David Clark's Will made 18 September 1865, proven 14 May 1866. (Transcription) I David Clark of the County of Botetourt and State of Virginia being sick in body but of sound mind and disposing memory for which I thank God and calling to mind the uncertainty of human life and being desirous to dispose of all such worldly estate as it has pleased God to bless me with I give and bequeath the same in manner following that is to say. 1st I give to the heirs of my son Isaac deceased one dollar. 2ndly I give to my daughter Sarah Ann T. Tolly one dollar. 3rdly I give to my daughter Rebecca Jane the wife of Joel Burger one dollar. 4th I give to my daughter Martha Phebe Clark one dollar. 5thly I give to my daughter Caroline Virginia five dollars. And in consideration of what I give my sons William M. Clark-- David C. Clark, & Martin V. Clark it is wish that they support the said Caroline Virginia as long as she remains single. 6thly after the payments of my debts and funeral expences I give to my Wife Synthia Clark all my real and personal estate for and during the term of her natural life and after her decease I give the same to my three sons William M. Clark, David C. Clark & Martin V. Clark executor of this my last Will and testament hereby revokeing all other or former Wills or testaments by me heretofore made. in Witness whereof I have hereunto set my hand and affixed my seal this 18th of Sept 1865 signed and sealed published and declared by David Clark as and for his last Will and Testament in the presence and hearing of us who at his request and in his presence have subscribed our names as witnesses. Flaherty In the County Court of Botetourt May 14th 1866 This last Will and Testament of David Clark decd. was produced in Court and proved according to law by the oaths of Allen Biggs & Thornton A. Flaherty two of the Witnesses thereto subscribed and the proper internal revenue stamp for probat having been affixed to the executors bond and cancelled the said Will is ordered to be recorded. And on the motion of William M. Clark the executor therein named who made such oath as the law requires and together with Thornton A. Flaherty & William L. Barger his securities entered into & acknowledged a bond properly stamp in the penalty of $600.00 conditioned as the law directs, Certificate is granted him for obtaining a probat of the said Will in due form.
