SOME WILSON DEEDS AND INDENTURES IN CHARLOTTE COUNTY Transcribed by Willanna Griffin, March 2002 Note: Nathaniel Wilson (1784-1860) of Charlotte County was my third great-grandfather. Several familiar names from the early 1800s in Charlotte County can be found here, including Armistead, Bolling, Gaines, Harris, Harvey, Pugh, White, Watkins, and others. Nathaniel Wilson was the son of Joseph Wilson (1758--abt 1815) and Elizabeth Hudson (1758-1830) of Amelia and Prince Edward counties. He is believed to have married (1) Mary McR. Moseley about 1806 (unproven) and (2) Elizabeth Hamlett, daughter of James Hamlett and Sarah Elizabeth Pamplin (m. 1829, Campbell County). 3 August 1814 Deed of Trust Between Edmund Bolling and Nathaniel Wilson (Charlotte County Deed Book 13, 111) Synopsis: Edmund Bolling owed John White 85+ pounds. He is apparently selling his slave James to Nathaniel Wilson for re-sale at Rough Creek Church, who will then pay Bolling's debt from the proceeds. Know all men by these presents that I Edmund Bolling of the County of Charlotte being desirous of Securing the Sum of eighty five pounds seven shillings and 4 c which sum I justly owe to John White of said County, and in consideration of the further sum of five shillings to me in hand paid by Nathaniel Wilson the receipt whereof I do hereby acknowledge both bargained sold and delivered. and by these presents do bargain sell and deliver unto the said Nathaniel Wilson, his heirs and assigns forever, one negroe man by the name of James to have and to hold the said negro man to him the said Nathaniel Wilson, his assigns to forever, upon trust nevertheless that the said Nathaniel Wilson shall and he is hereby authorised empowered and directed after the first day of October next after giving ten days previous public notice by advertisements proceed to sell the aforesaid negro man James at Ruff Creek Church for ready money to the highest bidder, and out of the money arising from such sale after defraying the ___? of the same, him the said Nathaniel Wilson shall pay the aforesaid John White the above sum of eighty five pounds seven shillings and 4c as specified above, and the balance if any to be paid to said Edmund Bolling or order(?). In Witness whereof him the said Edmund Bolling has fixed his hand and seal this third day of August 1814. Signed Sealed and delivered Edm. Bolling SS in presence of John Armstead, William White, Hill McCraw At a Court held for Charlotte County the 5th day of September 1814 This deed of Trust was proved in Court by the oath of John Armstead and Hill McCraw, two of the subscribing witnesses to be the act and deed of the said Edmunds Bolling and ordered to be Certifyed-- At another Court held for the said County the 3rd day of May 1815 the same was acknowledged in Court by the said Edmund Bolling to be his act and deed and ordered to be Recorded. Teste Thomas Read Truly Recorded Thomas Read 20 February 1818 Deed of Trust between Isham Harvey, Nathaniel Wilson, and John Fariss (Charlotte County Deed Book 14, 191) Synopsis: This deed was difficult to read in places. It appears that John Fariss owed Richard Gaines $1,834, so his land was to be sold to Nathaniel Wilson, who would then re-sell it and the proceeds used to settle the debt. This Indenture made and entered this 20th day of February in the year of our Lord one Thousand eight hundred and eighteen between John Fariss of the County of Charlotte of the first part and Nathl. Wilson, ____ of the second part, and Isham Harvie & Co. of the same county of the third part, witnesseth that wheras the said John Fariss is justly indebted to Richard M. Gaines in the sum Eighteen hundred and thirty four dollars sixty two 1/2 cents and said Isham Harvie security for said sum of money and being anxious of securing the said Harvie & Co. the said Fariss hath agreed to convey the property herinafter mentioned to said Harvie for the purposes aforesaid, viz., one certain Tract of land lying and being in the County of Charlotte containing 282-1/4 acres, bounded by the land of Capt. Thomas, Capt. Watkins, Capt. Gaines, John M. Pugh, and Isham Harvey to have and to hold the aforesaid Tract or parcel of land and premises with its appurtenances unto the said Nathaniel Wilson his heir and assigns forever to the only purpose and use and behoof of him the said Nathl. Wilson his heirs and assigns forever and upon this special trust and confidence and to said for the use, intent and purpose whatsoever that is to say the said Nathl. Wilson or his heirs is hereby empowered and required to sell the certain Tract