Will of Elias Stilwell, 1844 - Carroll Co. VA Will book 1 page 35 5 March 1844 In the name of God amen, this the fifth day of March in the year of our Lord One Thousand Eight Hundred and Forty four I, Elais Stilwell, of the county of Carroll. Gentlemen, being throug the blessings of God in a sound state of mind and memory. But calling to mind the final tenure of life of this life and that is appropriated to all must once die, do make and ordain this my last will and testament, that is to say, I give, bequeath and dispose of it in the manner and proportions here folowing: First, I give to my son, Evan Stilwell, one sorrel mare, one cow and calf, one bed and bedding, and six head of hogs. Second, I make my son, Amos Stilwell, my executor, to take care of myself and my wife during our natural lives, I do give my son, Amos Stilwell, the tract of land that I now living on with all its appertainings, one horse, bridle, and saddle, one feather bed and furniture, one cow and calf, six head of hogs, and he, the said Amos Stilwell, is to make no charge against the estate for settling the estate as executioner. Third, I give to my daughter, Polly Stilwell, one horse, one cow and calf, one feather bed and furniture, and six head of hogs. Fourthly, I leave to my son, William Stilwell, fifty acres of land, the where he has permanently lived, being passed my tract of land that I now live on till priced to him at twenty dollars and laid off to him. Fifthly, I give to my son, Vincent Stilwell, the piece of land that he is now living on, it being a part of my old survey until laid off for him, and bounded as followeth, beginning on the east side of the ridge road, and on the south side of the land that I am now living on, the same price to him at twenty dollars, and supposed to be fifty acres. Sixthly, I give to my wife, Susannah Stilwell, all of my household and kitchen furniture of all descriptions, all beds and beddings that is left after the above distributions is made to dispose of as she pleases during her life, and after her death to be sold and equally divided between the legalies. Seventh, I wish all the remaining of my personal estate to be sold and twenty dollars to be paid to my son, Lewis Stilwell, twenty dollars to my son, Evan Stilwell, and twenty dollars to my daughter, Polly Stilwell, to put them on an equality with my sons William and Vincent that I have given the twenty dollars worth of land to. And after that paying of my first debts the remaining of my estate to be equally divided between all of my children and I hereby utterly diallow, revoke, and disannul all and every other former testament, wills, legalies, and bequeaths and executors by me in any way before named, willed and bequeathed, ratifying and confirming this and no other to be my last will and testament.
