Booth of the county of Bedford State of Virginia being of sound mind and memory do hereby make publish and declare this to be my last Will and Testatment hereby revoking and making void all former Wills by me at any time heretofore made. First I order and direct my Executor as soon after my decease as practicable to pay off and discharge all the debts dues and liabilities that may exist against me at the time of my decease. Second I give and bequeath unto my wife Marcellar Francis Booth my entire estate for her support during her lifetime and at her death to be equally devided between my three children John a. Booth, Taswel A. Booth and Lula M. Powers and my granddaughter Anna E. Powers. Third I hereby nominate and appoint my son Taswell A. Booth as Executor. In witness thereof I have hereunto subscribed my name this first day of May 1916. /s/ C. B. Booth The above and foregoing instrument was at the date thereof signed sealed published and declared by the said C.R. Booth as and for his last Will and Testament in presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses. W.G. Neighbors of Bedford Co. A.B.Wade of Bedford Co. A codicile to my Will made the 1st day of May 1916. I C.R. Booth being of sound mind and memory have decided to mak some change in this my first Will my grand daughter Anna. E. Powers that I made equal with my three children I have decided to give her, her interest in money and not give her any share in my estate. This done the 30th day of August 1916 /s/ C.R. Booth The above and foregoing codicile was at the date thereof signed sealed and published and declared by the said C.R. Booth as a change to his last Will and Testament in presence of us and in presence of each other who at his request have signed our names as witnesses. W.G. Neighbors of Bedford Co. J.R. Garner of Bedford Co. Virginia, In Bedford Circuit Court Clerk's Office, October 21st 1916 This paper writing, bearing date of May 1st 1916, purporting to be the last will and testament of C. R. Booth, deceased, and a paper writing bearing date of August 30th 1916, purporting to be a codicil to said will, were this day produced before me, in said office. Whereupon W.G. Neighbors and A.B. Wade, the subscribing witnesses to the paper writing purporting to be the will, depose and severally say that they were both present with the testator when he executed and acknowledged the said paper writing to be his last will and testament, and that they then signed their names thereto as attesting witnesses, and the request of the testator, all three being present at the same time. And W.G. Neighbors, one of the attesting witnesses to the paper writing, purporting to be the codicil to said will, deposes and says that he and J.R. Garner, the other subscribing witness thereto, were both present with the testator, when he executed and acknowledged the said paper writing purporting to be the codicil, as and for a codicil to said will, and that they then signed their names thereto as attesting witnesses, at the request of the testator, all three being present together at the same time. Whereupon the said paper writings are admitted to probate and record as and for the true last will and testament and codicil therto of the said C.R. Booth, deceased. Upon the motion of Tazwell A. Booth, and in pursuance to the nomination in said will he is hereby appointed as Executor therof. Whereupon the said Tazwell A. Booth took the oath proscribed by law, and with John A. Booth, A.B.Wade and W.G. Neighbors, who justified, as his sureties, entered into and acknowledged a bond in the penalty of $1,600.00, conditioned as the law directs. Certificate is granted him for obtaining a probate of said will in due form and said bond is approved and admitted to record. Teste: _______ Deputy for S.M. Booth, Executor of C.R. Booth, deceased, this day personally appeared before me, in said office, and made oath that the above list is believed by affiant to be true. Bolling, Clerk Bedford Circuit Court Clerk's Office, October 21st, 1916 This list of names, ages and addresses of the heirs of C.R. Booth, deceased, was this day filed in said office by Tazwell A. Booth is Charles Robert Booth, husband of Marcella Frances Wade Booth and father of John A. Booth, Leila M. Booth Powers, and Tazwell A. Booth. He was the son of John Booth and Elizabeth Craghead. He was born March 28, 1937 and died October 14, 1916 of cystitis. He is buried at home. (see Commonwealth of virginia, Department of Health, Division of Vital Records File # 24201 - death certificate. Division of Vital Records also has a Certificate of Marriage, (page 28, line 40) dating the marriage on December 18, 1860 when Charles was 24 and Marcella 23. His birthplace is shown as Franklin County and hers as Bedford County. Ceremony performed by J.R. Harrison.