or parcel of land aforesaid to the highest bidder for ready money whenever he shall be thereto required by the said Isham Harvie giving ten days previous notice by advertising the time and place of such sale at Charlotte Courthouse and other publick places in the County and out of the proceeds of such sale first pay and satisfy the said sum of money that said Harvie has paid to said Gaines as security for said Fariss together with legal expenses attending the Execution of this Trust and the balance if any shall pay and deliver over to the said John Fariss --- ----? and it is hereby understood and agreed of all the parties to this deed that no such sale shall take place until the 10th day of March 1819 and the said Nathaniel Wilson and Isham Harvie do hereby command? and agree with the said John Fariss that if the debt hereby intended to be secured shall be paid and satisfied so that a sale within the true intent and meaning of this deed and do not necessary that there and in that case they the said Nathl. Wilson and Isham Harvie will execute? all such deeds of ----? or other conveyances so as to vest the fee simple title in the above mentioned land with its appurtenances in the said John Fariss he now holds it as the said John Fariss or his counsel may advise and the said Nathl. Wilson doth further covenant and agree and with the said John Fariss that he the said Nathl. Wilson will at any time execute good and sufficient acquitances to the said John Fariss for all such sums of money as may be paid by him the said John Fariss Towards a discharge of this trust and he the said Nathl. Wilson doth covenant and agree to ----? with the said John Fariss and Isham Harvey that he the said Nathl. Wilson for the ----? upon the trust in this deed mentioned shall --- ----? sufficient title to the land aforesaid & free from the ---? hindrance or molestation of all persons --- ---? and that the said Nathl. Wilson is the cost (cash?)and charges ---? the said John Fariss execute all such further deeds and assurance of title to the land aforesaid as the said John Fariss or his counsel shall advise in determining? whereof the parties of this deed have ----- at their homes and office (official?)...line illegible. (illegible) Hamlett (his mark) Cuthbert Williamson At a court held for Charlotte County September 7, 1818, this deed of trust was proved by the oath of John Harvie, Ralph Jackson, and Cuthbert Williamson and ---? Recorded. Teste William L. Martin (could be Marston? Marton?) 4 March 1820 Purchase of Land by Nathaniel Wilson from his brother, Joseph Wilson and wife Dorothy C. Wilson (Charlotte County Deed Book 15, 243) Synopsis: Joseph Wilson and his wife Dorothy Chamberlain Wilson of Prince Edward County sold 250 acres of land on Ward's Fork in Charlotte County to Nathaniel Wilson. The land was bounded by that of John Daniel, Zedekiah Vaughn, and John Harvey (and on one side by Nathaniel himself, as his father Joseph Wilson had willed a single tract of land in 1808 to the brothers which was to be divided equally between them). The land was about eight miles north of the courthouse on Ward's Fork. This Indenture made the fourth day of March in the year of our Lord one thousand eight hundred and twenty between Joseph Wilson and Dorothy C. his wife of the county of Prince Edward of the one part and Nathaniel Wilson of the County of Charlotte of the other witnesseth that the said Joseph Wilson and Dorothy C. his wife hath for and in consideration of the sum of two thousand four hundred dollars to them in hand paid the receipt whereof they are hereby acknowledged by these presents granted bargained and sold unto the said Nathaniel Wilson one tract or parcel of land lying on the waters of Wards Fork in the County of Charlotte aforesaid and containing by estimation two hundred and fifty acres, be the same more or less, bounded as followeth ---? on the N by the said N. Wilson, on the E. by Zedekiah Vaughn, and others on the S. by John Daniel and on the W. by John Harvey. To have and to hold the aforesaid land and premises together with all and singular the rights, privileges and appurtenances thereunto belonging or in any wise appertaining unto the only proper use of him the said N. Wilson his heirs or assigns forever and moreover the said J. Wilson and Dorothy his wife doth for themselves and their heirs warrant and defend the rights and title to the aforesaid land and premises unto the said N. Wilson his heirs or assigns forever against the claims of all person or persons whatsoever. In witness whereof we have hereunto set our hands