Present. John Bowyer, Benjamin Hawkins, Geo. Skillern and Andrew Woods, Gent. Justices. William Herbison, Sinking Creek, is od. levy free on account of his age & infirmity. Ord, that Geo. Hewett and Elizabeth Ramen serve Joseph Walker, their Master, accdg. to law to reimburse him six pounds, five shillings expended in getting them when run away eighteen months and three quarters. Ord. that Thomas Wheeler serve Math. Elder, his Master, accdg. to law to reimburse him three pounds, fifteen shillings expd. in getting him when run away fourteen months and three quarters. Ord. that Richard Coleman serve Thomas Barger, his Master, accdg. to law to reimburse him eight pounds expd. in getting him when run away two years and three months and one half. Ord. that Charles and Anne Stewart serve Geo. Hutcheson accdg. to law to reimburse him twelve pounds five shillings expd. in getting them when run away. Ord. that Lamm servo Robert Clark, his Master, two years to reimburse him seven pounds, eleven shillings and three pence expended in getting him when run away, and for six weeks up of time not paid. Ord. that the church wardens of Botetourt Parish bind out Alexander Boyd to Andrew Boyd accodg. to law. A valuation and improvement of two hundred and ten acres of land belonging to Moses Trimble and returned to court and to be recd. (James Trimble to pay). Ord. that Elizabeth Lewelling serve Patrick Lockhart, her Master, three years to reimburse him eleven pounds, ten shillings, and ten pence expended in getting her when run away and for twenty eight days up of time. John Poter, Junr., is apptd. guardian to Robert Madden, he having entd. into bond with Wm. Rowland, his security and conditioned as the law directs for securing the said orphan's estate and for endemnifying the court. .James Snodgrass is apptd. guardian to Joseph Tradden, he having entd. into bond with Wm. Snodgrass, his security, and conditioned as the law directs. A Commission of the Peace and Dedimus directed to Andw. Lewis, John Bowyer, John Maxwell, James Trimble, David Robinson, Wm. Fleming, Geo. Skillern, Benjamin Estill, Philip Love, Andrew Woods, John Bowman, Wm. McKee, Saml. Lewis, Richard May, Wm. Madison, John Murray, Wm. McClenachan, James Henderson, Andrew Donnelly and Adam Smith was produced, and James Trimble having taken the usual oaths to his Majesty's Person and Government, repeated & subscribed the test, and took the oaths of a Justice of the Peace of the County Court in Chancery, and of a Justice of Oyer & Terminer, which were administered to him by George Skillern and Benjamin Estill, he then the said Trimble administered the same to Geo. Skillern and Benjamin Estill, John Murray, Wm. McClenachan, Andrew Donnelly & Adam Smyth, who took the same and subscribed the test. John Jones to serve Patrick Lockhart, his Master, four years and eleven months to reimburse nineteen pounds, eighteen shillings and nine pence expended in getting him when run away and for forty two days loss of time. Ord. that Patrick Lockhart, Thomas Bowyer and Samuel McRoberts do view the way from the court house on the Mill Creek and make report thereof to the next court. Ord. that this court bo adjd. till tomorrow morning, six o'clock. The minutes of these proceedings were signed by James Trimble At a court continued and held for Botetourt County the 10th day of August, 1774. Present. James Trimble, George Skillern, Benjamin Estill & Wm. McClanachan, Gent. Justices. John Maxwell, the Sheriff, protested against the sufficiency of Botetourt County prison. Ord. that Dennis Lyon and Daniel Blair be confined to the stocks for ten minutes for the insolence and contempt offered in the presence of the court. Ord. that James Anderson enter into bond with security to the church wardens of Botetourt Parish to endemnify the said Parish for the maintenance of Anne Brooks, a bastard child of Anne Brooks, a servant of John Maxwell, and he is admitted to the goal until he comply with this order. And it is further ordered that the church wardens bind out the said Anne acedg. to law. Simion Alderson is apptd. a Constable about the Town of Fincastle. Ordered that the Gentlemen named in the Commission of the Peace for this County who have not already qualified be summoned to the next court to give the reasons why they have not. This court doth recommend John Maxwell, James Trimble and Geo. Skillern to his Excellency the Governor as fit persons, either of them to execute the office of Sheriff for this County. Ordered that suit be commenced in the Court of Hustings in Williamsburg against Mr. Edward Johnstin upon his bond to this Court of this County immediately, and that the Clerk to transmit to Mr. John Tazwell the keeping instructions for commencing the said suit. Ord. that the Shieriff employ a person to repair the stocks and that he bring in his account therefor at the levying of the levy, and then Mr. Thomas Bowyer admit the same, who is authorized to order a new pair if he think it necessary, and that the Sheriff do also get the prison well repaired by the directions of Mr. Thomas Bowyer. Moses Allen is apptd. a Constable on James River in the room of John Watkins, who is dischd. from that office. Ord. that William McClenachan take the list of tithables from the mouth of Craig's Creek up James River, Dunlop Creek, Jackson River, Cow Poaster River. Also Andrew. Donnelly from Marland's on Greenbrier to the mouth of Spring Lik Creek including the waters thereof. Ord. that the ct. be adjd. till court in course.
