FIRST - That I will and bequeath unto John W. Merritt my bed and a full set of covering for the same, my gold watch, bureau and mirror (bought of Richardson) one half of a set of china, linen tablecloth, one set of plates, split bottom chairs, one white counterpane, one washstand, one red bowl and pitcher, one set of knives and forks, one white and red cow, one bay horse (Barney), one white sow and a tract of land containing twenty acres adjoining the lands of Robert Frazier, J. D. Lee and others the same being the interest of R. C. Lee exchanged as per contract dated June 18, 1884, and also twenty acres of land adjoining the above and being my own interest in James W. Lee's estate. SECOND - I will to Robert C. Lee the remaining half of the above mentioned china. THIRD - I will to Emma Austin Chermany(sp?) ten dollars or its equivalent in property at appraisement. FOURTH - The remainder of my personal property I direct to be sold and my debts paid and the residue to be equally divided between my brothers and sisters. Lee Division of Estate 16 November 1861 The undersigned Legatees and Heirs at law of the Estate of Wyatt A. Lee, deceased, and being of full age and being desirous to avoid the expense of administration of the Estate of said deceased (he having died without a will) and being desirous to have a distribution of the Estate of said decedent with as little cost as possible in order to effect that object, we hereby consent and agree with John D. Lee and James W. Lee whom we hereby appoint for us in all matters pertaining to the distribution of said Estate, shall proceed to act as the personal representatives of the said decedent without qualification according to law and without being required to give bond with security conditioned as the law directs for their faithful performance as such personal representative and that the said John D. Lee and James W. Lee are hereby authorized and empowered as such personal representative to choose three or more disinterested persons to appraise in current money the personal estate of said decedent and if practicable to divide such personal estate into as many lots as there are legatees or heirs at law of said decedent of which said lots each legatee shall be entitled to an equal distribution but if it should be impracticable to make such distribution in kind of the perishable part of said estate the said John D. Lee and James W. Lee or either of them in case of the death or inability of the other to act to make sale of such portion as cannot be so divided upon such terms as to them may seem most advantageous to the heirs at law of said decedent and upon the collection of the money for such sale and after paying all the proper expenses attending such sale and the collection of the money therefore shall divide the residue into as many equal parts as there are distributions and pay to each one his distributive share as in hereinbefore provided or if preferred they may assign over the bonds for the proceeds of such sale to each legatee taking the receipt of each one therefore who shall not thereafter hold the said John D. Lee and James W. Lee responsible for any loss that may be sustained in the collection of the debts so transferred but it shall be the duty of the said John D. Lee and James W. Lee to take all bonds which may be necessary in carrying out the provisions of this instrument with good security in order to secure themselves from all responsibilities. We do further authorize and empower the said John D. Lee and James W. Lee to choose for us three or more suitable and proper men wholly disinterested in the matter to allot and divide the lands of said decedent into as many lots as there are distributees, having a due regard to qualify and quantify and the interest of the said several distributees and if in order to enable them to do so they may deem it necessary to employ a competent surveyor to assist them in allotting the same and after such allotment the several distributees shall each ballot for their respective share as is herein provided for the distribution of the perishable part of said estate, and in like manner the said Commissoners or others appointed by the said John D. Lee and James W. Lee shall allot the slaves belonging to the Estate of said deceased into as many lots as there are distributees having a due regard to proper valuation and each distributee to draw his share as hereinbefore provided in the perishable part of said Estate and land in such manner as said Commissoner may direct, all the expenses attending such distribution as are herein provided for to be paid out of said estate together with any expenses attending the recording of the same and when said distribution shall have been made as is herein provided for the said parties bind themselves to enter into refunding bonds with good security conditioned as the law directs to the said John D. Lee and James H. Lee to have them harmless on account of their acts and doings in the premises herein provided for. Lee to John D. Lee August 1856 THIS DEED made the 5th day of August 1856 between Ann E. M. Lee of the first part and John D. Lee of the other part both of the County of Campbell and State of Virginia. Whereas Polly Lee, the grandmother of the said Ann E. M. Lee, did by her Last Will and Testament (which is of record in the Clerk's Office of the County Court of Bedford) devised to Amily Lee, who intermarried with Wyatt A. Lee, a certain tract of land with sundry negroes thereon mentioned thereon with their increase, to be held by her during her life, and then to be distributed according to the provision of said Will, amongst the said Amiley's children, or their lawful heirs; and WHEREAS also it was devised by said Will of the said Polly Lee, that a negro woman Liza therein mentioned, should be delivered to the said Ann E. M. Lee, when she arrived at the age of twenty one years or married. UPON THE CONDITION that if the said Ann departed this life without issue, that the negro Liza, should return to be also distributed as the other property mentioned in said Will is decided to be distributed; AND WHEREAS the said Ann E. M. Lee, has arrived at the age of twenty one years and the said negro woman Liza, and her child, Mary Jane, has been delivered over to her, in accordance with the provisions of the aforementioned Will; AND WHEREAS the said Ann E. M. Lee, expects shortly to be married, and being desirous to secure to herself and her children (should she have any) all the property to which she may be entitled under the Will aforesaid, together with the negro woman, Liza and her child, Mary Jane, and their future increase, if any, or if she should die without lawful issue, being desirous to secure said property to her surviving brothers and sisters, or their lawful descendants, to be distributed according to the provisions of the aforesaid Will. NOW THIS DEED WITNESSETH, that in consideration of the premises, as well as the sum of One Dollar to her paid, by the said John D. Lee, she the said Ann E. M. Lee, doth grant unto the said John D. Lee, and his heirs and assigns forever, all and every right, title, interest and claim in the real and personal estate bequeathed to her mother Amily, during her life, as well as the negro woman Liza and her child, Mary Jane, devised to her by the said Polly Lee, upon Trust. That the said John D. Lee, shall permit the said Ann E. M. Lee to retain possession of the said negroes Liza and her child Mary Jane and their future increase, if any, and take the profits thereof, for the comfort and support of herself and her children or of herself should she not have any children during her life and that the said John D. Lee shall also permit the said Ann E. M. Lee to receive hereafter when a distribution shall take place of the negroes and their property mentioned in the Will of the said Polly Lee, her proportion of such estate so bequeathed, and take the profits of the same for her comfort and support as aforesaid; but neither the negroes Liza and Mary Jane, nor the other property mentioned in the Will of said Polly Lee are to be in anywise subject to the debts or contract of any person whom the said Ann E. M. Lee may marry, or any other person whomsoever, but shall be held by the said John D. Lee, for the sole use, comfort, and support of the said Ann E. M. Lee, and her children should she have any, during her life and upon this further trust -- that if the said Ann E. M. Lee shall die without lawful issue, or if any husband the said Ann may have, may be disposed to sell or other clerky(sp) the estate so devised by the said Polly Lee, then it shall be the duty of the said John D. Lee, on his personal representation, or such other person as the Court may appoint, to take care of said property and so to provide that it may be secured and forthcoming at the death of the said Ann E . Lee, to be distributed according to the provisions of the Will of said Polly Lee, as aforesaid, and also to provide that the said Ann E. M. Lee and her assigns as aforesaid shall receive the profits and benefits arising therefrom subject to the control of said other person; whatsoever, except the said John D. Lee or his successor. Indenture Deed of Trust John Lee, Sr. to Arnold THIS INDENTURE made and entered into the 3rd day of September in the year of our Lord 1830, between John Lee, Sr. of the first part; Moses A. Arnold of the second part; and Wyatt A. Lee, William Lee, Moses A. Lee, Richard Lee, Ann E. Lee, Elizabeth N. Lee, Stephen Terry, Garnett Lee (brother of said John Lee, Sr.) creditors of said John Lee, Sr., of the third part; WHEREAS the said John Lee, Sr., is justly indebted to the before named persons in a large sum of money in manner following THAT IS TO SAY: To Wyatt A. Lee in the sum of $1000 To William Lee in the sum of $1000 To Moses A. Lee in the sum of $500 To Richard Lee in the sum of $50 To Ann D. Lee in the sum of $300 To Elizabeth N. Lee in the sum of $300 To Stephen Terry in two separate debts in suit in the Superior Court of Campbell County supposed to be in and about $500 - to the aforesaid Garnet Lee - to secure the payment of the aforesaid several debts; NOW IN CONSIDERATION of the premises and for the further consideration of One Dollar to the said John Lee, Sr., in hand, paid by the said Moses Arnold, at or before the ensealing and delivery of this Deed, the receipt whereof the said John Lee, Sr. doth hereby acknowledge, he the said John hath bargained and sold and by these presents doth hereby bargain and sell to the said Moses Arnold the following property, to wit: A negro man named