy five Dollars, paid to us. We Mofes Walton and Sarah Walton do hereby relinquish and convey to Benjamin T. Walton all our right and title in said lands to him and his heirs forever with all the appurtenances thereunto belonging with [back of second page]: general Warranty and defence Given under our hands and seals this 12th day of April 1850 Sarah Walton [seal] Mofes Walton [seal] State of Virginia Alleghany County To Wit This day Sally Walton the wife of Mofes Walton came before us Lewis T. [Mann] & Moses H. [Mann] J.P. Justices of the peace for the County of Alleghany who a party to a Deed bearing date on the 12 day of April 1850; and acknowledged the same to be her act and Deed and desired us to certify the same to the Clerk of the County Court of Bath County in order that the same may be recorded; we also examined her seperately and apart from her husband and she stated that she made the Deed with her own free Will and consent not through pursuasion force or fear or compulsion Given under our hands and seals this 13th day of April 1850.
