This Indenture made this 19th day of July 1791 BETWEEN John Abernathy Sr. and Lucy his wife of the County of Brunswick of the part and Charles Abernathy son of the said John Abernathy and Lucy his wife of the other part witness that we the said John Abernathy & Lucy his wife as well for the natural affection love and goodwill which we bear to our said son as also for and in consideration of the sum of fifty pounds . . . do give grant bargain sell infeoff and confirm unto our said son ninety-seven acres of land situate & lying in the county of Brunswick and to be bounded as followeth (to wit) BEGINNING on Sturgeon Creek where the said John Abernathys & James Field decd. lines goes to the said creek thence along the said line to David Tuckers line thence along the said Tuckers line to Nathaniel Kings line thence along the said Kings line as far as it shall be necessary going an equal distance down the said creek from the BEGINNING and the said Kings line for a line across from the said Kings line to the said creek to leave ninety-seven acres of land together adjoining the above line . . . signed by John Abernathy and Lucy Abernathy (by her mark) and witnessed by Wright Tucker, Gency Abernathy, Irene Vaughan, and Milly Davenport (by her mark). Brunswick County Court March 26th 1792. This Indenture of deed and gift was acknowledged by John Abernathy party thereto to be his act and deed and ordered to be recorded. Deed Book 15, page 208. This Indenture made this 25th of July 1791 BETWEEN William Cordle of the County of Brunswick of the one part and James Frame of the said county of the other part . . . for and in consideration of the sum of five shillings . . . hath granted bargained and sold aliened & confirmed unto the said James Frame . . . a certain tract or parcel of land whereon I now live lying and being in the County of Brunswick containing five hundred acres . . . and bounded by the lands of Burwell Stark Ismael Dunn Charles Cordle and William Stanback . . . upon trust nevertheless it is the true intent and meaning of these presence that the said William Cordle being justly indebted to John Drummond surviving partner of Allen Love & Co. in the just sum of one hundred and thirty- two pounds fifteen shillings . . . and being willing and desirous to secure the payment of the same at some future date hath by these presence made over conveyed unto the said James Frame the above mentioned land and trust for the purpose aforesaid if therefore the said William Cordle shall fail to pay or fail causing to be paid unto the said John Drummond . . . the aforementioned sum of one hundred and thirty-two pounds fifteen shillings . . . and costs of drawing and recording and tax on this Indenture on or before the first day of December 1792 then the said James Frame shall by these presence have full power and lawful authority on giving ten day publick notice to sell the said land at publick auction to the highest bidder and to pay unto the said John Drummond his debt and costs aforesaid . . . signed by Wm. THE COMMMONEWEALTH OF VIRGINIA to John Rogers Robert Mabry and Benjamin Blunt Jr. gentleman greetings whereas Samuel Frances and Sally his wife of the county of South Hampton by their certain Indenture of Bargain and Sale bearing date the 23rd day of August 1791 has sold unto Alexander Green of the county of Brunswick the fee simple estate of two hundred and forty-nine acres of land with the appertenances lying and being in the county of Brunswick whereas the said Sally Francis cannot conveniently travel to our court . . . to make acknowledgement of the said conveyance therefore we do give unto you or any two or more of you power to receive the acknowledgement which she the sd. Sally Francis shall be willing to make before you of the conveyance . . . and we do therefore command you that you personally go the sd. This commission protecting the acknowledgement and privy examination of Sally Frances to an Indenture of Bargain and Sale from Samuel Frances & Sally his wife to Alexander Green was returned and together with the certificate of the execution thereof is ordered to be recorded. KNOW all men by these presents that we John Stainback & John Abernathy of the county of Brunswick for and in consideration of the natural love and affection which we have and bear to Sarah Stanback wido of Frs. Stanback Littlebury Stainback Rebecca & Hardiway Stanback children of Frances Stainback decd. but more especially for and in consideration of the sum of five shillings . . . do for ourselves and our heirs executors and administrators remise release and forever quit claim unto the said Sarah Stainback Littlebury Rebecca & Hardiway Stanback of Brunswick County . . . all and all manner of