and seals this day and year above written. Wilson the wife of Joseph Wilson parties to a certain deed for the conveyance of real estate to Nathaniel Wilson Bearing date the fourth day of March Eighteen hundred and Twenty and hereto ---? persons appeared before us in our county aforesaid and being examined by us privately and apart from her husband and having the deed aforesaid fully explained to her she the said Dorothy C. Wilson acknowledged the same to be her act and ----? and declared that she had willingly signed sealed and delivered the same and that she wished not to retract it given under our hands and seals this 4th say of March 1820. We Robert Kelso and Rizon Porter Justices of the peace in the County aforesaid do hereby certify that Joseph Wilson and Dorothy C. his wife parties to the --- conveyance have only acknowledged the sums before us on the 4th day of March in the year of our Lord one thousand eight hundred and Twenty and ---? us to certify the said acknowledgement to the clerk of the county Court of Charlotte in order that the same may be recorded as witness our hands and seals. Robert Kelso Rizan Porter This Indenture with the certificates of the acknowledgement thereof was delivered in at the Clerk's office of the County Court of Charlotte the 1st day of June 1820 and admitted to Record. Teste Winslow Robinson Truly Recorded Winslow Robinson 2 April 1821 Sale of land owned by John Faris to settle debt, Nathaniel Wilson Trustee (Charlotte County Deed Book 16, 8) Synopsis: The 286 acres belonging to John Faris were sold by Nathaniel Wilson, acting as trustee by virtue of an agreement made in 1818, to settle Faris' debt to Richard Gaines. The purchasers were Isham Harvey and John Thomas, whose land adjoined that of Faris. This Indenture made and entered into the 2nd day of April 1821 between Nathaniel Wilson Trustee of Charlotte County of the one part and Isham Harvey of the same county that John Faris was justly indebted to Richard W. Gaines the sum of 1834 dollars and 62-1/2 cents and the said Isham Harvey became security for the same and John Faris being ancious to secure the said Harvey the said Fariss conveyed to Nathaniel Wilson in trust a certain tract of Land lying in the aforesaid county which land contained 282-1/4 acres the boundaries of which will fully appear Reference being had to the record of Charlotte where the Deed of trust was Lodged the date September 1818 now the said Nathaniel Wilson Trustee by virtue of the title vested in him and on the 24th February 1821 after given Seque? notice Proceed to sell the Land to the highest bidder or at least 91-1/4 acres of the same it being the balance which was unsold on that day and the part on which the said Faris Family resided and joining the lines of Isham Harvey, John Thomas, and Henry Watkins. Isham Harvey became the purchaser for 20 Shillings p ---? In consideration of the sum ninety one pounds paid by said Harvey, I Nathaniel Wilson Trustee convey to Isham Harvey and his heirs all the right and title vested in me as Trustee and the balance of the 282-1/4 acres which was sold by said Faris to said Harvey and John Thomas. I Nathaniel Wilson Trustee, relinquish to them all the title vested in me as Trustee. Witness my hand and seal as above written. Nathaniel Wilson This Indenture was acknowledged in the Clerks Office of the County Court of Charlotte the 2nd day of April 1821 by Nathaniel Wilson a party thereto and admitted to record. Examined Teste, Winslow Robinson Truly Recorded,Winslow Robinson 18 August 1823 Purchase of land from Thomas and Mary Tredway (Charlotte County Deed Book 17, 11) Synopsis: Nathaniel Wilson bought 323 acres of land from Thomas and Mary Tredway in 1823 for $3000. The land was located on the headwaters of Wards Fork and was bounded by neighbors John Moseley, Isham Harvey, an unknown Elliott, and Thomas Woods. This Indenture made and entered into this eighteenth day of August one thousand eight hundred and twenty three between Thomas Tredway and Mary Tredway, his wife, of Prince Edward County of the one part and Nathaniel Wilson of the county of Charlotte of the other part, witnesseth that the aforesaid Thomas & Mary Tredway for and in consideration of the sum of Three thousand dollars to them in hand paid by the aforesaid Nathl Wilson before the sealings? and ----? of these presents the receipt whereof is hereby acknowledged they the said Thos & Mary Tredway have granted bargained and sold and by these presents doth grant bargain and sell unto the said Nathl Wilson his heirs ---? forever a certain tract or parcel