Present: The Revd. Adam Smyth, John Armstrong, Thomas Rowland & Robert Poage, Gent. Justices. Geo. Rutledge, one of the Gentlemen named in the Commission of the Peace for this County, took the oath required by Act of Assembly. James Shirkey is apptd. Surveyor of the Road in the room of Joseph Prior, who is dischd. from that office. Ord. that the Sheriff summon a jury of twelve men to meet on the land of Valor Bell, whereon William Crawford proposes to build a grist mill, and report the damages which will accrue to the said Bell to the court. Ord. that Andrew Willson, Andrew Crawford, William Dethart, & Thomas Arnett do view the way proposed by William Crawford from his mill to James Willson's on Craig's Creek, & report the conveniences & inconveniences to the court. Ord. that Jonathan Taylor's ear mark be recorded, towit: a crop and two slits in each car. Ord. that Frederick Smith and Robt. King be apptd. Surveyors of the (word omitted) from the head of Catawba to the top of the mountain at Montgomery line in the room of Samuel Robinson. The order made at last court for tho church wardens to bind James Lundie, a bastard child of Mary Mannon, to Francis Smith, the same is set aside. Ord. that William Scott be apptd. Surveyor of the Road in the room of Uriah Humphries. Geo. Rutledge's, John Robinson's and David Robinson's tithables are exempted from working under the Surveyor of the South Fork Road, and it is ord. that they attend the Surveyor of the North Fork Road and Danls Den Road, and John Robinson is apptd. Surveyor of the Danls Den Road. John Reaburn is apptd. Constable in the room of William Neelly, who is dischd. from that office. Joseph Snodgrass, Junr., son of Joseph, is apptd. Surveyor of the Road from the first ford of Catawba to Mrs. Breckinridge's, and that Capt. Armstrong do appoint the tithables to work thereon. John Drake the same from the half way tree to the town in the room of Robert Caldwell, who is dischd. from that office. John Ross, Junr., is apptd. Surveyor of the Road from the half way tree to James Alderson's. Ord. that the ct. be adjd. till tomorrow morning, ten o'clock. Skillern, Gent. Justices. A licence is granted to Thomas Miller to keep an ordinary at his house in this County. Bond entd. into with James Cloyd, his security. Ord. that John Withers be Surveyor of the Road over Sinking Creek Mountain to John Webb's Mill, and the tithables from the head of Craig's Creek to Caldwell's mill to attend and work thereon when required. Ord. that Wilbo Hudson, a son of Elizabeth Hudson, a convict servant of Jos. Kyle's, be bound by the church wardens to the said Joseph Kyle accdg. to law. William Madison is apptd. to take the list of tithables in Capt. Barnett's, McClenahan's and Pauling's Companies of Militia, Robert Poague on the Little River & its waters, Geo. Rutledge in Capt. Robinson's & McMurtry's Companies, John Armstrong in his own and Capt. Henry Smith's Companies, the Revd. Adam Smyth in Capt. Lockhart's and James Wright's Companies, Thomas Rowland in his own and Capt. Dean's Companies, George Skillern in Givens' and James Smith's Companies, Benjamin Estill in Logan's and Hawley's, and that they are required to return such lists to the January Court next. Samuel Lawrence, Junr.'s ear mark admitted to record, to wit: crop in the right ear and a slit in the left. On the petition of Thomas McMackin leave is granted him to keep an ordinary at his house in the Town of Fincastle, he having entd. into bond with James Ledderdale, his security, accdg. to law. Thomas McMackin is appointed to provide flic wood for the use of the court and bring in his account at the laying the next County levy. Ord. that the ct. be adjd.
