Present: William McClenachan, William Madison, Patrick Lockhart and Adam Smyth, Gent. Justices. Capt. Alexander Hanley having advanced by direction of this court the sum of six pounds fourteen shillings for provisions for the use of Elizabeth Ralston, whose husband is a soldier in the Continental Army. Ordered that he advance the further sum of thirteen pounds six shillings for the same purpose, and be exalted to draw for twenty pounds to refund him the said disbursement. William Hamelton and Robert Poage, two of the Gentlemen named in the Commission of the Peace for this County, took the oath reqd. by the Ordinance of Convention. The Commonwealth against George Lefener for a breach of the peace, parties heard. It is ord. that the said Lefener be bound in twenty pounds and two securities in ten pounds each that he shall be of good behaviour to all the subjects of this Commonwealth for and during the term & time of twelve months from this day. Whereupon the said George together with James Norvill ahd Archibald Kyle, his securities, came into court and acknd. themselves, the sd. George in twenty pounds and his said securities in ten pounds each of their respective goods & chattels, lands & tenements to be levied, with condition that the sd. George shall be of good behaviour the term &c. Ord. that the ct. be ajd. till tomorrow morning, 8 o'clock. The mins. of these procdgs. were signed by Adam Smyth At a court contd. & held for Botetourt County the 12th day of August, 1778. Present: Wm. McClenachan, Adam Smyth, Patrick Lockhart, Wm. Hamelton & Robert Poage, Gent. Justices. Wm. McClenachan, a Justice, took the oath reqd. by law. Andrew Woods with Wm. Preston and Patrick Lockhart, his securities, entd. into & acknd. bond accdg. to law for the said Woods' true & faithful collection of the publick duties and taxes in this County which have become due by virtue of an Act of Assembly passed the (blank date) day of January, 1778. David May produced a commission from the President and Masters of Wm. & Mary College appointing him Surveyor of Botetourt County, who took the oath required by law, whereupon the said Laird with Patrick Lockhart, his security, entd. into bond in the penalty of £600 pounds accdg. to law. Ord. that agreeable to an Act of Assembly Sarah Chambers draw from the Treasurer of Virginia, whoso husband is a soldier in the Continental Army, the sum of ten pounds for the support of herself and child. Ord. that Andrew Armstrong, John Griffeth and Samuel Crawford being first sworn do view the way proposed by John Neelly, Junr., from the end of the Long Meadow to James Neelly's & report the conveniences & inconveniences to the court. Ord. that John Stewart's, Thomas Madison's, William Graham's, Wm. Carvin's, Hugh Miller's, James Goodman's, Mathew Amack's, Sainl. Amack's, Thomas Welsh's, Andrew Harrison's, James Stewart's, John Depu's, John Howard's, Wm. Buknald's tithables do work on the road from John Stewart's to John Howard's under David May, Surveyor thereof, and it is further ordered that James Robinson's, Wm. Breckinridge's & Martain Baker's be added to the gang. This court doth appoint Francis Guthery to take and keep the court house clean till next court. William Ross is apptd. Surveyor of the Road in the room of Bryant McDonald, deed. John Neelly, Junr., the same from Thomas Barnes to James Neelly's and the tithablcs within two miles of said (missing word) to attend him to work on the same when required to keep said road in good repair as the law directs. Ordered that the Sheriff advertize the publick that this court will proceed on the docket at September Court, that all those who have suits depending may attend properly prepared for trial, and those who neglect may expect no further indulgence. And it is further ordered that he also summon the Justices now absent, as well as those who have as those who have not qualified to attend, and that such of them as do not evidence their willingness to serve in that character shall be left out of the Commission.
