All rights reserved. http://www.usgwarchives.net/copyright.htm ************************************************ Deed - Joseph Payne and Phobe, his Wife to Joseph Brown Witnessed by: John Dent, Robert Nimmo, William Asberry Bedford Co., Virginia Deed Book 5, Pages 496-498 Date: 1 Feb 1777 This Indenture made this first day of February In the Year of Our Lord one Thousand Seven hundred and Seventy Seven Between Joseph Payne and Phobe his Wife of the County of Bedford of the one party and Joseph Brown of the said County of the Other Part Witnesseth that for in Consideration of the sum of Twenty Pounds Current Money of Virginia to them Paid in hand the receipt whereof they do hereby acknowledge and there fore and of every part and parcel thereof do _____ and discharge the said Joseph Brown his Heirs and assigns forever have given granted sold Convey’d and Confirmed and by these presents do give grant sell Release Convey and Confirm unto the said Joseph Brown his Heirs and assigns forever one Certain tract or Parcel of Land Lying and being in the County of Bedford on East Branches of Beaver dam Creek and on the Head Branch of Stony fork of Goose Creek - Continuing two hundred and Sixty Eight Poles by Estimation be the same more or less & Bounded as followeth to wit Beginning at a Red Oak on Weaver line - Thence off North fifty one degrees east Sixty two Poles to a shrub White Oak - on Pates Path South eighty four degrees East one hundred and Ninety Eight poles to a Red Oak South one degree West Two hundred and Seventy six poles to Chesnut North Eighty-Eight degrees West, forty four Poles to a Chesnut North forth two degrees west forty six poles to Chesnut North Twenty Two degrees West one hundred and Sixteen poles to a Small with oak North fifty one degrees west six poles to - Weaver Corner Chesnut and Thence along Weaver line North forty seven degrees West one hundred and Sixty poles to the first Station Together with all Houses - Orchards Gardens Meadow Pastures Fences Woods under Woods ways Waters and Water Courses together with all the Estate Rights Title Interests Possession Claims and Demands of him the said Joseph Payne and Phobe his wife in or to the same or any part or parcel of the Reversion or Reversions Remainder & Remainders of all and Singular the afore mentioned Premises and every of their appurtenances to have and to hold the said Two hundred and Thirty Eight Acres of Land and the Premises with their and Every of their appurtenances unto the said Joseph Brown his Heirs and Assigns to their only proper use and Behoof forever free and Clear of and from all Incumbrances whosoever and further the said Joseph Payne and Phobe his Wife for themselves their Heirs and assigns do covenant promise and agree to and with the said Joseph Brown his Heirs and assigns that him with the receipt and Title of the said Land and Premises and every of appurtenances against all person and Persons whatsoever will warrant and defend unto the said Joseph Brown his Heirs and Assigns and Lastly the said Joseph Payne and his wife Phobe do promise and agree to and with the said Joseph Brown his Heirs and Assigns that they and will be ready at all times hereafter to make - and Deed or Deeds Conveyance and Conveyances as shall be Requisite in the Law for the Better Servicing the Right and title of the said Land and Premises unto the said Joseph Brown his Heirs and Assigns as he or they shall Reasonable desire or Require In witness whereof the said Joseph Payne and Phobe his Wife have Hereunto set their Hands and Seals the day and year above written Joseph (his X mark) Payne (LS) Phobe (her X mark) Payne (LS) Signed Sealed and Delivered In the presents of - John (his X mark) Dent Robert (his X mark) Nimmo) William (his X mark) Asberry Intertined before assigned Memorandum that on the day and year within written Livery of Seison of the sold Land and premises was given made done and Executed by the within Named Joseph Payne to the within named Joseph Brown according to Tenor and Effects of the within Deeds Joseph (his X mark) Payne (LS) Phobe (her X mark) Payne (LS) Witnesses John (his X mark) Dent Robert (his X mark) Nimmo) William (his X mark) Asberry At a Court held for Bedford County the 28th day of July 1777 This Indenture together with the memorandum of Livery of Seison thereon Indorsed were proved by the oaths of John Dent, Robert Nimmo and William Asberry, Witnesses thereof Subscribed and Ordered to be recorded EX Teste J Steptoe, CC NOTE: Livery of Seison - idea that goods need to be handed over in a public setting.
