Present. William Fleming, George Skillern, Philip Love, Andrew Woods and Adam Smyth, Gent. Justices. John Davis is on his motion exempted from paying levies for the future on account of his age & poverty. Ord. that Jane Welsh, daughter of Thomas Welsh, be bound by the church wardens to Henry Woodley accdg. to law. A valuation of improvements amounting to four hundred and sixty eight pounds, three shillings made on a tract of land in Botetourt County on the Ohio River about three or four miles above the Raped at the Great Bent belonging to George Washington, Esquire, containing four thousand, three hundred and ninety five acres of land, was presented in court by James Cleveland, Agent for the said Washington, and proved by the oath of the said James, according to law, and ordered to be recorded. A writing was presented in court as and for the last will and testament of James Trimble, decd., by John Trimble, Isaac Trimble and James Trimble, the executors therein named and was proved by the oaths of John Maxwell and Hugh Barcley, witnesses thereto, and (missing word) to be recorded. Ordered that John Paxton, Joseph Walker and William McKee being first sworn do appraise in current money the slaves (if any) and personal estate of the said James Trimble, decd., & make return of the same to the court. And on the motion of the said executors who made oath according to law, certificate is granted them for obtaining (missing word) thereof in due form, they having entered into bond in the sum of two thousand pounds with John Bowyer, James Gilmore and William Paxton, their securities. A report of a road from Botetourt Courthouse to Alexander Stewart's plantation on James River was retd. to court and sd. road is established, and Robert Burdwell is appointed Surveyor of the same, and the petitioners for the sd. road are to clear and keep the same in repair as the law directs. Ord. that the court be adjd. till tomorrow morning, six o'clock. The minutes of these proceedings were signed by Philip Love At a court continued & held for Botetourt County the 16th of April, 1776. Present. John Bowyer, William Fleming, Geo. Skillern, Benjamin Estill, Philip Love, William McClenachan and Adam Smyth, Gent. Justices. Upon the complaint of Wm. Hutcheson against Richard Woolley, his servant, parties heard and the said Richard confessing that he had stole his conviction bill from his said Master and had destroyed it, whereby he was bound to serve his said Master ten years and ten months from this day. It is ordered that the same be recorded and that the said Richard serve his said Master the term aforesaid, Ord. that the Sheriff summon twenty four of the most capable freeholders in this County to appear here at the next court to serve as a Grand Jury of Inquest for the body of this County. Agreeable to an ordinance of Convention, the court appoints William Fleming to act as Sheriff in this County, who refused to serve, and thereupon the court proceeded to the appointment of an other person to that office, when George Skillern was chosen into the same, and thereupon the said George took the oath pointed out by Convention and entered into bonds according to law, one for the sum of five hundred pounds for the collection of the taxes, fines, forfeitures and Amendments, and the other in the sum of one thousand pounds for the collection of officers' fees and dues and for the faith, execution of the said office of Sheriff, with Patrick Lockhart, William McClenachan and John May, his securities. Samuel Lapsley and Saml. Walker sworn Deputy Sheriffs for this County, being apptd. to the said offices by George S. Killern, Gent. Sheriff of this County. George Skillern protest against the sufficiency of the prison of this County. Ord. that the ct. be adjd. till court in course.
