This Indenture made this 10th day of October in the Year of our Lord Christ One Thousand Seven Hundred and Ninety Seven Between John Wilson & Martha his wife of the County of Botetourt & State of Virginia of The one Part and Thomas Newell of said County and Joseph Stover of [ blank ] County & State aforesaid of the other part Witnesseth that the said John Wilson & Martha his wife for and in Consideration of the Sum of three Thousand Three Hundred Ninty four Dollars & thirty four cents to them in Hand paid by the sd Newell & Stover the receipt Whereof they do by these presents acknowledge hath Granted Bargained & Sold & by these presents doth Grant Bargain Sell Alien & Confirm unto the said Thomas Newell & Joseph Stover One Certain Tract or parcel of Land lying in the County of Botetourt on the Waters of James River on the main road Leading from Pattonsburg to Lexington Joining the lands of James Moor & Michael Ocheltree said tract contains (Including the surplus thereof by Survey Two Hundred Thirty Seven & one Half acres of Land and is Bounded as followeth to wit, Beginning at two poplars in the fork of a branch corner to the Land of James Moor on the east Side of the Great road near the same and runneth thence South Thirty one and one Quarter Degrees West two Hundred and five poles to a Black Oak and Three White Oaks added the Old Corner & thence to the Land of Michael Ocheltree thence with a Line of the same N61W187 poles crossing the great road at 14 poles the new road at 168 poles and a Branch at One Hundred and Seventy four poles to a black oak and Hickory (the Hickory is fell down) the old corner thence North Thirty one and a quarter Degrees East two Hundred and one poles to three chestnut oaks on a Ridge Corner to Thomas and James Moor & thence with Moors line South Sixty two degrees East one Hundred and Eighty Eight poles crossing a Branch and the Great road to the Beginning To Have and to Hold said tract of 237 1/2 acres of Land & premises together with the appurtenances thereunto belonging to the said Thomas Newell & Joseph Stover to the sole use and behoof of the said Newell and Stover their Heirs forever and the said John Wilson & Martha his wife for themselves their Heirs & the said tract of Land and premises together with its appurtenances unto the said Thomas Newell and Joseph Stover their Heirs or assigns from themselves and the claim or claims of all persons Whatsoever shall & Will forever Warrant & Defend by these presence in Testimony Whereof this John Wilson and Margaret his Wife hath hereunto set their Hands and Seals the Day and Year above written John Wilson (Seal) Martha Wilson (Seal) Memorandum Whereas the within John Wilson for a valuable consideration sold a Location of ninety seven acres made May the 16th 1794 adjoining the within mentioned tract of Land to the within Thomas Newell & Joseph Stover who has since by the Direction of said Wilson Included the same with the within tract in one survey the said John Wilson doth therefore Bind Himself his Heirs Executors admrs in the sum of Eight Hundred five Pounds Current Money of Virginia unto the said Newell and Stover their Heirs or assigns the payment of which well and truly to be made if the said Location of 97 acres should prove Deficient on in any respect Sealed with my seal and Signed this 10th day of Oct 1797 John Wilson (Seal) At October Botetourt Court 1797 This Indenture of Bargain and Sale together with a Memorandum thereon Endorsed was acknowledged in Court by John Wilson and Martha his wife She Having been first prively Examined as the Law directs and thereupon Ordered to be Recorded A Copy Teste H Barger CBC [Pattonsburg is now part of Buchanan, VA - RRWeber]