Phil, another negro man Daniel, another named Dick; another named Neptune, also Jacob a boy, another boy named Charles, also Winston a child, also Austin a woman, Maria a woman, Nelly a girl, Linda a girl, Eliza a girl, Martha and infant, and Harriett a woman, also all the stock of every description on the farm of said John Lee, Sr., in the County of Campbell together with the plantation utensils of all kinds, household and kitchen furniture, beds, bedsteads and furniture, also the present growing crop of the said John Lee, Sr. together with the crop of wheat now ready for market - also the amount of a legacy coming to said John Lee, Sr., from the Last Will of Richard Lee, formerly of Bedford County, Virginia. TO HAVE AND TO HOLD: to the said Moses Arnold and his heirs forever: UPON TRUST NEVERTHELESS and to and for the following use and purpose and no other that is to say: To secure the payment of the before named debts as they are named in the order here set down to the respective creditors and it is hereby covenanted and agreed between all the aforesaid parties to this Deed that the said John Lee, Sr., shall remain in undisturbed possession of the said negroes and all the other property embraced in this Deed, (except the crops on hand) severed and to be severed till the expiration of twelve months from this date, and shall have the use of the land; and if the said debts be not paid or otherwise satisfied at or before the lapse of twelve months; that then the said Arnold shall proceed to sell, at such place as he may select (first giving four weeks public notice of such sale in some newspaper published in Lynchburg) the above named property or such part thereof as may be sufficient to produce the amount of debts herein provided for; which sale shall be either for cash or on such reasonable credit as said Arnold may consider after defraying all reasonable and normal expenses of carrying this Trust into effect, shall pay over to the persons hereinbefore named their respective debts - and the surplus if any shall pay to the said John Lee, Sr., or his personal representatives or his assigns. PROVIDED always and it is hereby understood and declared to be the true intent of this Deed, and the understanding of all the parties thereto that if the said John Lee, Sr. shall pay and satisfy the aforesaid debts in full at or before the expiration of twelve months from this date to be computed that this Deed to be void and no effect; otherwise to be in full force. McAlister, Justices of the Peace in the County aforesaid, in the State of Virginia do hereby certify that John Lee, Sr., and Moses Arnold parties to this Deed bearing date on the 3rd day of this present month (September) 1830, and hereto annexed personally appeared before us in our County aforesaid, and acknowledged the same to be their act and deed, and desirous to certify the said acknowledgement to the Clerk of the County Court of Campbell in order that the said may be recorded. Will of JOHN LEE 1 September 1818 In the name of God amen I John Lee of the County of Campbell and Parish of Russell being in a reasonable good state of health of body and mind but in the decline of life thanks be to Almighty God for his unspeakable gifts and calling to mind the uncertainty of this mortal life, doth make this my last Will and Testament in manner and form followeth: To wit: First and principally I recommend my soul unto the hands of Almighty God who gave it hoping to receive everlasting happiness through the merits of my beloved redeemer in the world and life to come and joyful resurrection with the just at the last day, my body I commit to my mother earth from whence it was taken, to be decently buried by my ancestors hereafter named and as touching such worldly estate as it has pleased Almighty God to bestow upon me, I give and dispose of as followeth: To wit: I desire that all my just and lawfull debts be paid off and discharged. ITEM first and foremost my desire is whereas I have endeavoured and taken the most care in keeping my accounts, that whereas if any of my sons, sons in law, daughters or, daughters in law had done any favour or favours for me, I say that I have made it a part of my study and principle to compensate, and to retaliate and make that person who did me the favour equal amends and to the favour, as favour, otherwise I gave them a credit in their accounts on my books of accounts for as much as in conscience could the favour or service they had done for me was worth and for this reason all the credits and debits stated on my books shall stand permanent for and against all or any of my sons, sons in law, or daughters, or daughters in law. WHEREIN it is written by my own handwriting and be it further observed that if either of them heretofore named or shall be hereafter named shall after my death, shall bring in ________ accounts and that they insist upon their having them allowed as credit or credits more than is stated on my books, I say if any or either of the legatees hereafter named should so claim and contend for and insist upon being allowed a credit for such claim, that I do by this my Last Will and Testament pronounce that he she they or either of them so contending and will not give up such claim forfeit's one half of the legacy allotted to them by the