Present: Adam Smyth, Pat Lockhart, John Armstrong & James Barnett, Gent. Justices. For reasons appearing to the court it is ordered that the fine laid on Wm. Crawford last court for not appearing as a witness on behalf of the Commonwealth against Geo. Patterson be set aside, he paying costs to the Clerk. This court doth authorize John Logan to draw on the Treasures for forty one pounds for the maintenance of an infant child of Edward Pearie, who is a soldier in the Continental Army, that he apply eleven pounds thereof towards satisfying Wm. Dempsey for his trouble & expences in taking care of the sd. infant heretofore, and that the remainder be laid out in necessaries for its future support. On the petition of Uriah Humphries leave is granted him to keep an ordinary at his house in this County, he having entd. into bond in the sum of fifty pounds accdg. to law with Joseph Pryor his security. William Caldwell is set levy free on acct. of his age and other infirmities. The order made to bind Samuel Kerr, infant orphan of Wm. Kerr, decd, to James McCown, is set aside. James McCown and Robert McAfee are apptd. by the court guardians to Samuel Kerr, decd., who with Archibald Woods, their security, entered into bond in five hundred pounds accdg. to law. Ord. that James Cloyd, Joseph Richardson and Henry Pauling, having been first sworn, do view and report to the court the nighest & best way from the fork of the road at John Howard's field to Hugh Mills'. Benjamin Allen is apptd. Surveyor of the Road from John Stewart's to John Howard's in the room of David May, who is discharged from that office, and also Henry Pauling from Mr. Howard's to the Bedford line. Ord. that the ct. be adjd. till tomorrow morning, six o'clock. The mins. of these procdgs. were signed by Adam Smyth At a court continued and hold for Botetourt County the 11th day of June, 1779. Present: The Revd. Adam Smyth, Pat Lockhart, John Armstrong & James Barnett, Gent. Justices. David Mitchell Plff. ) agst. ) John Ross Deft. ) This day came the parties by their attornies &c. & also a jury, towit: Robert Harris, James Norvil, Wm. Thompson, Jas. Cloyd, Wm. Miller, Samuel Baldwin, Jesse Clark, John Looney, John Davies, Samuel Kinnerly, Andw. Moore and Hugh Neelly, who retd. a verdt. in favor of the defendant. Judgt. accdgly. & costs. Ord. that Mary Montgomery, wife of James Montgomery, be allowed for her present support and till the suit in chancery be determined in this court the sum of twenty shillings per day. Ord. that the court be adjd. till court in course.
