Present: Benjamin Estill, Andrew Woods, Richard May & Adam Smyth, Gent. Justices. John Bowman, one of the Justices of the Peace for said County, took the oath of a Justice of the Pence agreeable to an ordinance of Convention. Moses Collier, an Ensign in the Militia, took the oath directed by an Ordinance of Convention. John Yancy is npptd. Surveyor of the Road from Buchanan's Ferry to Thomas Rowland's, and the tithables before allotted to that road by George Skillern to work thereon when required to keep the same in repair accdg. to law. Andrew McKinley, John Trimble & James Taylor, having reported that the way proposed for a road by John Paxton's from the fork next to the North River to Samuel Wallace's field &, and thence through the same as the old road formerly run before it was shut up by the said Wallace, is the best, the lowest and most convenient for travellers. Ordered that the same be established accordingly, that the said Wallace be discharged from the office of Surveyor of the said Road, that Joseph Walker, Junr. be Surveyor of the Road from the said River to James Buchanan's, and John Poage, Junr., from the said Buchanan's to Buffaloe Creek, & that John Trimble and John Moore divide all the tithables living within three miles of said road between the said Surveyors. And it is further ord. that the said Joseph Walker with the tithables belonging to his district do open the road through the said Wallace's field agreeable to this order. And that the Sheriff with a sufficient number of his County Militia do attend the said Surveyor upon notice of the day he shall propose to open the said road to remove force and violence, if any be offered by tho said Wallace or any other person. A copy of the order of court made in August, 1776 for Samuel Wallace and Mathew Elder to open the road which they had stopped by them having been duly & and not complied with, it is considered by the court that they be fined for their contempt, the said Wallace in the sum of twenty pounds and the said Mathew the sum of five pounds. Benjamin Estill, Philip Love & Andrew Woods, Gent., are recommended to his Excellency the Governor rts fit persons to execute office of Sheriff, which office the said Estill refused to except of. Ord. that the ct. be adjd. till court in course.
