William Tolleyís Will, made 10 July 1873, proven 8 June 1874. Transcription. In the name of God Amen: I William Tolley of the County of Botetourt and State of Virginia, being infirm in body, but of sound mind and disposing memory do constitute and this my solemn last Will and testament in manner following to wit: 1st To my son Alexander Tolley. I give and bequeath all the land I purchased from Jacob Zell viz: Twenty Seven Acres more or less being the lot assigned to said Jacob Zell in the division of the lands of his father Jacob Zell, decíd and I also give and bequeath to my said son Alexander Tolley all the land I purchased from Wm. Zell viz: Sixty Six acres being the land assigned to said Wm. Zell in the division of his fatherís lands the same land being exclusive of the Bee Hill tract. I also give to my said son Alexander one half of the said Bee Hill tract being one half of thirty three acres. The content of said Bee Hill Tract being sixteen & one half acres to said son Alexander. 2nd To my son William A. Tolley. I give and bequeath all the portion of the land assigned to my wife Sarah as the widow of the said Jacob Zell decíd, which was Fifty one acres of which I purchased the interests of the said Jacob and ?William Zell, their interests being two thirds of said Fifty one acres exclusive of the Dower in the Bee Hill tract as to the interest in that portion of the Bee Hill tract assigned to my wife Sarah as widow of said Jacob Zell decíd. I wish it to be equally divided between my sons Alexander & William A. Tolley. 3rd Since I have given all my real estate to my sons Alexander and William A. it is my intention that they shall furnish a comfortable support to my afflicted daughter Sarah and in case my said daughter Sarah dies before me, then my said sons Alexander and William A. Tolley, stand relieved and hold all my bequests as mentioned in my above Will & Testament. In Witness whereof I have hereunto set my hand and seal this 10th day of July 1873. Wm.
