Present: Pat Lockhart, Revd. Adam Smyth, Wm. Ward & William Neelley, Gent. Justices. John Craig, a Dep. Sheriff in this County, took the oath reqd. by law. A report of a road made & retd. by Moses Preston, Thos. Martin, John Caldwell and Thomas Akins from the mouth of John's Creek to the fork of survey, ordered that the road be established agreeable to sd. report, and that the tithables annexed to the said report do attend John Caldwell the Surveyor thereof who is open & keep the sd. road in repair as the law directs. Ord. that Wm. Kyle, Jos. Kyle and Wm. Ritchey, being first sworn, do view the way from Isaiah Vinsandt's mill to the ford of Catawba at James Rowland's and make report thereof to court. A licence is grtd. Pat Lockhart to keep an ordinary at his house in this Town, he having entd. into bond accdg. to law in the sum of five hundred pounds with Joseph Carrol, his security. Wm. McClenachan, Adam Smyth and Pat Lockhart are recommended to the Governor as fit persons, either of them, to act as Sheriff in this County for the ensuing year. Ord. that the ct. be adjd. The mins. of these prcdgs. were signed by Adam Smyth At a court held at Botetourt Courthouse the 17th day of Decr., 1781 for the examn. of Zachariah Thorp on suspicion of his feloniously coining & uttering dollars of base metal. Present: Revd. Adam Smyth, Pat Lockhart, Wm. Ward, Thomas Rowland & Martin McFarran, Gent. Justices. The prisoner being set at bar & arrgd. of the felony aforesaid pleaded thereto not guilty. Whereupon sundry witns. were sworn & examd. on behalf of the Commonwealth & the prisoner heard in his defence. Decision of the court that he is guilty & ought to be tried therefor in the General Court, & therefore remanded to goal. Joseph Sarler to be summoned as a witness to appear against the said Thorp at his trial in the General Court. Ord. that the ct. be adjd. This prcdg. was signed by Adam Smyth At a court held at Botetourt Courthouse the 31st day of December, 1781 for the examn. of Spencer Humphries on suspicion of his feloniously was concerned in making and uttering dollars of base metal. Present: Geo. Skiilern, Pat Lockhart, Thos. Rowland and Martin McFarran, Gentlemen. The prisoner being set at the bar (same as in next preceding case). On consideration whereof the court are divided in their judgment, & it is ordered that a summons issue against Hugh Kirkpatrick to appear at the next court to shew cause why he may not be fined for not attending this day as a witness on behalf of the Commonwealth. And it is further ordered that the High Sheriff be summoned to appear at the said next court to shew cause why the witness in behalf of the Commonwealth agst. the prisoner was not summoned to attend this court. Ord. that the ct. be adjd. till court in course.
