I Henry Clary of Brunswick County (__) being weak in body but of sound and perfect mind and memory (____) be to almighty god for the same do make and publish this as my last will and testament in manor and form following First I do request and direct my executors to sell all my property in Virginia so soon as it can in their judgment be sold with reasonable advantage except my Dear Wife may receive her belongings if she wish for herself and children. Second I request and direct my executors to pay all my debts which remain unpaid at my decease. Third I give and bequeath unto my beloved Wife Hephzebah E. Clary during her life one third part of all which remains after the payment of my debts; and if at her decease any part of her said third shall remain it shall be divided equally between the two children. Fourth I give and bequeath unto my beloved son Henry E. Clary all which he is entitled to receive from the Eldridge Estate which (____) have in my possession. Also one third part of the balance that remands after the payment of my debts. Fifth I give and bequeath unto my beloved Daughter Amelia Henrietta Clary one third part of all balance that remains after the payment of my Debts. Sixth I give and bequeath my gold watch to my son Henry E. Clary to be given unto his possession at the age of twenty one until which time my dear wife shall have the use of it if she shall wish. Seventh I give and bequeath unto my beloved daughter Amelia Henrietta Clary six of my large silver spoons with carved handles to be given unto her possession when she marries or becomes of age also my Gold ring. As I proceed to pay for Mr. (Hart/Hunt?) two hundred dollars towards building the meeting house and as I do not justly owe him more than one hundred dollars I request and direct my executors to pay the last mentioned one hundred dollars to Mr. (Hart/ Hunt/Hariet?) as to the subscription of his so should so direct Also as I subscribed to the building of this meeting house. I request and direct my executors to deminish the amount of the subscription for myself and family to one hundred Dollars I give and bequeath the last (___) second one hundred dollars to the Presbyterian Congregation in Brunswick to build the meeting house provided it is built in the conditions of the said subscription. As have subscribed under the signature of H.C. to the fund for the Theological Seminary and as I cannot at this time tell whether my family will (____) (____) (__) (__) (__) I request and direct my executors if the subscription is filled accordingly to the conditions of my offer to leave it to my beloved wife to decide whether it shall be paid or not provided that if she does not live to the time limited for filling the subscription What the majority of my Executors shall make the decision. I request and direct my Executors to place my son Henry under the care of such person or persons in Amherst (_) Conway in the State of Massachusetts as my wife shall choose. I enjoin the fulfillment of this direction that it may save my beloved wife against deal of unnecessary anxiety and care hereby appoint my wife Hephezebah E. Clary executrix and John Clary and (Galanion?) K. Eastman of Massachusetts and Richard W. Feild, Francis (B______) and John Eastman of Virginia a part or all of whom may serve if they please as Executors of this my last will and testament and hereby revoking all former wills by me made. I Benjamin Clary of the County of Brunswick and State of Virginia being weak of body but of disposing mind and memory do make and ordain this my last will and testament hereby disposing of those worldly goods it hath pleased the Almighty to bestow on me. 1st I give to my live daughters Lucy and Mourning Clary all my lands lying on the East side of the Spring Branch to them and their heirs forever. 2nd My will and desire is that all my crop of corn, wheat and meal remaining after my death be devided between my son John Clary and my two daughters Lucy and Mourning Clary according to the size of or number of their families. 3rd My will and desire is that my son John Clary ___the ground around my house for two or three years after my death. 4th I give to my son John Clary my black horse and my still and all the money that may be due me at my death to him and his Heirs forever. 5th I give to my grandson William Byrd the bed and the furniture belonging to it on which he generally sleeps and one horse to him and his heirs forever. 6th I give to my son Herod Clary all my lands lying in the West side of the spring branch to him and his heirs forever. 7th I give to my Grandson Joseph Clary the bed and furniture belonging to it on which I sleep to him and his heirs forever. 8th I give to my son John Clary one pair of last wheels to him an his heirs forever. 9th The Ballance of my Estate not heretofore dispossed of to be sold and equally divided among the children of my Daughter Susan Lynch after paying my just debts.
