Present: Geo. Skillern, Adam Smyth, Thomas Rowland, Jno. Armstrong and James Barnet, Gent. Justices. Ord. that the Surveyor of the County proceed immediately to run the dividing line between this & Rockbridge County agreeably to an Act of Assembly. Harry Innis and Andrew Moore, Gent., attornies, took the oath required by law. George Poage took the oath of Colo, in the Militia of this County accdg. to law. Benjamin Estill, one of the Gentlemen named in the Commission of the (missing word) for this County, took the oath reqd. by law. Upon a motion made by Geo. Hutcheson against Charles and Anne Stewart, his servants, parties heard, court's opinion that they serve their said Master eighteen months each over & above the expiration of the term of their indentures to reimburse him £12.5 expended in having them retaken when run away. Ord. that the church wardens of Botetourt Parish bind out John McCollock, an orphan child of Neelly to James Tosh accdg. to law. Edward Mitchell took the oath of a Deputy Sheriff under Andrew Woods, Sheriff of this County, accdg. to law. The order made for Charles and Anne Stewart to serve George Hutcheson, their Master, eighteen months each, adjudged good. Whereupon the said Charles and Anne came into court and agreeable to an Act of Assembly paid down to their said Master twelve pounds five shillings for which they were to serve their said Master the time aforesaid. Therefore it is considered by the court that they be set at liberty after the expiration of their said indentures. Ordered that John Depew be Surveyor of the Road from John Howard's to the Big Lick, and that the tithables within three miles of the said road do attend the said Surveyor when reqd. to keep the same in repair as the law directs. Ordered that James Pearie, Junr., be apptd. a Constable on Rennix's Run. Ord. that James Anderson be apptd. in the room of John McRoberts to appraise the estate of George Inglebird, decd. Ord. that the ct. be adjd. till tomorrow morning, six o'clock. The mins. of these procdgs. were signed by George Skillern At a court contd. & held for Botetourt County the 9th day of September, 1778. Ord. that the church wardens bind Catharine Hance, a bastard child of Grace Thompson, to Lettice Brekinridge accdg. to law. Ord. that the church wardens bind Saml. Jones, Sarah & Elizabeth Jones, bastard children of Elizabeth Jones, to Patrick Lockhart accdg. to law. Ephraim Dunlop, Asee. Of Francis Byrd, Plff. ) against ) In Debt Geo. Patterson, Adm. of the Estate ) of Arthur Woods, Decd., Deft. ) This day came the parties &c. & also, a jury, towit: Stephen May, Patrick Shirkey, Francis Rowan, John Tatham, Hugh McNell, William Thompson, Geo. Lefner, Andrew Henry, Joseph Hanah, Simion Alderson, William Robinson & Samuel Henderson, who retd. verdt. in favor of the plff. Judgt. for eight pounds ten shillings accordingly in favor of the plff. But this judgt. is to be dischd. by the payment of five pounds five shillings with interest thereon from the ninth day of March, one thousand seven hundred and seventy three till paid and his costs. Isaac Robinson is apptd. Surveyor of the Stone House to Thomas Barnes', and the usual tithes to attend him when reqd. to keep the road in repair as the law directs. This court doth recommend Luke Pryor, Saml. Eason and Joseph Martin to his Excellency the Governor as fit persons to be added to the Commission of the Peace for this County, that Philip Love, on account of his declining state of health, and William Christian, Thomas Lewis and Jonathan Taylor, who refuse to qualify, be left out of the Commission. Ord. that Laird Anderson bring in his charge at the laying the next County levy for keeping Christopher Fenner, who the court consider as an object of charity. Ord. that James Cloyd, Thomas Miller, William Kyle and Joseph Kyle or any three of them being first sworn do view the way from Capt. Christian's mill to Benjamin Hawkins' on Catawba, and report the best, shortest & most convenient way to the court. Ord. that Capt. Crow bring in his charge against the Parish at the laying the next County levy for keeping William Duncan, who the court consider as an object of charity. Ord. that the ct. be adjd. till the court in course.
