Present: William Fleming, Geo. Skillern, Adam Smyth (Ck), Wm. McClenachan and Samuel Eason, Gent. Justices. Ord. that Jasper Terry, William Terry and Leonard Huff, having been first sworn, do view the way from the Pine Spur to Majr. Inglishes and report the conveniences &c inconveniences to the court. On the motion of William Ward and for reasons appearing to the court, it is ordered that it be certified to the Register of the Land Office that the said William Ward served as a Sergeant in the year fifty six and fifty seven in Dickerson's Company of Rangers in the defence of the country, and that at the time that warrants were obtained for their services by the officers he was an inhabitant of South Carolina, and being informed of the matter could not make application at that time, and prays that he may at this time be granted a warrant for that purpose agreeable to an Act of Assembly in that case made and provided. Andrew Woods, Sheriff of this County, enters his protest against the sufficiency of the prison of this County. Ordered that the Sheriff take into his custody a Negro woman who says she belongs to John Hunley in Hanover County taken up by James McAfee as a runaway and that he immediately advertize her (word omitted) the Publick Gazette. Received of Mr. Edward Johnson by the hand of Colo. Fleming two hundred and fifty pounds, nine shillings and one penny half penny the principal and interest of his bond due to this County which is deposited in the hands of the Revd. Adam Smyth towards paying for the publick building of a prison for this County. Thomas Madison, Esqr., is recommended to this Excellency the Governor as a fit person to execute the office of Escheator for this County and the Clerk is ordered to certify it accordingly. Ord. that the ct. be adjd. till tomorrow morning, six o'clock. The mins. of these proedgs. are signed by William Fleming At a court continued tfc held for Botetourt County the 13th day of August, 1779. Present: George Skillern, Adam Smyth, Wm. McClenachan, Pat Lockhart & Samuel Eason, Gent. Justices. Ord. that Elizabeth Ralston be allowed the sum of twenty pounds for her present relief, whose husband is a soldier in the Continental Army. Ordered that it be certified that Wm. Yeully & Christian Yeully, who served as soldiers in Wm. Preston's Company of Rangers in the year 1759 are entitled to obtain a warrant for fifty acres of land each agreeable to an Act of Assembly. The Commonwealth against Jonathan Withers for dealing with a deserter, parties heard and it is ordered that the said Withers be fined in the sum of five pounds, discharged and set at liberty. Received the five pounds, David May. William Preston Plff. ) agst. ) In Case Michael Ohair Deft. ) This day came the parties &c. & also a jury, towit: Wm. McNeelly, Robert Caldwell, Wm. Frazier, Thos. Welsh, Uriah Humphries, Alexander Hunley, John Barnett, John Drake, Josiah Phipps, John Johnson, Wm. Kyle and Ebenezer Titus, who retd. a verdt. for the deft. And on the prayer of the plff. by his attorney a new trial is granted him on his paying the costs of this day. Ordered that the sum of twenty pounds be allowed to Mary Chapman, wife of Wm. Chapman, a soldier in the Continental Army, towards the support of herself and five small children. Ord. that a certificate to his Excellency the Governor that William Skillson is entitled to receive a warrant for a sergeant's quota of land, having acted as such in the year sixty in the Regular Additional Troops on the Cherokee Expedition commanded by Colo. Wm. Byrd. An indenture of sale from William Fleming, Adam Smyth, Patrick Lockhart and Samuel Eason, four of the Gentlemen named in the Commission of the Peace for the County of Botetourt to James Roberts, was proved by the oaths of Saml. McArnell, George Skillern and William McClenachan, witnesses hereto, & ord. to be recorded. The same to James Strain was proved by the same witnesses and ord. to be recd.
