Present: William Fleming, George Skillern, William McClanachan & Adam Smyth, Gent. Justices. Andrew Woods produced a commission from his Excellency the Governor apptg. Sheriff of Botetourt County, who took the oath prescribed by law &e entd. into bond conditioned as the law directs with George Skillern and William McClenachan, his securities, in the sum of £1000. Robert Woods is apptd. Dep. Sheriff under Andrew Woods in this County, who took the oath required by law. Ord. that Thomas Madsion be recommended to the Attorney General as a fit person to execute the office of State's Attorney for this County. Ord. that John Smith, John Compton & John Mills being first sworn do view the shore on Wm. Anderson's side of James River and report to the court the most convenient landing place for a ferry from Crow's Land. On the petition of Andrew Woods leave is granted him to build a water grist mill on Looney's Creek on his own land, and it appearing to the court that no other person's land will be effected thereby. Ord. that the ct. be adjd. till tomorrow morning, 9 o'clock. The mins. of these procdgs. were signed by William Fleming At a court contd. A held for Botetourt County the 12th of February, 1778. Present: William Fleming, Geo. Skillern, William McClanachan & Adm. Smyth, Gent. Justices. James Henderson, Andrew Donally, John Stewart, Saml. Lewis, Saml. Brown, Geo. Poage, Wm. Hamilton, Muddy Creek, William Ward and Michael Woods, Gent., are recommended to his Excellency the Governor as proper persons to serve as Justices of the Peace for the County of Greenbrier. Wm. Christian, Patrick Lockhart, Thomas Lewis, Geo. Rutledge, Jonathan Taylor, Wm. Hamilton, Sweet Springs, Thomas Rowland, John. Armstrong, Robt. Poage and James Bar-net t are recommended to his Excellency the Governor as proper persons to be added to the Commission of the Peace for this County. And it is recommended that the Justices who refused to qualify under the old commission shall be left out. On the petition of Patrick Lockhart leave is granted him to keep an ordinary at his house in this County for the space of one year from this time, he giving security, on which he together with David May, his security, entered into and acknd. bond for the said Lockhart's keeping the said ordinary accdg. to law. And it is ordered that the Clerk of this County prepare a licence for him accdgly. The same to James Barnett. Bond entd. into with William McClanachan, his security. Ordered that William Cross with the tithables persons belonging to his precinct do keep the road from George Skillern's down the river bank to Crow's in repair as the law directs. John Potts is apptd. a Constable about the courthouse in the room of James Ghant, decd. Ord. that Patrick Lockhart, James Rowland, Josiah Phipps and John Potts or any three of them being first sworn do view the way from the ford on Catawba at Wm. Hawkins' to Israel Christian's mill and report the most convenient way for a road to the court. Thomas Reed is apptd. a Constable in the room of George Burdwell, who is discharged from that office. James Barnett, Capt., & George Hutcheson, Ensign, in the Militia took the oath required by Ordinance of Convention. Ord. that the ct. be adjd. till court in course. The mins. of these procdgs. were signed by Wm. Fleming There being no prison in this County, ordered that the Sheriff be empowered to summon a guard over any prisoner which he may have in his custody untill a prison shall be built.
