Present: Patrick Lockhart, James Barnett, Thomas Rowland, and Robert Poage, Gent. Justices. Ord. that Rose Lynem, Susanna Lynem & Thomas Lynem be bound to John Withers accdg. to law. Ord. that Agness, a mulatto child of Peggy Lynem, be bound to James Curry accdg. to law. Ordered that the claim of James McNeell, a soldier in the year 1759, be certified in order to entitle him to a bounty of fifty acres of land accdg. to law, which certificate was delivered to Jas. McNeell. Ord. that the ct. be adjd. till tomorrow morning, six o'clock. The mins. of these procdgs. were signed by William McClenachan At a court contd. & held for Botetourt County the 10th of September, 1779. Present: William Fleming, William McClenachan, Patrick Lockhart, and James Barnett, Gent. Justices. Samuel Woods Plff ) agst. ) In Case William Campbell, Deft. ) This day came the parties &ec. &k also a jury, towit: Jas. Buford, James Roberts, Saml. McRoberts, Stephen May, Luke Pryor, James Cloyd, Wm. Galloway, Richard Helet, Hugh Crockett, William Walton, Andrew Henry and Thomas McFarran, who retd. verdt. awarding plff. damages of two hundred pounds. Judgt. accdgly. &c costs. Jesse Clark, a Deputy Sheriff under Andrew Woods, Sheriff of this County, took the oath accrdg. to law. Ord. that Mary McCormack, wife of Adam McCormack, who is a soldier in the Continental Army, be allowed the sum of thirty pounds for the support of herself and child. Ord. that William Walton and Wm. Neelly be added to the recommendation of the (word omitted) Peace for the County and that the Clerk certify accdgly. Ord. that the ct. be adjd. The mins. of these procdgs. were signed by William Fleming At a court held for Botetourt County the 26th day of September, 1779 for the examination of Joseph Bailey on suspicion of felony. Present: Wm. McClenachan, Pat Lockhart, Geo. Skillern and John Armstrong, Gentlemen. The prisoner being set at the bar and arraigned of feloniously stealing a gray mare the property of John Haynes and it being demanded of him whether he was guilty of the said felony, pleaded thereto not guilty, whereupon sundry witns. were sworn and examd. on behalf of the Commonwealth, and the prisoner heard in his defence. On consideration whereof the court are of opinion that he is guilty thereof and that he ought to be held for the same in the General Court. Therefore he is remanded to goal. Ord. that the ct. be adjd. This procdg. was signed by George Skillern At a court held the aforesaid 26th of September, 1779 for the examination of Elizabeth McCorkle on suspicion of felony. Present: the aforesaid Justices. The prisoner being set at the bar & arraigned of feloniously stealing from Joseph Bailey a percell of woolling yarn & a pair of wooll cards pleaded thereto not guilty. Whereupon sundry witnesses were sworn and examined and the prisoner heard in her defence. On consideration whereof the court are of opinion that she is guilty of stealing the yarn, and by consent of the prisoner and with the assent of the court it is ordered that the said Elizabeth McCorkle receive ten lashes on her bare back by the Sheriff well laid on. Ord. that the ct. be adjd. till court in course.