of land containing by recent survey Three hundred and twenty three acres to the same more or less lying and being in the County of Charlotte on the headwaters of Wards Fork and bounded as follows, to wit, Beginning near two Red oaks on John Mosleys line thence North 384/4 (?) poles on Isham Harvey's line to pointers ---? w 100 poles on Elliotts line to a white oak thence ---- poles to a black Jack thence ---- 8140 poles on Thomas Woods line thence Lg1/4 E256 poles to a hickory or white oak thence N 53 1/2 E 81 to the beginning on John Moseley's line with the revertion and revertions remainder and remainders unto Isues & profits? to the same belonging or in any wise appertaining relinquishing and conveying all right, title and claim in and to the said tract of land to have and to hold the above named land with all and every right thereunto appertaining to him the aforesaid Nat Wilson his heirs and assigns forever and the aforesaid Thomas and Mary Tredway doth covenant and agree to and with the said Nat Wilson and his heirs against themselves and their heirs and against the claims of all others whatsoever the title to the aforesaid land they will forever warrant and defend to the said Nat Wilson his heirs and assigns. In witness whereof the aforesaid parties have hereunto affixed their hands and seals this day and date first above written. Thomas Tredway Mary Tredway Prince Edward County Court, We Nathaniel Price & James D. Wood Justice of the peace in the County aforesaid in the state of Virginia do hereby certify that Thomas Tredway a party to a certain deed bearing date on the 18th day of August 1823 and hereto annexed? personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed and desire us to certify the said acknowledgement to the clerk of Charlotte in order that the said deed may be recorded given under our hands & seals this 19th day of August 1823. Nathaniel Price James D. Wood Prince Edward County Court, We Nathaniel Price & James D. Wood, Justices of the peace in the County aforesaid in the state of Virginia, do hereby certify that Mary Tredway the wife of Thomas Tredway parties to a certain deed bearing date on the 18th of August 1823 and hereto annexed? personally appeared before us in our County aforesaid and being examined by us privately and apart from her husband and having the deed aforesaid fully explained to her she the said Mary Tredway acknowledged the same to be her act and deed and declares that she had willingly signed sealred and delivered the same and that she wishes not to retract it. Given under our hands & seals this 198th day of August 1823. Nathaniel Price James D. Wood This Indenture with the certificates of acknowledgement annexed was delivered in at the clerks office of the County Court of Charlotte the 3rd day of November 1823 and admitted to record. Teste, Winslow Robinson 14 March 1826 Indenture between William B. Harris, Nathaniel Wilson (Trustee), Isham Harvey & Co. (Charlotte County Deed Book 14, 191) Synopsis: William B. Harris owed Isham Harvey & Co. $263 and change. A lien was placed on his land but he and his family were allowed to remain. Nathaniel Wilson acted as Trustee. The property (100 acres) adjoined the lands of Zedekiah Vaughan, Reuben Allen, Pleasant Harris, and Nicholas Edmunds. Harris was given until December 1827 to pay the debt or lose his land. This Indenture made this 14th day of March in the year of our Lord one thousand eight hundred and twenty six between William B. Harris of the first part, Nathaniel Wilson, Trustee of the Second part, and Isham Harvey & Co. John Harvey and Thomas Harvey & Co. Trading under the firm of Isham Harvey & Co. of the third part. Whereas the Said William B. Harris is justly indebted to the said Isham Harvey & Co. in the sum of two hundred and sixty three dollars and ninety four cents due by bond the 1st day of September 1826 the Said William B. Harris is willing and desirous to secure now this indenture witnesseth that for and in consideration of the premises also for the further consideration of one dollar of lawful money of Virginia to the said William B. Harris in hand paid by the Said Nathaniel Wilson at or before the Sealing and Delivery of these presents, the reciept is hereby acknowledged. The said William B. Harris hath given granted bargained and Sold a lien enfeoffed? released and confirmed and by these presents who give grant bargain sell a lien enfeoff release and confirm unto the said Nathaniel Wilson his heirs and assigns forever one tract or parcel of land containing one hundred acres lying and being in the