BRUNSWICK COUNTY, VIRGINIA - WILL BOOK 18 JOHN CLARY, 1858 In the name of God I John Clary of Brunswick County, Virginia do make this my last will and testament as follows; I wish all my just debts paid and my real and personal estate disposed of as herein after named; I loan to my wife during her life one negro to be chosen by her and also leave in the hands of my executor hereinafter named, the sum of one thousand dollars the interest on which he is directed to pay to my wife during her natural life, and if the interest should be insufficient for her comfortable maintenance, I authorize my executor to expend such part of the principal as he may think necessary to secure that object. At the death of my wife, I direct that the salve loaned to her, together with the increase and such part of one thousand dollars as remains unexpended, shall be equally divided among my children. I give to my daughter, Chaney one bed and bed clothing the one she claims at present. I give to my wife one bed and bed clothing, to be chosen by her. I give to my son George one of my stills, the best one and the other one I give to my grandson Clanton Clary, son of Peter. I devise to my sons William and David jointly my mill and apprentices belonging thereto, together with as much land around the mill grise as may be necessary to the complete enjoyment and use of said mill property. I have marked off said land. It is my wish and quest that they shall continue the owners of said mill and keep the same in good repair out of the profits thereof. And if either one should become dissatisfied, and wish to sell his interest the other shall become the purchaser in preference to other persons at a fair price to be ascertained by impartial men chosen for the purpose. I also devise to my son William a parcel of land part of the mill tract on the Eastern side thereof and I give to my son David the other part of the said mill tract, on the Western side of the dividing line. I having __ the same, commencing on the Road leading from Wesley Chapel, thence along path leading to mill until it strikes road coming, coming by the mill, then across said road unto head unto head of bottom, then down bottom to mill pond. I devise to my son Thomas the tract of land on which he resides known as the Wray tract, containing 178 acres. I devise to my son Peter the tract of land called Reed's containing 15 acres more or less and fifty acres of the tract, I bought of Moore's Estate. I devise to my son George, the tract of land on which I reside containing 339 acres more or less together with my interest in David Reed's tract containing (blank) acres I also will that my sons, William, David, & George shall each pay to my son John the sum of one hundred dollars to compensate him for this portion of my land none of which have I given him. I wish the balance of my slaves perishable property money __ to be divided equally among my children as follows, To William, John, Thomas, David, George, Peter, Chaney, Jinsey, Sally and Lucy one tenth each in absolute property. I appoint my friend, John Weaver Executor of this my last will and testament, hereby revoking all others. Weaver & Edward Doomgoole witnesses thereto and ordered to be recorded and on the motion of John T. Weaver the executor therein named, who made oath thereto according to law, and together with James Ruffin Leward: e John J. Wesson his securities entered into a bond in the penalty of $20.00 conditioned as law directs which bond was acknowledged by the several obligors therein named and ordered to be seconded certificate is granted him for obtaining a probate of said will in due form.
