Present. John Bowyer, William McClenachan, William Fleming & Adam Smyth, Gent. Justices. A Grand Jury appeared and was sworn, towit; Samuel Walker, James Gilmore, Andrew Armstrong, John Neelly, Wm. Adams, Richard Watkins, Joseph Walker, Junr., Saml. McClure, Junr., Robert Burdwell, Wm. Scott, John Cartmill, James Hutcheson, Mathew Ralston, John Larkin and William McClure, who having received their charge went out of court to consult of their presentments. Andrew Lewis proved a certificate according to law for thirteen thousand six hundred and twenty three pounds of hemp. Caleb Worley the same for twelve thousand one hundred and twenty three pounds of hemp. Ordered that Bradle Hamilton, a bastard child of Mary Hamilton, be bound by the church wardens of Botetourt Parish accdg. to law. Ord. that the court be adjd. till tomorrow morning, eight o'clock. The minutes of these proceedings were signed by John Bowyer At a court contd. & held for the County of Botetourt the 10th of May, 1775. Present. John Bowyer, William Fleming, Geo. Skillern, Benjamin Estill, Wm. McClenachan & Adam Smyth, Gent. Justices. Ord. that Thomas Kirk serve his Master, Thomas McClure, eleven months after the expiration of the term of his conviction to reimburse him his expences in retucking him and bringing him to his said Master when run away and for the time he was absent. On the petition of Patrick Lockhart leave is granted him to keep an ordinary at his house in the Town of Fincastle, he having entd. into bond with David May, his security, and conditioned as the law directs. On the motion of Samuel Wallace, it is ordered that Audley Pain, John Logan, John Maxwell and James Gilmore or any three of them being first sworn do view the road from James Buchannan's store to the North River at Paxton's Ford and the way proposed by Saml. Wallace to the same place, as also any other way that may be proposed and report the conveniences & inconveniences, if any them, to the next court. On the motion of Laird May, ordered that William Fleming, John Neelly and William Graham being sworn do view the road by said Laird May's, and also the way which he proposes to turn the same and make report to the court. Upon the complaint of William Hope against William Anderson, his Master, the parties heard & it appeared to the court that the indenture by which the said William Hope was bound to serve were made by his father to Israel Christian and his heirs until he arrives at the age of twenty one years, but that he were nine last (word missing) complaint dismissed. Ordered that John Bowman take the list of tithables on the south side of Roanoake, also William Madison and Philip Love from Mason's Creek on the south sido of Roanoake to Fincastle line and down Catawba to James McAfee's, also William McClenachan's between (missing word or words) and Moses Creek, the main road to the court house, and the road to Craig's Creek Gap and on Catawba to McAfee's, also William Fleming and Andrew Woods between the court house road and Roanoake as far up as Mason's Creek, and from the court house to Robert Caldwell's at Craig's Creek Gap and down the mountain to the mouth of said creek, down James River to Anderson's lower ferry, up tho mountain to the Bedford line, and along the same to Roanoake, and up the same to Mason's Creek, also Adam Smith on Craig's Creek, John Creek Potts Creek and Sinking Creek and their waters to Fincastle line, also James Henderson on the Linkhole lands Sund Creek Indian Creek Woy Creek Hunds Creek and their branches, and from the mouth of Muddy Creek to the mouth of Greenbrier River on both sides of said river, and Andrew Donnelly from the mouth of Muddy Creek up Greenbrier on the north side through to Spars Ford, and from thence on both sides of said river to the Augusta line including Howard's Creek and Anthony Creek, also Richard May from the mouth of Craig's Creek up James River and the Cow Pasture to the County line, and up Dunlap's Creek to the Sweet Springs, Benjamin Estill and George Skillern from James River from mountain to mountain to Buffaloe Creek, also James Trimble and Wm. McKee from Buffaloe Creek from mountain to mountain to the Augusta line. James Gilmore is apptd. Surveyor of the Road from Buffaloe Creek to his own house in the room of James Simpson. William Lawrence is apptd. Constable in the room of Uriah Humhpries, also Arthur McClure in the room of William Lapsley, who is dischd. from that office. On the petition of Joseph Huton leave is granted him to keep an ordinary at Anderson's ferry on James in this County, he having entd. into bond with John Maxwell, his security, and conditioned as the law directs. Ord. that James Montgomery (Richpatch) be summoned to shew cause at next court why his children should not be bound out accdg. to law, he not maintaining & educating them in a Christianlike manner. Ord. that John Neelly and Robert Burdwell be fined for their contempt in not appearing as two of the Grand (missing word), having been sworn yesterday when the Grand Jury were presented from delivering their presentment thirty shillings each. Ord. that the ct. be adjd. to court in course.
