Will of Simmons (Simmonds) EVERITT (EVERETT), dec. Nov. 25, 1822, Bedford County, VA Bedford Co., VA, will book 5, page 376 signed and sealed July 7, 1822 In the name of God Amen. I Simmons Everitt of the County of Bedford being weak in body but in perfect memory and mind thanks be to Almighty God for his mercies, & calling to mind the uncertainty of this transatory life and being willing to settle all my worldly affairs do make and ordain this to be my last will and testament. In form and manner following, to Wit. I command my soul to God who gave it hoping through the death and merits of Jesus Christ my savior to be made partaker of the never fading joys of Immortality at the day of the resurection. And as for what temporal estate it has pleased God to bestow on me, I give and bequeath in the following manner. To Witt, Item I have formerly given to my son Thomas Everitt a tract of land to which I have made him a title to him I give nothing more. Item I give to my son William Everitt a negroe boy by the name of Squire upon his paying his brother Jeremiah Everett the sum of one hundred dollars. Item I give and bequeath to my son Jeremiah Everitt one hundred dollars in the hands of his brother William Everett apart of the price of my boy Squire. Item I give to my son Jesse Everett one negroe girl by the name of Martha and her future increase forever. Item I give to my son Samuel Everett one negroe boy by the name of Bobb. Item To my daughter Elizabeth Guttery I have given one negroe girl by the name of Lottie with her increase forever. Item I give to my daughter Hulda Sammons a negroe girl by the name of Cynthia and her increase forever. Which girl she now has in possession. Item: I give and bequeath my daughter Nancy Everett one negroe girl by the name of Doshico with her increase forever and if my daughter Nancy Everett should never have possess she may dispose of the said negroe girl Doshico and her increase provided the disposition be made to some one or all of the surviving brothers and sisters and if she does not dispose of the said negroe and her increase in that way at her death my will is that the aforesaid property shall decend to my surviving children to them and their heirs forever. I also lend to my daughter Nancy Everette during her natural life my mansion house including the Land from the mouth of the Peach Orchard Branch up to Lowrys line and thence along Lowrys line to the Sam ridge from thence a straight line from the Sam ridge to the Spring and down the spring branch to Otter River than thence up the river to the begining. Item: I give the balance of my trace of land to my son John Everette and his heirs forever and also that part of the trace that I have lent to my daughter Nancy after her death. I also give to my son John Everette, my negroe boy Isacce forever. I also give to my son, John, one still and one shotgun forever. Item I now lend to my loving wife Elizabeth Everett after paying all my just debts all my Estate real and personal during her natural life that I now hold in possesion to wit my negroe woman Dehela my girl Doshio, my boy Bob, my girl Martha, my boy Squire, also my stock of every description my household and kitchen furniture plantation utensils. Item its also my will that my son John Everett shall have the privilege during the life time of my wife to cultivate a part of this plantation whereon I now live. Its my will that any of the negroes bequeathed to my children should die before they get them unto their possession that their legacy should be made good out of any of the recorded part of my estate if it not otherwise exhausted by the payment of my just debts that I may owe at my decease. I do constitute and appoint Davis Saunders, my sons Thomas Everett and John Everett my Executor to carry this (revoking all other wills that I have heretofore made) my last will into effect given under my hand and seal this 9th July 1822. Simmonds Everett At a court held for Bedford County at the courthouse the 25th day of November 1822 This last will and testament of Simmonds Everett deceased was proved by the oath of Paschal W. Nance, Thomas D. Overacre and William Ryan they subscribing witness thereto and ordered to be recorded. And on the motion of Davis Saunders and Thomas Everett two of the executors their named who made oath and gave bond and securitys according to same certificate is granted them for obtaining a probate thereof in due form liberty, being received the other Executor to join in the probate wherever he shall think fit.
