Present. John Bowyer, William Fleming, Andrew Woods and John Bowman, Gent. Justices. Hugh McNeell is apptd. a Constable in the room of Cornelius Riddick, who is dischd. from that office. Edward Marshall, servant to Samuel Linsay, Junr., with the assent of the court, agrees to serve his said Master six months after the expiration of the term of his present indenture. The Grand Jury that was summoned by the Sheriff appeared in the court and were sworn, towit: Win. McElhinney, George Dougherty, Samuel McNubb, David Smith, Michael Kirkman, John White, Mathew Ralston, James Cartmill, Andrew Armstrong, William Bilbro, Samuel Lindsay, John Looney, Wm. McClelon, Thomas Pruett, Malcom Allen and George McAfee. Joseph Kyle is apptd. Surveyor of the Road from Hall's Run, Baltart's Spring, in the room of Thomas McFarran, who is dischd. from that office. George Adams is apptd. guardian to William and Andrew Miller, orphans of David Miller, and he having entered into bond in the sum of five hundred pounds with William Preston, his security for securing the said orphans' estate and to endemnifying the court. Ord. that Laird Robinson, John Robinson and Samuel Robinson do lay off and alott to Hannah Bryd late widow of Laird Miller, decd., her dower in two tracts of land of the said decd. estate lying on the North Fork of Roan Oak and make report of the same to the court. Ord. that Joseph Long, Samuel Laurence and James Hall do value the improvements made on two hundred and ten acres of land on Buffalo Creek belonging to Moses Trimble and report the same to court. The Grand Jury returned into court and presented the following persons, towit: William Napier for harbouring and detaining William Farster's servant. The same for detaining other men's servants. We also present James Morrow for retailing liquors and keeping (word missing) and bad orders in his house. Also Augustine Brumley for keeping and cohabiting with his housekeeper unlawfully. Also John Brumley for the same. The Grand Jury also presented Miles Cunningham for keeping and cohabiting with his housekeeper unlawfully. Also Nathaniel Evans for the same. Also John Dazner and John Quillin for a breach of the Lord's day and for profane swearing. Ord. that process issue against the several persons this day presented by the Grand Jury, returnable here at the next court. Ord. that the court be adjd. till tomorrow morning, six o'clock. The minutes of these proceedings were signed by John Bowyer At a court continued & held for Botetourt County the 11th of May, 1774. Present. John Bowyer, James Trimble, William Fleming and John Bowman, Gent. Justices. James McNeell is apptd. a Constable in the room of James Alexander, who is dischd. from that office. On the petition of George Poague leave is granted him to keep an ordinary at his house in this County for the term of twelve months from the time he having entered into bond with Samuel Givens, his security. Ord. that George Wall be summoned to appear at the next court to show cause why his children should not be bound out by the church warders of Botetourt Parish according to law. On the motion of William Gillispie, sundry witnesses being sworn and examined, it was proved to the court that the conviction bill of Bill Jane Monk, his servant woman, was lost and that she had four years to serve from the 19th day of March last, and it is ord. that the same be recd, and that a certificate be granted to the sd. William Gillispie. Dougherty, George Dougherty and John Larkin, who retd. a verdt. in favor of the plff., awarding him one penny damages & costs. Judgt. accdgly. John Sproul Plff. ) agst. ) In Case William Mann Deft. ) This day came the parties by their attornies and thereupon came also a jury, towit: Jacob Cleek, Amos Potts, Joseph Looney, Robert Robinson, Joseph Bailey, John McRoberts, John Bozwell, Robert Ewing, Robert Barnes, Isaac Richeson, and James McClure, who redtd. a verdt. awarding plff. damages of eight pounds, besides his costs. Judgt. accdgly. James Templeton Plff. ) agst. ) In Case Samuel Moore & wife Defts. ) This day came the parties &c. & also a jury, towit: Abraham Chrisman, John Neelly, Samuel Blair, William Dougherty, Thomas Buford, David Herbert, Thomas McClure, Thomas Harrison, James Buford, Josiah Bullock, John Larkin