Present: James Barnett, Jno. Armstrong, Wm. Madison, & Adam Smyth, Gent. Justices. Robert Poage and Josiah Martin, two of the Gentlemen named in the Commission for this County, took the oath required by law. John Haynes' ear mark admitted to record, towit: an half crop off the left car. Thomas Ferguson is apptd. Constable in the room of John Harrison and Surveyor of the Road from the Long Lick to the Bedford line, and the usual tithables to attend him when required to work thereon. Geo. Hutcheson and Caudley Maxwell took the oaths of Deputy Sheriffs for this County under Andrew Woods, Sheriff. Rowland Madison and Michael Bowyer took the oaths required by law to practice as attornies in this court. Henry Watterson and Samuel Willson are apptd. Surveyors of the Road from Brown's on the North Fork to Peter Rieff's, & that the tithables from William Robinson's to Isaac Taylor's including those on Bratcher's Creek, the Don Inglishes Creek do attend them and work thereon, and also that the tithables from the head of the North Fork to George Rutledge's do attend and assist in opening the same road. This court doth allow Mary O'harrell, wife of John O'harrell, a soldier in the Continental Army, thirty pounds for the support of herself & two small children. Ord. that the Commissioners for this County bind an orphan Samuel a child of Wm. Kerr to James McCown accdg. to law. Moses Allen is apptd. Surveyor of the Road in the room of Thomas Read, who is dischd. from that office. Ord. that a road be established from Wm. Crawford's mill to John Tillery's on Craig's Creek, and John Ritchey is apptd. Surveyor thereof, and the petitioners for the same to attend and open and keep the same in repair as the law directs. Ord. that the ct. be adjd. till tomorrow morning, six o'clock. The mins of these procdgs. were signed by George Killern At a court contd. & held for Botetourt County the 12th of March, 1779. Present: Wm. Madison, Adam Smyth, Jas. Barnett, Thos. Rowland & Robt. Poague, Gent. Justices. Patrick Lockhart took the oath of a Justice of the Peace of the County Court in Chancery and of Oyer and Terminer in this County. This court doth allow Thomas Madison one hundred pounds as State's Attorney for this County for the current year. John Tatham Plff. ) agst. ) In Trespass Joseph & David Anderson ) This day came the parties &c & also a jury, towit: John Yancy, James Moss, William Miller, Wm. Ross, Jesse Clark. John Potts, James Hutcheson, Wm. Mills, Adam Peck, Isaiah Vansandt, John Intsminger and Edmund Sturns, who retd. verdt. assessing damages in favor of the plff. to sixty pounds. Wherefore upon the prayer of the deft, by his attorney a new trial is granted on his paying the costs of this day. John Hungate is apptd. Constable in the bounds of Capt. Rentfroe's Company of Militia. Also Joseph Willis is apptd. Constable in the bounds of Capt. Willson's Company. James Roberts the same in the Town of Fincastle.