decedant, and that this is his will and I desire and further direct that if it so happen that such forfeiture be equally divided between the other legatees which does not contend, and I humbly hope and fully desire that there be no disputes, respecting what I have left behind by the helping of Almighty God what he has been pleased to bestow upon me his poor weak and unworthy servant. Legatees observing well and complying with what has been before stated, as I trust and hope they will. I now proceed to make out different legacies to the different legatees. ITEM I give to my son Burwell Lee the land and plantation whereon I now live lying and being in the County of Campbell and lying on the north side of Goose Creek and Staunton River it being part of the tract of land I purchased of Jacobs Early with the following exceptions to wit that part called Darby's field lying in the north side of Goose Creek at Darbys Ford and adjoining the lands of Jessee Leftwich and others, and one hundred and twenty eight acres taken off said tract for the Town of Leesville at the junction of Goose Creek and Staunton River which leave a balance of Two hundred and forty six acres. I also give my son Burwell Lee the tract of land I purchased of Robert Owen adjoining the land I now live on the above named lying on the east side of the same containing one hundred and thirty five and half acres and deeded to me by said Owen, also two negro men named Daniel and Garnett with other necessaries I have heretofore given towards housekeeping upon his complying with some other items hereafter named. ITEM I lend to my two sons to wit, Stephen Lee and Beverly Lee during their lives the following tracts of land; one in Bedford County deeded to me by Thomas Halley the land I bought of Thomas Smith and built a mill on it. Also one other tract of five hundred acres lying and adjoining on the south side of the above mentioned tract, and deeded to me by William Leftwich also one other tract containing one hundred and twenty six acres adjoining the same on the north of last tract above named and deeded to me by Lucy Pratt, also I lend to my son Beverly Lee and his wife during their lives, one negro man named Jack with some things necessary heretofore received for the purpose of housekeeping also I give to my son Stephen Lee one feather bed and furniture, also I remit to son Stephen Lee the debt he is owing me as stated on my books. My desire is and I direct it so to be, Stephen Lee and his brother Beverly in the mills be equals both in profits and loss during their life, and after their death, and the death of Rebecca Lee who is now the wife of Beverly Lee that the legacies herein mentioned and sent, to the two brothers. I say in consequence of Stephen Lee and Beverly Lee and Rebecca his wife, that after their deaths be equally divided between the heirs of Beverly Lee both male and female lawfully begotten. ITEM I give unto my daughter Patty Arnold and John Arnold her husband one negro woman named Mary and her increase which they have now in their possesion. Also I give them one negro man named Mat also one negro boy named Harrison, also other necessaries that they have heretofore had, necessary for housekeeping. I lend unto my son in law Alexander Lee and my daughter Sarah Guthrey Lee his wife, one negro woman named Abby now in their possesion with all her increase during their lives excepting one of the said Abby's children named Mary that I gave my consent that may sell and did sell to my daughter Polly Lee, also I lend to my son in law Alexander Lee and Sarah G Lee his wife during their lives one negro boy named Ben and one other negro boy named Nelson with other things necessary for housekeeping heretofore received and after their deaths, I desire that they the said slaves just mentioned with their increase, be equally divided between the lawfull being of the body of my said daughter Sarah G. Lee, I give it to them and their heirs forever. ITEM I give unto my son in law James Lancaster and to my daughter Elizabeth his wife one negro woman named Tamer and now in their possession, also some necessaries for housekeeping heretofore received also I give them one negro man named Aleck (my blacksmith) with all and every of their increase also my set of blacksmiths tools. ITEM I give unto my son in law Robert Clark and my daughter Susannah his wife, one negro woman named Milly now in their possession with other necessaries for housekeeping heretofore received, also I give them one negro boy named Will with and singular their increase. I give it to them and their heirs forever. ITEM I lend to my son in law Henry Crider and to my daughter Permelia his wife one negro woman Judy and one negro named Dick now in their possession with other necessaries for housekeeping heretofore received the above named slaves with all and every of their increase. I lend to the said Henry Crider and Permelia his wife during their lives and after their deaths, to be equally divided between the children the lawfull heirs of the body of my daughter Permelia Crider I give it to them and their heirs forever. ITEM I give to my daughter Mary Lee one negro girl named Molly and one negro boy named Andrew with all and every of their increase also one feather bed and furniture. I give the said slaves