right title interest claim & demand whatsoever which we now have or hereafter may have to certain tract or parcel of land lying and being in the county of Brunswick which said land was left by the last will and testament of the said Frances Stainback decd. to be sold and the money arising therefrom to be applied to the payment of his just debts containing by estimation three hundred and twenty- five acres . . . we have hereunto set our hands and affixed our seals this 26th day of March 1792 . . . signed by John Stainback and James Abernathy and witnessed by James Powell, Robert Wallace and Wm. Sims. Brunswick County Court March 26th 1792. This Indenture of release was acknowledged by James Abernathy and John Stainback parties thereto to be their act and deed and ordered to be recorded. KNOW all men by these presents that we Thomas Jones & Richard Clack are held and firmly bound unto Thomas Stith, Thomas Edmunds, Andrew Meade, John Haskins Christopher Haskins James Fletcher Benjamin Blick, James Harrison, Edward Buchett [Berchett], John Stith, Richard Fletcher, Edward Drongoole, Sack Pennington and Daniel Huff gentlemen justices of the said county of Brunswick in the full and just sum of one thousand pounds . . . to be paid unto the said justices . . . to which payment well and truly to be made we bind ourselves and each of us our and each of our heirs executors & administrators jointly and severally firmly by these presents sealed with our hands & dated this 26th day of March one thousand seven hundred and ninety-two. The condition of the above obligation is such that whereas the above bound Benjamin Jones gentl. is and stands appointed treasurer of the said county of Brunswick by virtue of which appointment he hath power to demand and received all such sum or sums of money or tobacco from time to time as shall or may be levied or otherwise become due and payable to the county aforesaid now if the said Thomas Jones . . . shall and do well and truly pay and properly apply all such sums of money or tobacco from time to time during his continuance in the said office as shall come to his hands or into the hands of any other person by his order the property of which said money or tobo. being in the county aforesaid after deducting five percent for his commissions for his trouble and expense in the execution of the office aforesaid then the above obligation to be void or else remain in full force power and virtue. This Indenture made this 25th day of October 1791 BETWEEN John Jones of the county of Brunswick of the one part and William Mason of Sussex county of the other part whereas the said John Jones with John Jones Jr. and Charles B. Jones by their five several Bonds or writtings bearing date with these presents stands justly bound and indebted to the said William Mason in the sum of twelve hundred and twenty-five pounds . . . to be paid & etc. as in the said Bonds is particularly set forth and the said John Jones being willing and desirous to secure the payment thereof by mortgaging a certain or parcel of land lately purchased by the said John Jones of the said William Mason . . . by these presents doth bargain & sell unto the said William Mason . . . all that certain tract or parcel situate lying and being on both sides Totaro Creek and on the North side of Merehin River containing by estimation one thousand and five acres . . . and is meant and intended to be all that entire tract of land & premises lately purchased by the said John Jones of the said William Mason & Mary his wife by deed (indented) bearing date with these presents and which said deed is intended to be duly recorded in the worshipful court of Brunswick County aforesaid . . . provided always in this Indenture is upon condition that if the said John Jones due and shall well and truly pay or cause to be paid unto the said William Mason . . . the several sums of money as they shall become due on the said several Bonds or writings obligatory that then this writing and everything therein contained shall cease determine & be utterly void and of non effect but if it shall so happen that the said John Jones . . . shall fail to make payment to the said William Mason . . . of the said several sums of money contained in the said several Bonds or writings obligatory as they shall severally herafter become due that then it shall be lawful to and for the said William Mason . . . to make sale of the said land & premises or so much thereof as from time to time shall become due to the said William Mason and it is further agreed by the parties that the said William Mason shall keep possession of the above mentioned or granted lands and premises until the whole debt interest and cost is fully satisfied contented