Present: the Revd. Adam Smyth, Andw. Woods, Wm. Hamilton, Martin McFarran & Wm. Davidson, Gent, justices. Ord. that this ct. be adjd. till four o'clock this evening. The mins. of these procdgs. were signed by Adam Smyth At a court contd. and held for Botetourt County the 14th day of September, 1780. Present: Pat Lockhart, Martin McFarran, James Barnett, Wm. Ward, Wm. Neelly & Josiah Martin, Gent. Justices. Thomas Madison came into court and resigned his commission as State's Attorney & Escheator for this county. Ord. that the ct. be adjd. till five o'clock this evening. This procdg. was signed by Pat Lockhart At a court contd. & held for Botetourt County the 14th day of September, 1780. Present: Geo. Skillern, Martin McFarran, James Barnett, Josiah Martin and George Rutledge, Gent. Justices. Ord. that the ct. be adjd. till tomorrow morning, eight o'clock. This prcdg. was signed by George Skillern At a court contd. A held for Botetourt County the 15th day of September, 1780. Present: Geo. Skillern, Wm. Hamilton, Geo. Rutledge, Andrew Woods, Josiah Martin and John Baller, Gent. Justices. On the petition of Robert Armstrong leave is granted him to keep an ordinary at his house in this County for the space of twelve months from (word omitted.) time, he having entered into bond with James Barnett, his security, in the sum of fifty pounds accdg. to law. Rates to be observed by the ordinary keepers in this County (towit): Dollars Rum per gallon 64 Do. per H pint. 14 Brandy per y2 pint 8 Sound cyder per quart 5 Diets per As 18 Lodging 3 Grain per gallon 8 Whiskey per gallon 36 Do. per pint 1.16 Ordered that Colo. Skillern apply to the Governor that he will remit the confinement of David Tate, a State prisoner in the geoul of this County by a verdict for two years so, for that ho the said Tate giving sufficient security to Colo. Skillern confine himself to his plantation and a bounds of five miles from the same during the term above mentioned and be of good behaviour &c. The Commonwealth against Thomas Welsh on suspicion of being a Torey a jury sworn to try him according to evidence (towit): Thomas Goodson, Thomas Goodson, Junr., Moses Mann, Jeremiah Carpenter, James Dalzel, Moses Dunlop, John McEllister, Edward McMullin, Richard Maize, David Reace, Wm. McClenachan and Jonathan Newman returned a verdict in these words: We the jury are of opinion that the said Thomas Welsh shall be fined fifty pounds and imprisoned one hour. Richard Manley on suspicion of his being an enemy to the United States of America a jury sworn to try him accdg. to evidence (towit): Thomas Goodson, Senr. and others the same jury as in the suit against Welsh, retd. verdict in these woods [sic]: We the jury do acquit Richard Manley of the charge. Whereupon the court are of opinion that he shall find two securities to be bound himself in the sum of two hundred and fifty pounds and his securities in the sum of one hundred and twenty five pounds each for his good behaviour for one year and a day from this date. Ord. that Benjamin Huff, Surveyor of the Rond from the Pine Spurr to the County line loading to Colo. Inglishes be discharged from that office and that James Cooper and William Terry be apptd, in his room. Ord. that this ct. be adjd. till tomorrow morning six o'clock. The mins. of these predgs. were signed by Geo. Skillern At a court contd. and held for Botetourt County the 18th day of September 1780. Present: Geo. Skillern, Saml. Eason, Josiah Martin, Martin McFarran, Pat Lockhart & Jas. Barnett, Gent. Justices. James Woods is apptd. Captain in the room of Wm. Robinson, who hath resigned his office, Henry Waterson Lieutenant and John Rutledge Ensign. Ord. that the ct. be adjd. till Monday next, ten o'clock. The mins. of these prcdgs. were signed by Geo. Skillern At a court contd. & held for the County of Botetourt the 18th of September 1780. Present: Geo. Skillern, Adam Smyth, Martin MoFarran and Patrick Lockhart, Gent. Justices. Whereas at a court held for this County last July twas ordered that Wm. Ward, Gentleman, should be recommended to the Governor to be commissioned Lieut. Colo. of said County, and as it appears that the appointment of Mr. Ward would give dissatisfaction and likely to impede the publick service, he not being entitled by security, ordered that application be made to his said Excellency to commission Wm. Robinson Ensign in the room of Wm. Ward, and that he will please to overlook the former order for the reasons above alledged should nothing in this be contrary to law. Ord. that the ct. be adjd. till court in course.