with their increase to my said daughter forever. ITEM I lend to my son in law David Holladay and to my daughter Ann his wife one negro girl named Charlotte now in their possession with other things necessary for housekeeping heretofore received. Also I lend to David Holladay and to my daughter Ann his wife one negro named Jacob the said negroes just named, I lend to them during their lives and after their deaths to be equally divided between the children of my daughter Ann Holladay lawfully begotten. I give to them that is to them and their heirs forever with all and every of their increase. ITEM I give to my son John Lee two tracts of lands in the Counties of Campbell and Bedford one tract containing one hundred and forty six acres granted to Henry Henrickson also one other tract containing two hundred acres granted to John Lee by patent bearing date the tenth day of April in the year seventeen hundred and ninety nine and of the Commonwealth the twenty third remembering that the two tracts above mentioned contain three hundred and forty six acres. Also, I give to my son John Lee one negro man named Jerry and one feather bed and furniture now in his possession. I give to him and his heirs forever. ITEM I give to my son Richard Henry Lee one negro man named Frank one good feather bed and furniture also five hundred pounds in cash I give to him and his heirs forever. ITEM I give to my daughter Matilda and to Drury Holland her husband one negro woman named China with her increase also one negro boy named Phil also one good featherbed and furniture the said bed she now has in her possession. I give the said slave with their increase to them and their heirs forever. ITEM I give to my daughter Aggy Lee one negro girl named Charity also one negro boy named Soloman and one good feather bed and furniture with all and every of their increase. I give it to her and her heirs forever. ITEM I lend to my daughter Sophia Lee during her life one negro girl named Gilly with her increase if any to wait on her and assist her in her domestic affairs during the life of her as need may require which her situation may often require, also I give to her one good featherbed and furniture bedstead and cord. Also, I direct that there be raised out of my estate twelve hundred dollars and that sum to be put upon legal interest per annum and the interest thereof be paid yearly to my daughter Sophia Lee during her life and after death the said negro girl Gilley with her increase if any and the said twelve hundred dollars above named be equally divided between all my children hereinbefore named my wish is that my executors hold the said twelve hundred dollars in their hands paying the interest thereof to my said daughter Sophia Lee yearly during her life. I further desire and direct in consequence of my giving to my son Burwell Lee, the negro man Daniel that he may be with his wife and children that my said son Burwell Lee pay four hundred dollars towards raising the twelve hundred dollars for my daughter Sophia. I also desire that the lots in the town of Leesville commencing at the mouth of Plumb Tree branch be sold and the money together with the moneys arising from the sales already made be equally divided amongst all my children hereinbefore mentioned the balance of my slaves not hereinbefore mentioned. I wish laid off in nine equal lots as near as can be drawn for by my daughters hereinbefore named or their legal representatiatives all I say excepting my daughter Sophia Lee she being otherwise provided for. I further desire that the tract of land I bought of John Overstreet and the tract I bought of Jacob Citty (the last mentioned tract deed to me by Henry Brown) both tracts lying and being in the County of Bedford be sold and the money arising trom the sale be equally divided between my five sons TO WIT, Burwell Lee, Stephen Lee, Beverly Lee, John Lee, Jr., and Richard Henry Lee. I further desire that all my stock of every denomination on the plantation whereon I now live and at the mill, with what grain may be in the mill and one patent cross cut saw at the mill, also all my household and furniture, the crop made on the plantation, all my plantation tools and utensils and all that belongs to my estate not otherwise disposed of, be sold and the money arising from the sale thereof, and all my outstanding debts either by bill bond or otherwise, and all of every denomination after being sold the whole amount of the sale be equally divided between all my children hereinbefore named excepting my daughter Sophia Lee which is otherwise provided for, in addition to what I have given to my son Burwell Lee, I give to him all the town of Leesville on the West side of the Third Broad Street leading from Goose Creek to him and his heirs forever, exception 2 acres of land adjoining the mill seat, I reserve for my estate and allotted for commons for the mill, and the two acres above named to extend from the center of the mill house a due North course, and lastly, I nominate and appoint my son, Burwell Lee and my son in law John Clark and my son in law James Lancaster and son in law John Arnold executors to this my last will and testament, revoking, and disannulling all other wills by me heretofore made, and declaring and appointing this my last Will and Testament.
