Present: John Bowyer, Andrew Woods, Richard May & Wm. McClenachan, Gent. Justices. A writing was presented in court as and for the last will & testament of Jacob Kine, decd., by Mary Kine and Hugh Crockett, two of the Exors. therein named, and was proved by the oaths of John Madison, William Walton & James Brown, witnesses thereto, and is ord. to be reed. And on the motion of the said Exors., who made oath accdg. to law, certificate is granted them for obtaining a probate. Whereupon they entered into bond in the sum of £5000, with John Madison and William Preston securities according to law, and leave is reserved to the other Exors. to join in the probate. William Simpson is apptd. Surveyor of the Road from his shop to the line of Montgomery County in the room of William Madison, and the tithables formerly allotted to work under him on the said road do attend the said Surveyor when required to keep the same in repair according to law. Ord. that James Barnett, William Madison, John Reaburn and Henry Waterson or any three of them being first sworn do appraise in current money the slaves (if any) and personal estate of Jacob Kent and return an account thereof to the court. A valuation of improvements made on 1374 acres of land in Botetourt County on the Ohio River belonging to James (missing word), amounting to £120, was returned & ordered to be recorded. Ord. that John Greenlee, John Gilmore and James McClure being first sworn do view the way that crosses Potuts Gap at Arnold's to James River at Stepheson's Ford and make report to the court. Ord. that John Davis, a bastard child, be bound out according to law. Ord. that Thomas Bratton, a bastard child of Amy Bratton, be bound out accdg. to law. On the complaint of John Robinson against Mary Edgers, his servant, ordered that she serve him eight months after the expiration of her present indenture to reimburse him for trouble & loss of time in apprehending and bringing her home when run away. James Henderson, a Justice of the Peace, and George Davidson, an Ensign in the Militia, were qualified accdg. to law. John Robinson who was suspected of being a disaffected person to the United States of America, this day appeared in court & being examined it appears to the court that there is reason for such suspicion. Therefore it is ordered that he enter into a recognizance to appear at the next court, himself to be bound in the sum of £100 and to find two securities to be bound with him in the sum of fifty pounds each. John Robinson, Robert Gillispie & Daniel Prentice acknowledged themselves to be severally indebted to the Commonwealth of Virginia, the said John Robinson in the sum of £100 and the said Robert Gillispie and Daniel Prentice each in the sum of £50 of their goods & chattels, lands & tenements to be levied & to the said Commonwealth rendered. But on condition that if the said John Robinson shall make his personal appearance at the next court to answer a complaint against him for being an enemy to the United States of America & for expressing himself contrary to an Act of the late General Assembly of this State by acknowledging the authority of the King of Great Britain over the said States, & shall not depart without the leave of the said court, this recognizance to be void. George Skillern, Gent. Sheriff of this County, enters his protest against the sufficiency of the prison of this County. Ordered that the several Militia Captains in this County do make a list of all the tithable persons and taxable lands within their respective districts and that they return said lists respectively to the next convenient Magistrate of his County, to be by them returned to the court. .John Burdwell is apptd. Surveyor of the Road from the Beaver Dam cross path at James Rowland's to Andrew Henry's new field, and Thos. Rowland's, Andrew Henry's, James Rowland's, Rich Willson's, Ephraim Willson's, George Hutcheson's, Thomas Hutcheson's, Samuel Henderson's, Isaiah Vinsandt's, George.Burdwell's & Wm. Hutcheson's tithables are ordered to attend when required to keep said road in repair as the law directs. Ord. that John Trimble, John Poage, Junr,, James Taylor & Andrew McKinley or any three of them being first sworn do view the new road from the fork above John Paxton's to the North River and the way proposed by John Paxton from the same place & make report of the conveniences & inconveniences and of the distances of each to the next court. Ord. that Thomas Spencer be summoned to appear at the next court to shew cause why his children should not be bound out by the church wardens, as they are likely to become chargeable to the Parish. David May, Deputy Clerk of this Court, took the oath prescribed by an Ordinance of Convention for that purpose. Ord. that this ct. be adjd. till court in course.
