I, Thomas Scott of the County of Caroline and St. Margaret's Parish, being in good health and of perfect and sound mind and memory, and calling to mind the certainty of death, do make and ordain this my last Will and Testament in manner and form following: Item: I give to my son, Rice Scott, the tract of land whereon he now lives, lying in Prince Edward County, containing by estimation on thousand acres, to him and his heirs forever. Likewise six negro slaves, Viz; one man named Cupper, one yellow man named Glasgow, one woman named Dolly, one man named Dick, one boy named John, one boy named Sheppard, their future increase and all the stock and household goods that he has already received and hath now in possession, to him and his heirs or assigns forever. Item: I give to my son, John Scott, seventy pounds current money of Virginia, which is to pay the balance now due for the land whereon he now lives, lying in the county of Amherst, which money is to be raised out of my estate after my death and paid to my son, John Scott, his heirs or assigns, if I do not advance it for him before my death. Likewise six negro slaves as follows: one man named Admarel, one man named Harry, one woman named Moll, one woman named Black Lucy, one girl named Venus and one girl named Bet with all their future increase; likewise all the stock and household goods which he hath already received and now in his possession, to him or his heirs or assigns forever. It is my will and desire that unless my son John Scott, return to me before my death, or immediately after to my son William Scott, upon being informed of this clause of my will, a negro girl named Charlott, which girl I lent to my son John Scott, in the presence of John Wiley, unless the girl departs this life before me, then my son, William Scott, shall receive of my estate the seventy pounds, which is herein mentioned and bequeathed to my son, John Scott, to enable him to pay for his land. Likewise the two of the negroes which I have bequeathed to my son John Scott, which are as follows. Viz; one man named Harry and one woman named Moll with all their future increase. Moll shall go to my son William Scott, in lieu of the negro named Charlott now in the possession of my son, John Scott provided she is not returned according to this my last will and desire. Item: I give to my son Thomas Scott, six negro as herein mentioned, Viz; one named Caroline, one named Bristol, one woman named Patt, one boy named Harry, one woman named Jill and one girl named Nance and their future increase. Likewise six head of cattle and all of the household furniture he has received of me and now hath in his possession to him and his heirs forever. Item: I give to my son James Scott, the tract of land whereon he now lives, which I purchased of John Bagby, lying in Prince Edward County, containing by estimate four hundred acres, to him and his heirs or assigns forever. Likewise six negro slaves next hereafter mentioned, Viz; one boy named James, one man named Daniel, one woman named Hannah, one woman named Daphney, one woman named Phillis,and one man named John and their future increase to him and his heirs or assigns forever. Item: I give to my son Samuel Scott, six negro slaves next hereafter mentioned, Viz; one negro boy named Hunter, one man named Len, one man called Black Glasgow, one boy named Dave, one girl named Jane and one woman named Tenor and their future increase to him and his heirs or assigns forever. Item: I give to my son William Scott, six negro slaves next hereafter mentioned, Viz; a negro boy named Lewis, one negro girl named Selah, one negro woman Sarah, one man named Martin, one negro woman named Jane and one negro girl named Charllot and their future increase to him and his heirs or assigns forever. Whereas last mentioned negro girl named Charllot is now in the possession of my son, John Scott, as before mentioned. If he refuse to give her up to me before my death, or after to my son, William Scott, on having notice of this my will, I then will and bequeath to my said son, William Scott, the seventy pounds which I have before desired to be raised out of my estate for my son, John Scott, an likewise two negro slaves which I have before given to my son, John Scott, Viz; one man named Harry, one woman named Moll and their future increase shall be to my son William Scott and his heirs or assigns forever. Item: I give to my son Robert Scott, six negro slaves next hereafter mentioned, Viz; one negro woman named Lucy, one negro boy man named Charles, one negro girl named Peg, one negro boy named Jeffery, one negro man named George and one negro woman named Old Peg and their future increase to him and his heirs or assigns forever. Item: I give to my daughter, Frances Gatewood, four negro slaves next hereafter mentioned, Viz; one negro woman named Lou, one negro woman named Jane, one negro woman named Chloe, one negro man named Robin and their increase now in possession of my daughter and likewise the future increase of these slaves to her during her natural life for her sole and separate use, and not to her husband, and after her death to the heirs of her body lawfully begotten and to them and their heirs or assigns forever. Likewise the stock and household goods which she hath already received from me and now hath in possession. Also six head of cattle to be delivered to her out of my stock after my decease. Item: I give to my granddaughter, Martha Gatewood, one negro woman named Sarah and her future increase to her and her heirs or assigns forever. Item: My will and desire is that the land whereon I now live and all the land I shall be possessed with at my death (except lands I have already given away in my last will) shall be sold and the money arising from the sale of my lands shall be equally divided between by three sons hereafter mentioned, Viz; Samuel Scott, William Scott and Robert Scott, to be by them or their guardians laid in purchasing other lands as they shall choose, for them, their heirs or assigns forever. It is my will that if either of my four sons hereafter mentioned, Viz; James Scott, Samuel Scott, William Scott and Robert Scott die without lawful issue of their body, that all the estate that I have herein given and bequeathed to them shall be equally divided between the survivors of them which shall be to them and their heirs or assigns forever. Item: I give to my four sons hereafter mentioned, Viz; James Scott, William Scott, Samuel Scott and Robert Scott (after my just debts being paid) all the residue of my estate be it of what nature and kind so ever to be equally divided among them or their heirs which shall be to them, their heirs or assigns forever. My will and desire is that if I should depart this life and there is a crop upon the land that the negros shall remain on the plantation until the first of the January following to finish the crop. Item: I give to my two sons, William Scott and Robert Scott three negros next following, Viz; one named Sirus, one named Samson and one named Venus, to them and their heirs or assigns forever. I have given these three negros to my sons William and Robert in consideration of by lending to my well beloved wife, Martha Scott, during her natural life, two negros, Viz; Lewis and Peg, which I have herein before willed to my two sons William Scott and Robert Scott. Item: I lend to my well beloved wife, Martha Scott, during her natural life, two negro slaves, Viz; Lewis and Peg, likewise my riding chaise and double harness and my two horses or mares, which are in common drove in my chaise at the time of my death, which I desire she may peaceably and quietly possess and enjoy during her natura life. It is likewise my will and desire that my well beloved wife, Martha Scott, shall have the liberty to live where I now live with whichever of my sons as live at my place till she thinks proper to move to (till they sell my land to some other party) without being molested or forced to move. Item: I last constitute and appoint Capt. Hawes, John B. Roy, George Yates, and my sons Rice and James Scott, executors of this my last will and testament. John Wiley Jennie Russel William Davey Codicil: To this my last will, as James Gatewood has brought suit against me since I had this will written, it is my desire if he should recover more than herein bequeathed to my daughter, Frances, which he married, that all I have herein given to her and likewise what I have herein given to my granddaughter Martha Gatewood and my account of sundry articles delivered to my daughter Francis and her husband James Gatewood, shall be recovered out of the sum he receives by lawsuit, if it amounts to more than I have given him.