and Alexander Hanley, who retd. verdt. that the defts. are guilty of speaking the alleged slanderous and defamatory words & assess plff.'s damages to two pounds, one shilling and one penny, besides his costs. Judgt. accdgly. William Paxton's ear mark, towit: a crop and slit in the right ear, and a slit in the left car, and is ord. to be recd., as also his brand, towit: WP. Patrick Coults Plff. ) agst. ) In Case James Laurence Deft. ) This day came the parties &c. & also a jury, towit: Amos Potts, William Bilbrow, John McRoberts, John Boywell, John Robinson, Robert Robinson, Jacob Cleek, William McMurray, James Walker, James McClure, Joseph Looney and Thomas Arnett, who retd. a verdt. awarding damages to plff. of six pounds, twelve (word missing) and four pence, besides his costs. One of the jurors was withdrawn and the suit was continued. Judgt. accdgly., for nine pounds, with int. thereon from the first day of February, 1773 till paid and his costs. Hairston in the room of James Buford and John Drake, who retd. a verdt. awarding damages to plff. for fifty six pounds, one shilling, besides costs. Judgt. accdgly. John Bowman is apptd. to take a list of tithables from John Howard's a direct line to James McAfee's on Catawbow and up the said Creek to the County line including Little River settlement. Philip Love from John Howard's to James McAfee's on Catawba and down a direct line to James River from mountain to mountain. Andrew Woods on Craig's Creek, John Creek and Sinking Creek and Rich Creek and the waters thereof. James Trimble in the forks of James River on the cast side of the main road that leads from John Paxton's Ford to Crow's Ferry on James River. William McKee on the northwest side of said road from John Paxton's Ford to Crow's Ferry up the North Mountain to the mouth of Craig's Creek. John Robinson from Newland's on Greenbrier to the mouth of Spring Lick Creek including the waters thereof. George Skillern on the Big Levels on Greenbrier Sinking Creek and Muddy Creek, Anthony's Creek and Howard's Creek and the waters thereof. Benjamin Estill on the Linkhold lands on Greenbrier Sand Creek, Indian Creek, Woy Creek, Hund Creek and their branches; also from the mouth of Muddy Creek to the mouth of Greenbrier to New River to the mouth of Indian Creek and their waters. Benjamin Hawkins from the mouth of Craig's Creek up James River, Dunlop's Creek, Jackson's River, Cow Pasture, and the waters thereof to the County line. Ord. that the court be adjd. till tomorrow morning, six o'clock. The minutes of these proceedings were signed by John Bowyer At a court continued &c held for Botetourt County the 12th of May, 1774. John Bowyer, Benjamin Hawkins, George Skilbren, Benjamin Estill, and Andrew Woods, Gentlemen Justices. Ordered that the church wardens bind out Joseph, Rachel and Mary Dunn, children of William Dunn according to law, it appearing to the court that they are likely to become chargeable to the Parish. William Mann Plff. ) agst. ) In Debt Andrew Donnely Deft. ) This day came the partios &c. & also a jury, towit: John Caffery, Samuel McRoberts, Wm. Webb, Levy Todd, Caleb Worley, Josiah Vandant, Robert Burdwell, Jacob Cleek, Wm. McMurry, James McCalister, Geo. Givens and John Henderson, who retd. a verdt. awarding damages of one hundred pounds to the plff. But the judgt. of the court is that the same shall be dischd. by payment of fifty pounds, with int. thereon from the second of February, 1773 till the time of payment and the costs to be pd. by the deft. On the petition of sundry inhabitants of the South Fork of Roan Oake leave is given them to open a road from the Muir Road and Robert Elliott is appointed overseer thereof, and the tithables on the fork arc to keep the same in repair according to law. On the potition of the inhabitants of the South Fork of Roan Oake they are exempt from working on the Direct Air Road. Sundry witnesses are sworn & examined, and the inhabitants of the North Fork heard therein mentioned, and it is ordered that John Brown and Philip Love appoint the tithables on the Direct Air Road. Mann, John Cuffery, Caleb Willey, Michael Tumey, Wm. Laurence, Isaiah Vansant, William Walker and Samuel Hairston. The plff. not being present, he was non-suited. Judgt. that plff. pay deft.'s costs.
