Division: "We on the 12th day of this month proceeded to examine, state and settle the account current of the estate of Thomas Wood deceased with Elizabeth Wood the Executrix and find a balance due unto the said Executrix of £46.8.7 one half penny...to be paid out of the real estate. Also that under the will the said Executrix as widow of the decedent is entitled to her dower in the lands of which the decedent was seised during his lifetime to which she hath not relinquished her right, but we cannot lay off the said Dower without the assistance of a Surveyor." ".......on the day aforesaid in presence of all the parties proceeded to make a division of the said decedents estate agreeable to his Will among several legatees: Heirs of Phebe Wood or Purnell: all the right......which the heirs and legatees of the said decedent ( the widow's Dower excepted) have to a tract of land now in contest between them and Peter Purnell in the High Court of Chancery on an appeal from a decree of this Worshipful Court. Also one undivided fourth part of the tract on the waters of Little Otter in this county containing 470 acres purchased by the decedent from Robert Clark, and the sum of £28.17.11 and 3 farthings in Specie with legal interest from this date till paid. James Wood: one undivided moiety of the lands on Bigg Otter River bounded by the aforesaid land which the decedent purchased from Clark and by the lands of John Sharp, Andrew Donald, Joseph Hardy, Callohill Mennis and William Quarles, Senior on condition that he pay unto the Executrix the sum of £12.7.0 and one farthing with legal interest from this date till paid. Jeremiah Wood: the other undivided moiety of the land last above mentioned on condition that he pay unto the Executrix the sum of £12.7.0 and one farthing with legal interest from this date till paid. Josiah Wood: an undivided 3/4 parts of the 470 acres on Little Otter purchased from Robert Clark as above described and the sum of £11.7.11 and 3 farthings to be paid to him with interest thereon from this date until payment. (_____) Smith,wife of Jonathan Smith: 3 surveys adjoining the "Hearkning Hill in Botetourt County" on condition of paying to the Executrix £ 21.14.7 and unto Josiah Wood £2.19.11 and one farthing both sums to bear interest from this date till paid. (Note: Elizabeth Wood, daughter of Thomas, married Jonathan Smith 15 March 1791 according to the Bedford County Marriage Records) Jonathan Wood: the tract of land on Jennings Creek in Botetourt County containing 162 acres known by the name of McGuires old place and the tract of 400 acres on the Chesnut Mountain in said County, on condition of paying £12.7.0 and one farthing to the heirs of Phebe Wood deceased with interest from this date. Sidy, the wife of Henry Dooly: these 2 tracts of land whereon the widow at present resides which were purchased by the decedent from McGuire and Yoakum on condition of paying Josiah Wood £8.8 and 1/2 penny and unto the heirs of Phebe Wood £16.10.11 half penny both sums to bear interest from this date.
