Present: William Fleming, Wm. Madsion, Wm. McClenachan & James Barnett, Gent. Justices. A Commission of the Peace and Dedimus directed to William Fleming, George Skillern, Benjamin Estill, Andrew Woods, William Madison, Wm. McClenachan, Adam Smyth, Pat Lockhart, Thomas Lewis, Geo. Rutledge, Wm. Hamleton, Thomas Rowland, John Armstrong, Robert Poage, James Barnett, Saml. Eason & Josiah Martin, Gentlemen, were presented in court & read, whereupon Wm. Madison & Wm. McClenachan administered the oaths required by law to William Fleming, who administered the same to the said Wm. Madison, Wm. McClenachan, Adam Smyth, James Barnett and Samuel Eason. A report of a road was made and returned by Andrew Armstrong, Samuel Crawford and John Griffeth agreeable to an order of this court. Ord. that the same be established accdg. to the report, and that John Neelly, junr. be appointed Surveyor thereof from Thomas Barnes' to General Lewis's, and the tithables on each side of said road from mountain to mountain to attend and work thereon when required. Ord. that Andrew Armstrong, Samuel Crawford, Daniel McNeil and David May or any three of them being sworn do view the way proposed by Nathaniel Evans & others from Thomas Barnett's to John Love's on Roan Oak, and also the old road, and report the conveniences & inconveniences of the said proposed roads to the court. Ord. that the Commissioners of the Taxes for this County bind out Hannah and Jane, mulatto bastard children of Margaret Campbell, accdg. to law to William Madison. Ord. that the sd. Commissioners bind out Charles, a mulatto base born child of Mary Ryon, to Wm. McClenachan accdg. to law. William Neelly is apptd. Surveyor of the Road on Roan Oak in the room of Wm. Simpson, who is dischd. from that office. George Robinson is apptd. Constable in the room of Wm. McNeelly, who is dischd. from that office. Moses Dunlop, James Willson and Henry Waterson are apptd. Constables on the South and North Forks of Roan Oak. Ord. that the ct. he adjd. till tomorrow morning, six o'clock. The mins. of these procdgs. were signed by Wm. Madison At a court contd. & held for Botetourt County the 12th day of February, 1779. Present: Wm. Madison, Adam Smyth, James Barnett & Samuel Eason, Gen. Justices. George Skillern, Thomas Rowland & John Armstrong, the Gentlemen named in the Commission of the Peace for this County, took the oath reqd. by law. Ord. that a road be established from Capt. Christian's mill to the first ford on Catawba on the land of Benjamin Hawkins' agreeable to a report. John Peck is apptd. Surveyor thereof, who with the tithables to be nominated by Adam Smyth to open and keep the same in repair as the law directs. John Jemison is apptd. Surveyor of the Road in the room of James McAfee, who is dischd. from that office. Ord. that Wm. Cross' ear mark be admitted to record, to-wit: a swallow fork in each car. Ord. that the trustees apptd. to let the building of a prison in this County be authorised to inform the undertakers that unless they proceed within ten days after being served with a copy of this order to compleat the said buildings, they the said trustees or either of them direct the State's Attorney for the County to commence suit against them for failing to comply with their article. Ordered that Colo. Skillern take the deposition of John Todd, Junr., relative to an article of agreement entered into between the trustees for letting the building of a prison in this County and Jasper Robinet & Thomas McClure, the undertakers thereof. Ord. that the ct. be adjd. till court in course.
