May 28th 1877. Wm. H. Garnett & Mary J., his wife Pltfs vs . . . . . . . . . . . . . . . . . On a Petition John R. Saunders and other mentioned Defts This cause having been in all respects regularly matured came on this day to be heard on the petition the report of Special Comm. Wm. M. Perkins, exhibits filed and Examination of witnesses, and was argued by counsel: On consideration whereof, the Court being satisfied that the Will of Elizabeth Phelps substantially subscribed in paper marked "Will" was duly admitted to record in the County Court of Buckingham County prior to 1869, and was in February of that year destroyed by fire and lost together with the record thereof doth adjudge, order and decree that said paper purporting to be a "Will" of Elizabeth Phelps together with a copy of this order be certified by the Clerk, to the Clerk of the County Court, in ordered that said paper marked "Wills" may be recorded and indexed by him in the book Kept in his office for the recordation of Wills. "Will" In the name of God Amen. I, Elizabeth Phelps being of sound and disposing mind and memory do make this my last Will and Testament. Item. I give and bequeath to Mary Jane Carter my whole estate real and personal. Given under my hand this ___ day of ___ 186__. (signed) Elizabeth Phelps Witness: Geo A. Bolton L.C.
