Thomas Wilson's Will (Transcription) Whereas I have it in comtemplation to go to the Western Country and the uncertainty of my returning Imposes the duty on mw to Declare this to be my last will and Testament first it is my desire that all my Just Debts be paid and in order to effect that purpose I direct that my wife & my Son Matthew make sale of any part or all of my real or personal Estate as they may [think] The Interest of my Estate May require & I hereby Give them the same power to Sell make Titles to purchases that I myself now have With the Exception that it is my desire that all my children reserve an Equal part of my Estate after my Debts are paid and Whereas I leave full confidence in the Integrity and honesty of my said son Matthew & he being now under Lawfull age & unable to Execute a bond it is my desire that the Court will permit him to qualify as my Executor without such bond but after he arrives of Lawfull age & any of the Legatees should be dissatisfied with the administration of the said Estate they will be at Liberty to compell him to give such security as the Court may think reasonable I further direct that my children be Educated in the best manner tht my Estate may allow but one regard must always be had to the disch[arge] of my Debts Witness my hand and seal this 19th of April 1819 Thos Wilson (seal) Teste: Sol Simpson Samford Camper At Botetourt November Court 1826 This Instrument of writing purporting to be the last Will and Testament of Col. Headley", 1997 In the name of God, Amen. I Isabella G. Thompson of Botetourt County, Va. being a married woman and the wife of John Thompson but possessing a separate Estate which I wish to dispose of by will, and calling to mind the uncertainty of life, do make the following as my last Will & Testament hereby revoking all others. The Separate Estate owned by me consists wholly of land to wit 136 acres where I know live, being seven-fifteenths of a tract of land Containing 337 acres lately divided between George Alphin and myself which 7/15 of said land was - - - - - - my part by inheritance from my father Nathan Lackey and my brother James Lackey _and in kind by purchase from Joseph Steel Commifsioner of Rockbridge circuit Court to whom I am indebted $600 for the balance of purchase money. I also own 37 acres of land, part of a tract of 72 acres which is a portion of the 337 acres of land divided between George Alphin and myself which 37 acres of land was not included in the said division, but was bought at a sale made in 1873 as delinquent for the non payment of taxes in the name of Robert Henry Kayton by Charles Rigins, who assigned to me the benefit of his purchase and the same has been recently conveyed under an order of the County Court of Botetourt by B W Allen clerk of said Court to Lewis Linkenhoker and to be held as a trustee for my benefit and to be disposed of by me by will or to be sold or disposed of for my benefit should I desire in my lifetime. Should my Executor herein after named deem it proper or necefsary in order to pay my debts to sell this parcel of land (37 acres) or should he think it best to sell this land or to exchange it for other lands for the benefit of my Estate and of my three younger children herein after named. I hereby authorize my said Executor to sell or exchange the said lands, and to convey to the purchaser or to persons with whom the same may by exchange the said 37 acres of land. After the payment of all my just debts, I give and bequeath the whole of my -- separate Estate, including the land on which I live containing 136 acres, and the 37 acres of land above mentioned should the same not be sold or exchanged as aforesaid, to my three younger children Viz: Robert W. Thompson, Kate Z. Thompson, and Joseph B. Thompson to be equally divided between them when the youngest Joseph B. arrives at the age of 21 years and in the event that one of them should die before that period arrives, the survivor or survivors are to take the whole estate. I make this provision for my younger children because of their tender years and the helpless situation in which they will be left when I am -- by death, and out from any want of affection for my older children who are better able to take care of themselves. I have leased my farm & premises to my son Frank Thompson for five years, and it is my will that this lease be carried out according to the arrangement made between him and myself. At the termination of this lease my Executor will make such arrangements as he thinks best for the working of the farm and the maintenance of my said three younger children, my desire is that they live together and enjoy together the use and profit of the farm. I hereby appoint my friend Lewis Linkenhoker the Executor of this my last will and testament and also the guardian of my said younger children, hoping that he will accept these trusts and desiring that no security be required of him by the Court either as Executor or Guardian.
