Snyder of the County of Botetourt State of Virginia being of Sound Mind and in Good health do make this my Last and Only Will and testament as follows to wit, Sec 1st that my Executors hereinafter appointed to execute this my Will Will pay all the expenses of my burial and Doctors bills and will place tomb Stones (plaine but [Neat]) at the head and foot of my Grave and That of my wife and pay all of my lawfull indebtednefs according to Law. Sec. 2nd Having been Married twice and having five children Now Living by my first marriage, Viz Wm. H. Snyder Mrs Elizabrth Wallace Wife of Samuel Wallace decd Sophia Holmes Wife of Jos B. Holmes Saml S. Snyder and Chas A. Snyder I Give and bequeath to the said five children my brick house, frame Shop and the lot No 28½ in the town of Buchanan Va Situated and fronting on High Street 66 feet and 157 feet on Second Alley to a 8 foot Crofs alley — also, Lot No 116 in Said town on the Corner of Water Street and Beaford Street, said Lot fronts 80 feet on Water Street and 254 feet on Beaford, to the Corner of Ferry Street, and on the N.E. lines and with Lot 117, is 225 feet from Water Street, I also Give and bequeath to said children I also give the said five Children ten Shares of Stock in the Lvage [Sage?] & Hall Co. property in Buchanan Va The property bequeathed in this Sec. is not to be Sold at public Sale but may be Sold privately by my Executors, with the Consent of a majority of the five Children, herein named, first be Obtained, If not Sold privately within two years after my death Then to be Sold at public Sale with the approval of a Majority of the five children Named in this Sec and until Sold My Executors will rent the same pay all taxes and reasonable repairs and pay the Surplus to said five Children reserving two and one half per Cent Coms to the Executors, and when the property is all Sold and Settled up out of the total Sum I Give and bequeath to my Daughter Mrs. Elizabeth Wallace Widow of Samuel Wallace Decd the Sum of thirty five dollars this Sum and the Sum of Sixty five dollars advanced to her to pay a claim brought against the estate of her Decd husband, this Sum advanced to her and the bequest of Thirty five dollars make the sum equal to the Sum of One hundred dollars, I Give and hereby bequeath to My Daughter Mrs. Sophia Holmes wife of Jos B. Holmes, one hundred Dollars these two Sums Amounting to $135.00 are to be taken from the Grofs Sum before the distribution is made to the said five Children named in this 2nd Section of this my Will With the above [Supplimation] I Give and bequeath to the five Children remainder of the income of the property named in this Second Section after the Same is fully assertained, as follows to my Son Wm. H. Snyder One fifth; to my Daughter Mrs. Elizabeth Wallace one fifth to my Daughter Mrs. Sophia Holmes One fifth my Son Saml S. Snyder One fifth; to my Son Charles [C.?] Snyder One dollar, and the remainder of the One fifth to be paid Over to my Executor to be [Casaited] on his indebtednefs to me by his three notes One for $50 dated Dec 23d 1895 With 6 per C interest till paid One Other Note for $55.00 with int dated June 9th 1897. One Other Note for $110.00 with int dated July 5th 1897. and if his Share does Not Satisfy the three Notes and interest to my Executors will make two Statements of his Account and Mail One of the Statements to him at Powahatan C House Powhatan County Va and the Other Statement to Mannie [Nannie] T. Snyder at the Same Post Office. She being Indorser on Said three Notes and if they or either of them fail to Satisfy any balance that may [Set one] within a reasonable time my Executors Will bring Suit before a Magistrate at or in the vicinity of Powhatan C.H. and Obtain Judgment and have Such Judgement placed on the Lien [docket] by the Clerk of the County of Powhatan County Court Sec. 3d-- After [executing] the property bequeathed in Sec 2 The remainder I Give and bequeathed to my Children by My Second Marriage Viz, Millard Snyder, Morris C. Snyder, Everett A. Snyder, Ellie D. Snyder, and Mrs. Sue E. Booze. I Give and bequeath to the aforesaid [five] Children last Named all my Real and personal property [Money on hand, [Notes], bonds, and all Other evidences of debts due ["and" or "me"] after paying my burial expenses and all of his expenses Named in ["said" or "same"] I Give and bequeath to my five children by my Second Marriage, Viz; Millard Snyder, Everett A. Snyder, Morris E. Snyder, Ella D. Snyder and Mrs. Sue E. Booze, The Wife of Charles Booze -- [to] ["as" or "son"] Millard Lot No 15 in Nofs [or Rofs] Addition to Pattonsburg, ["Nun" or "Nine"]North Buchanan. To my Son Morris E. Snyder Lot 23 in Nofs [or Rofs] addition Lots No 3 & 4 I have divided into three Lots each of the two lots are 102 feet front on the Rockbridge road and 165 in depth the two make 264 feet which I have divided into three equal Lots of 88 feet on the front and number them Lot No 3, No 3½ and No 4 I Give and bequeath Lot No 3 to my Son Everett Snyder So No 3 ½ I Give and bequeath to my daughter Mifs Ellen D. Snyder. Lot 4 I give to My daughter Mrs. Sue E. Booze I also Give and bequeath to my son Everett A Snyder Mifs Ellen D. Snyder and My daughter Mrs Sue E. Booze My Purgatory Mountain tract Containing 156½ Acres, and When all is fully Settled Whatever is the remainder is to be divided Share and Share alike between the five Children Named in this Third Section of this my Will I appoint and Constitute My Son Millard Snyder and My Son Everett Snyder my Executors to execute this my will Without being required by Law to Give bond and Security I having full Confidence in both In testimony Whereof I have hereunto affixed my Signature and Seal this 22nd day of November 1897. Snyder decd, was this day Produced in Court by Millared Snyder & Everett Snyder, the Executors Named therein and there being no Witnefses thereto JS Garland & Turner McDowell [were and Sworn] and testified that they were acquainted with the handwriting of the Said H.C. Snyder decd and that the said instrument of writing and the signature thereto Subscribed are wholly in the handwriting of the Said H.C. Snyder, Whereupon the said instrument of writing is Ordered to be recorded as & for the true last will and testament of the said H.C. Snyder decd.
