Present: The Revd. Adam Smyth, Wm. Hamleton, George Rutledge, Josiah Martin & Samuel Eason, Gent. Justices. William Davidson, William Walton and William Ward, three of the Gentlemen named in the Commission of the Peace for this County took the oaths required by law. Ord. that Mary Rance, a servant maid of Geo. Rutledge, do serve her said Master five months over & above the expiration of the term of her present indenture to reimburse him twelve pounds for apprehending and trouble and loss of time when run away. Ord. that Zopher Carpenter's claim be certified who acted in Capt. Dickerson's Company of Rangers formerly for the defence of the Colony as a Drummer. Ordered thence be certified to the Register of the Land Office, that James Robinson, Senior, in Capt. Peter Hogg's Company of Rangers, in the year 1768, as a Sergeant in the defence and protection of the frontiers of this Colony. Ord. that the road leading from Peter Rieff's on the South Fork of Roanok to Brown's place on the North Fork be discontinued. John Allen is appointed a Constable in the room of Thomas Read, who is discontinued. Ord. that court be adjd. till seven o'clock this evening. The mins. of these procdgs. were signed by Wm. Madison At a court held by consent of the prisoner for the examn. of James Turman on suspicion of having passed sundry counterfeit sixty dollar bills of Continental currency of the emitting of September the 26th, 1778 knowing the same to be bad. Present: William Madison, George Rutledge, Josiah Martin, and Wm. Walton, Gentlemen. The prisoner being set the bar and arraigned of the felony aforesaid pleaded thereto not guilty. Whereupon the witness on behalf of the Commonwealth was sworn & examd. and the prisoner heard in his defonce. On consideration whereof the court are of opinion that he is not guilty thereof. Therefore he is dischd. and set at liberty. Ord. that the ct. be adjd. This prcdg. was signed by Wm. Madison At a court continued and held for the County aforesaid the 11th of November, 1779. Present: George Rutledge, Josiah Martin, Samuel Eason & Wm. Walton, Gent. Justices. Ord. that this ct. be adjd. till tomororw morning, seven o'clock. James Burnsides Plff. ) agst. ) In Trespass Stephen Cork Deft ) This day came the parties &c, &e also a jury, towit: Caleb Worley, Samuel Lawrence, James McAfee, James Turman, Philip Hammon, Malcom Hunter, Uriah Humphries, Wm. McMurray, Andrew Armstrong, Alexander McArnold, Josiah Phipps and Geo. Poage, who retd. verdt. awarding plff. damages of twenty five pounds. Judgt. accdgly. & costs. Luke Pryor is apptd. Surveyor of the Road in the room of Geo. Givens, who is dischd. from that office. Ord. that the Sheriff pay out of the County money in his hands to David May, Surveyor of the County, one hundred pounds in order to enable him to compleat and finish the dividing line between this and Rockbridge County, for which the said David May is to account when his claim for running the said line shall be adjusted. Ordered that the Reverend Adam Smyth, John Armstrong and William Ward, Gentlemen, do enquire into the state and condition of the mind of John Howard and report the same to this court agreeable to Act of Assembly. McRoberts, Pat McCorkle, Stephen Huff, Adam Peck, Robert Harvey, Allen Gulleford, Dawson Wade & Wm. Hutcheson, retd. verdt. awarding damages of one penny to plff. Judgt. accdgly. & costs. Benjamin Huff Plff. ) agst. ) In Case Josiah Willson Deft. ) This day came the parties &c. & also a jury, towit: James Dalzen, Hugh Brown, Adam Peck, Edmund Sturns, Jacob Carper, Robert Harvey, Wm. Mullin, Patrick McCorkle, Wm. Hutcheson, Samuel McRoberts, Josiah Phipps and Allen Gulliford, who retd. verdt. in favor of the deft., the plff. not making his appearance. Judgt. accdgly. and that deft, recover agst. piff. five shillings, besides his costs. Ord. that the ct. be adjd. till court in course.
