Present. Robert Breckenridge, Israel Christian, William Preston & Stephen Trigg, Gent. Upon the petition of Stephen Trigg a licence is granted him to keep an ordinary at his house at Millers Mill for one year & from thence till the next court held for this County, whereupon the sd. Stephen together with Thomas Madison his security entered into & acknd. bond as the law directs. Luke Bowyer produced a commission from his Excellency the Governor appointing him King's Attorney for this County and took the usual oaths to his Majesty's Person & Government, repeated & subscribed the test and also took the oath of King's Attorney. Upon the petition of Samuel Ingram for leave to build a mill on the Thornspring Run, ordered that the Sherif do summon a jury thereon accdg. to law to enquire what damages the same may be of to any person and that he make report of the Jury's verdict to the next court. John Murray proved a certif. accdg. to law for nine hundred and five pounds of winter rotted hemp made on his plantation in this County. Joseph Walker the same for fourteen hundred fifty two pounds of hemp. Matthias Yoakum the same for four thousand five hundred and eighty six pounds of hemp. James Campbell the same for three thousand six hundred and ninety two pounds of hemp. Caleb Worley the same for three thousand four hundred and sixty pounds of winter rotted and eleven hundred and eighty seven pounds of water rotted hemp. Patrick McCalom the same for two thousand and seventy six pounds of winter rotted hemp. Thomas Paxton the same for three thousand nine hundred and thirty five pounds of hemp, the same for four thousand four hundred and ten pounds of hemp. Adam Wallace proved a certificate accdg. to law for five hundred and ten pounds of winter rotted hemp made in this County. Robert Whitley the same for twelve hundred & sixty eight pounds of hemp. William Matthews the same for six hundred three quarters and seventeen pounds of gross hemp. John Paxton the same for eight thousand eight hundred and ninety five pounds of hemp. George Sailing the same for seventeen hundred fourteen pounds of hemp. Peter Wallace the same for seventeen hundred and sixteen pounds of hemp. Samuel McCorkle the same for two thousand seven hundred and fifty pounds of hemp. Henry Larkin the same for two thousand and ninety nine pounds of hemp. William McKee the same for five hundred and fifty seven pounds of hemp. David Wallis the same for eight hundred and eighteen pounds of hemp. James Gilmore the same for seventeen hundred and fifteen pounds of hemp. Upon the petition of Walter Stewart a licence is granted him to keep an ordinary at his house for one year and from thence till the next court held for this County, whereupon the said Walter together with Jonathan Smith his security entered into and acknd. bond conditioned as the law directs. Ordered that the Church Wardens for the Parish of Botetourt do bind out Martha Conner, an infant orphan of Anne Conner, decd, to James Campbell according to law. Ordered that the Church Wardens for the Parish of Botetourt Court do bind out Michael Courtney, an infant orphan of Perdiew Courtney, decd., accdg. to law. Ordered that Thos. Rowland, George Burdnell, Isaiah Vinsent & Joseph Looney do view and report the nearest and best way from where the court house is to stand to George Skillern's plantation to the next court. William McKee, William Fleming & Andrew Woods, three of the Justices named in the Commission of the Peace for this County, and in the Commission of Oyer and Terminer for the same took the usual oaths to his Majesty's Person and Government, repeated & subscribed the Test, took the oaths of a Justice of Peace, of a Justice in the County Court in Chancery, and of a Justice of Oyer & Terminer. Arthur Woods took the usual oaths to his Majesty's Person and Government, repeated and subscribed the Test, & took the oath of Deputy Sheriff for this County. This court doth appoint William McKee to be Surveyor of a Road to be opened from his house to Hall's Mill agreeable to an order of Augusta Court made in August, 1768, and it is ordered that he together with the tithables within two miles thereof on both sides do open and keep the same in repair accdg. to law. Ordered that the Court be adjourned till tomorrow morning, eight of the clock. The minutes of these proceedings were signed. Robt. Breckenridge At a court held for Botetourt County the 11th day of April, 1770. Present. Robert Breckenridge, Israel Christian, William Preston, William Fleming, John Bowyer & Stephen Trigg, Gent. It is ordered that the Sherif summon twenty four of the most capable freeholders of this County to appear here on the second Tuesday in May next to serve as a Grand Jury. Ordered that the Surveyor of this County do lay off two and a half acres of land for the use of the County at such place as he shall be directed to by Robert Breckenridge, Israel Christian, John Bowyer & William Fleming, & from the place where the aforesaid Justices shall direct the Court House to be built he do lay off ten acres of land for prison bounds. The court doth appoint Is. Christian & Stephen Trigg to agree with a workman to build a log cabbin twenty four feet long and twenty wide for a Court House, with a clapbord roof with two small sheads, one at each end for jury rooms. The Court doth give leave to James McGavock to build a log cabin twenty feet long and sixteen feet wide, with an addition at the end of it the same width and twenty feet long for a prison and the Coaler's House, the expence of which to be repaid him by the County. Ordered that this court adjourn till court in course. These proceedings were signed. Robt.