and paid . . . signed by John Jones witnessed by Jas. This Indenture made this 6th day of May, 1785(?), between Thomas Butter of the County of Brunswick Gentl. of the first part, Daniel Fisher of the County of Greensville Attorney at Law of the second part and Theophilus Field the younger son & heir at law of Theophilus Field merchant late of the County of Prince George, decd. of the third part for as Richard Burch of the County of Brunswick was seized and possessed in fee simple of and in a certain or parcel of land on the North side of Waqua Creek containing by estimation three hundred & fifty acres more or less conveyed to him by Richard Burch, Senior, by deed acknowledged and recorded in the County of Brunswick and bearing date the 22nd day of September One Thousand Seven Hundred and Sixty the boundaries of which land reference to the said deed being had will fully appear and whereas the said Richard Burch the younger by his certain Indenture bearing date the 26th day of August in the 1769 for the consideration of One Hundred & Ten Pounds to him in hand paid by the said Fisher conveyed the said tract of land to him in fee simple which said Indenture was partly proved in Brunswick County by Samuel Craft & Charles Mason two of the witnesses thereto but before the same was fully proved and admited (sic) to record the above named Thomas Butler purchased the same land whereupon it was agreed by the said Fisher, Butler and Burch that the said Burch should make the said Butler a conveyance for the same he the said Fisher consenting to release his interest in the said land at any time thereafter to him the said Butler or any other person that he might sell to or that should claim under him in consequence of which agreement the said Burch by deed conveyed the said land with the appurtenances to him the said Thomas Butler as by the same the date the 27th day of March 1774 duly recorded in Brunswick Court will fully and at large appear and whereas the said Thomas Butler sold Theophilus Field, father of Theophilus Field party to the presents a part of the said tract of land for the consideration of Two Hundred & Thirty Eight Pounds which the said Butler actually received of him but never gave a conveyance for the lifetime of the said Theophilus now decd. by whose death intestate the equitable right in the same hath descended to Theophilus the son heir at law as aforesaid . . . that the said Fisher & Butler in consideration of the premises and in affirmance of the said Butler's contract with the said Theophilus, the father as aforesaid as also for and in consideration of the sum of five shillings . . . do grant bargain sell alien enfeoff release and confirm unto the said Theophilus Field party thereto two hundred thirty eight acres of land part of the said tract so purchased as aforesaid of the above mentioned Richard Burch and bounded as followeth (TO WIT) Beginning at Masons line near Waqua Creek at a Red Oak thence along his line to a Hickory thence along his line to a Red Oak near the Great Road thence up the said road to Waqua Creek near the Mill Dam to an oak thence down the said creek to Wilkinsons line to a Turkey Oake thence along the said line to Masons at the Red Oake aforesaid at the Beginning . . . This Indenture made the 24th day of April 1792 between Charles Edmunds of the County of Brunswick of the one part and Buckner Stith of the same County of the other part . . . for and in the consideration of the sum of five pounds . . . he the said Charles Edmunds hath bargained granted and sold & liened and confirmed unto the said Buckner Stith . . . two Negro men slaves named Tom and Binn . . . in trust nevertheless and it is the true intent of these presents that whereas the said Charles Edmunds being indebted unto Smith Hampton the just sum of seventy pounds . . . due on Bond and being willing and desirous to secure the said Smith Hampton in the payment thereof with interest from the 24th day of April 1793 . . . doth agree that it shall and may be lawful and he doth ____ give unto the said Buckner Stith power and authority immediately after the 24th day of April 1793 on giving ten days publik notice to sell to the highest bidder for ready money the slaves aforesaid and to apply the money arising from such sale to the payment of the above mentioned sum of seventy pounds with lawful interest from the 24th day of April 1793 . . . But if it shall so happen that the said Charles Edmunds shall on or before the expiration of the term aforesaid or at the day of sale pay unto the said Smith Hampton the said sum of seventy pounds with interests and costs aforesaid in full then this Indenture shall be null and void and of no effect as if the same had never been made . . .
