Present: William Fleming, Benjamin Estill, Andrew Woods & Richard May, Gent. Justices. An instrument of writing was prestd. in court as & for the last will & testament of Michael Woods, and was proved by the oaths of John Logan, George Dougherty and Charles Lambert, witns. thereto, & ord. to be recorded. And on the motion of David Woods, one of the Exors., who made oath accdg. to law, certificate is granted him for obtaining a probate. Bond entered into with John Logan, his security, in the sum of £1000 & liberty is reserved for the other Exors. to join in the probate. And it is ord. that Audley Paul, Benjamin Estill and Christopher Vyneard having been first sworn do appraise in current money the said Michael Woods' estate & make report thereof to the court. Ord. that James Moore, Wm. McClelon & Matthew Ralston being first sworn do view the way through which it is proposed to establish a road from the court house to William Ward's saw mill and report the conveniences & inconveniences to the court. Ord. that the church wardens bind out Giltree Talbot, a bastard child of Mary Bryan, accdg. to law. William Leagerwood is apptd. Surveyor of the Road from his house to the division of the said road in the room of James McAfee, John Mills, Junr. from the Beaver Dams to James River, James Leatherdale, Junr., from the said Beaver Dams to Moore's Creek & Wm. McCIelan from the said Creek Mrs. Breckinridge's. William Bilbro is apptd. Surveyor of the Road from James River to Renexes in the room of Benjamin Estill. The Commonwealth against Robinson the defendant appeared and nothing being alledged or proved against him the said complaint was dismissed. The same against John Vanbbber [sic] & William Davies. The defendants appeared and being heard court's opinion the same as to Vanbbber be dismissed, but it appearing that the other defendant has larnt the art of making gun powder & from his connexions with the Indians, and his intending to go amongst them again, where has lived upwards of twenty years, the court's opinion that he shall enter into bond with security in the sum of £1000 himself & 2 securities in £500 each, not to depart the Commonwealth within 12 months, and he is committed to the custody of the Sheriff till he comply with this order. Ordered that this court be adjd. till tomorrow morning, 7 o'clock. The minutes of these proceedings were signed by Benjamin Estill At a court continued and held for Botetourt County the 12th of March, 1777. Present. Benjamin Estill, Andrew Woods, Richard May & Adam Smyth, Gent. Justices. Charles Stewart, a servant, against Joseph Miller, his Master. Complaint dismissed for want of prosecution. Ordered that the following rates be observed by the ordinary keepers in this County, towit: For a gallon of whiskey, doubly distilled, 12/ Do. singularly Do. they shall not demand more than 10/; for brandy the same; cider per quart, 6c; for beer, the same; diet, 1/3; lodging, 6d; grain per gallon, 7/2d; hay and stablage 12 hours 7/2d or same 24 hours 1/; pasturage 12 hours, 6d; Continental rum per gallon, 8/; West Indian rum per gallon, 16/; rum toddy per quart, 1/6; brandy or whiskey do., 1/ per quart; if double distilled whiskey, 1/3 per quart. The order made yesterday for William Davis to find security to depart this State is set aside. And thereupon the said Wm. Davis & John Vanbbber acknowledge themselves indebted to the Commonwealth of Virginia, the said William in one thousand pounds and the said John in five hundred pounds of their respective goods & chattels, lands & tenaments to be levied and to the said Commonwealth rendered. But on condition that if the said William shall not depart this State within twelve months from this day without leave of the court but shall appear here at March court next to do what he court shall in that part consider, and that in the meantime he do not curry or correspond with the Indians or other enemies of this State, then this obligation to be void. And thereupon the said William is discharged. Ord. that the ct. be adjd. till the court in course.
