Garnett Lee and others Garnett Lee v. Charlotte Lee and others William Lee v. Charlotte Lee and others These causes came on this day to be heard together the first upon the papers formerly read, the report of Commissioner Wharton, and the report of Commissioner Creed T. Wills made in pursuance of former orders in this cause to which there is no exception, and the second which appears to have been matured in the office as to all the defendants, upon the Bill and exhibits, and the third which also appears to have been regularly matured in the office as to all the defendants, upon the original and amended Bills, the answer of Richard Harvey Sheriff of Campbell County and as such Administrator of Garnett Lee, Jr. dec’d and exhibits and, were argued by Counsel upon consideration whereof the Court approving the Reports of Commissioners Wharton and Wills doth confirm the same, and doth adjudge, order and decree that Creed T. Wills who is hereby appointed a Commissioner for the purpose, do withdraw from the papers of this cause, the several certificates of deposit therewith filed and collect the same and that he also collect from the administrators of John Wills deceased the sum of Twelve hundred and five dollars with legal interest thereon from the 30th day of November 1843 until paid and that being the balance of the cash payments for the lands sold under a former order in this cause as shown by Commissioners report that he collect of Garnett Lee the sum of One Hundred and twenty eight dollars and seven cents with legal interest thereon from the lst day of January 1850 until paid that being the balance of the purchase money due by him after crediting the sums paid to him and Fowler and wife and to Elizabeth Lawhorn, and out of the proceeds thereof that he pay the outstanding costs of this suit including a fee of Thirty dollars to Garland and Slaughter and the costs of executing this decree and then that he pay, to Garnett Lee the sum of Forty five dollars and forty two cents for taxes on the land and tickets in this cause paid by him, and to William W. Andrews the sum of eight dollars and ninety three cents for tickets paid by him and that he also pay to Richard Lee the sum of One hundred and two dollars and thirty cents with 5 per cent interest thereon from the lst day of January 1850 until paid, to Mark Andrews the sum of Twenty dollars and seventy four cents with like interest from the lst day of January 1850 until paid, to John Andrews the sum of Seventeen dollars and sixty nine cents with like interest from the lst day of January 1850 until paid, to Mosby Arnold and Ann D. his wife the sum of Ninety five dollars and thirty seven cents with like interest from lst of January 1850 until paid, to John A. Lee, the sum of Two dollars and sixty three cents with like interest from the lst of January 1850 until paid, to Richard H. Lee guardian for Frances I., Susan A., and Madison Lee, the sum of Seven dollars and sixty three cents with like interest from the lst day of January 1850 until paid, to James H. His wife, the sum of Nine dollars and eleven cents with like interest from the lst day of January 1850 until paid, to Beverly Arnold the sum of Nine dollars and eleven cents with like interest from lst of January 1850 until paid to Thomas Davis and Ann G. his wife the sum of Nine dollars and eleven cents with like interest thereon from the lst of January 1850 until paid, to Willis Rucker and Tabitha his wife the sum of Twelve dollars and thirty cents with like interest thereon from lst of January 1850 until paid, to John Andrews and Patsy his wife the sum of Nine dollars and eleven cents with like interest thereon from lst January 1850 until paid, to Benjamin W. Brooks and Juliana his wife, the sum of Sixty one dollars and thirty nine cents with like interest from lst of January 1850 until paid, to Angelina Lee, the sum of (bottom line of page not photocopied) the sum of Five dollars and forty three cents with like interest thereon from lst of January 1850 until paid, to Beverly Lee guardian of Edward P., Julianna A., Jeremiah E., Robert A. and Chastina Lee the sum of Thirty dollars and twenty cents with like interest thereon from lst of January 1850 until paid to William Hix and Avey his wife the sum of eighty one dollars and thirty seven cents with like interest thereon from lst of January 1850 until paid, and the Court doth further adjudge, order and decree that in case the said funds shall be insufficient to pay these decrees, and those to be made in the 2nd or 3rd of the abovementioned causes, that the deficiency be divided according to the respective interest of the parties in the lands directed to be sold and to be credited on the sums decreed to them respectively, and the principal of the sums of money above decreed to be paid to William Hix and Avey his wife and to Richard Lee, as well as the portions of Elizabeth Fowler and Garnett Lee, Sr. credited on the purchase of land made by the latter or at their respective deaths, to be divided among their children according to the provisions of the will of Richard Lee decd. And the court doth adjudge, order and decree that William W. Andrews do pay to C. T. Wills commissioner as aforesaid the sum of eight dollars and nine three cents with legal interest thereon from the lst day of January 1850 until paid and that the said C. T. Wills do pay over the same to the Administrator of John Wills decd. And it being suggested that the said John Wills departed this life before executing the conveyance to James H. Overstreet directed by the decree on the ___ day of September 1850, the court doth further adjudge, order and decree, that in case said conveyance was not made, that said C. T. Wills who is hereby appointed a commissioner for the purpose do upon the payment of the sum decreed against Garnett Lee, Sr. convey to the said James H. Overstreet, the tract of land heretofore directed to be conveyed to him by deed with special warranty as the cost of said Overstreet. And in the 2nd of these causes, the court doth adjudge, order and decree that Rebecca Lee, Gracey G. Lee, Beverly Lee and Richard A. Lee do pay to Garnett Lee, Sr. the sum of Three hundred and eighty four dollars and twenty cents with legal interest on $362.20 a part thereof from the 24th September 1844 till paid and his costs by him in this behalf expended and that C. T. Wills Commissioner as aforesaid do pay to said Garnett Lee Sr. the sum of Five hundred and ten dollars and thirty five cents with 5% interest from the lst day of January 1850 till paid which sum is to be held by the said Garnett Lee, Sr. during the life of said Rebecca Lee and the interest thereon including interest that has already accrued as well as the portions in remainder of the said Gracey G. Lee, Beverly Lee, and Richard A. Lee in said fund at her death are to be applied to the payment of the foregoing decree against them, and the portions of the remaining children of said Rebecca Lee in said sum of Five hundred and ten dollars and thirty five cents are to be paid to them respectively at the death of the said Rebecca Lee, but the said Garnett Lee is not to have the benefit of this decree until he or someone for him shall enter into bonds with good security before the Clerk of this Court in the penalty of One thousand dollars each the one payable to Rebecca Lee, Gracey G. Lee, Beverly Lee and Richard A. Lee, with condition to perform such future decree as may be made upon their appearing and making defence and the other payable to the remaining children of Rebecca Lee, with condition to pay to them their proportional parts in the said sum of Five hundred and ten dollars and thirty five cents upon the death of said Rebecca Lee - and in the 3rd of these causes, the Court being of opinion that the plaintiff is entitled to be substituted to the rights of Daniel Brown whose judgment created a lien upon the interest of Garnett Lee, Jr. In the land in the bill and proceedings mentioned, the Court doth adjudge, order and decree that Commissioner credit upon the claim of said William Lee against Garnett Lee, Jr. in the Bill mentioned. Ordered that this court be adjourned until tomorrow morning at 8 o clock. S/George H.