County of Charlotte adjoining the lands of Zedekiah Vaighan, Reuben Allen, Pleasant Harris, and Nicholas Edmunds. To have and to hold the Said hereby granted tract or parcel of land hereby conveyed to the said Nathaniel Wilson his heirs and assigns forever to the only proper use and behoof of him the Said Nathaniel Wilson and his heirs and assigns forever and the William B. Harris for himself his heirs Executors and administrators doth hereby Covenant, promise and agree to and with the said Nathaniel Wilson and his heirs and assigns forever in manner and form following, viz., That the Said William B. Harris his heirs Executors and administrators the aforesaid tract or parcel of land unto the said Nathaniel Wilson his heirs and assigns against all persons whatever shall and will warrant and forever defend by these presents upon trust nevertheless that the said Nathaniel Wilson shall permit the Said William B. Harris to remain in quiet and peaceable possession of the Said tract of land hereby Conveyed until default in payment of the Said Sum of money with legal interest, either in the whole or in part and then upon this further trust that him or the Survivor of him Shall and Will So Soon after the happening of such default of payment, or the said Isham Harvey & Co. shall request proceed to Sell to the highest bidder for ready money at public auction, the aforesaid Tract or parcel of land and premises after having fixed the time and place of Sale at their own discretion and given three months notice by advertisement to be set up at the door of Charlotte Courthouse and other publick places in the County aforesaid and out of the monies arising from such sale shall after satisfying the charges thereof and all other expenses attending the same pay to the said Isham Harvey & Co. their heirs executors administrators or assigns with legal interest which may thereon lawfully have occurred, and the balance if any shall pay to the Said William B. Harris his heirs exors. administrators or assigns. But if the whole Sum of money shall be lawfully paid off and discharged on or before the 25th day of December 1827 so that no default of payment is made, then this indenture to be void or else to remain in full force and virtue-- In witness whereof the said parties to these presents have hereunto set their hands and affixed their Seals this day and year first above written. Dowell John Sumpter This deed of trust was acknowledged in the Clerks office of the County Court of Charlotte the 28 day of April 1826 by William B. Harris a party thereto and admitted to record. Teste Winslow Robinson 3 July 1827 Deed of Release from Nathaniel Wilson and Isham Harvey to William B. Harris (Charlotte County Deed Book 18, 7) Synopsis: William B. Harris owed money to Isham Harvey. His land was put up for security. This deed of release returns the 100 acres to Harris, who had paid his debt. This Indenture made and entered into this 3rd day of July 1827 between Nathaniel Wilson and Isham Harvey & Co. of the first part and William B. Harris of the Second part whereas the said William B. Harris did on the 11th day of March 1826 Convey to the Said Nathaniel Wilson one hundred acres of land lying and being in the County of Charlotte adjoining the Lands of Zedekiah Vaughan, Reuben Allen, Pleasant Harris, and Nicholas Edmunds in land to secure the said Isham Harvey & Co. the payment of the Sum of Money two hundred and sixty three dollars and ninety four cents with interest thereon from the 11th September 1826 and the Said William B. Harris, having fully paid off and discharged to the Said Isham Harvey & Co. the debt and interest aforesaid now the Said Nathaniel Wilson, in Consideration of the premises and also of the further Consideration of one dollar to him in hand paid by the Said William B. Harris hath with the consent of the Said Isham Harvey & Co. ----? and released and by these presents doth amise? and release and forever quit Claim, to the property aforesaid and to the Said William B. Harris his heirs and assigns forever. In Testimony whereof the Said Nathaniel Wilson and John Harvey Sr. ? have hereunto Set their hands and affixed their Seals the day and date above written. Robinson This deed of Release was acknowledged in the Clerk's Office of the County Court of Charlotte the 3rd day of July 1827 by Nathaniel Wilson and Isham Harvey the parties thereto and admitted to Record. Teste Winslow Robinson 3 May 1830 Thomas Pugh, Trustee of 66 acres formerly owned by Reuben Allen, sells this land to Nathaniel Wilson (Charlotte County Deed Book 19, 136) Synopsis: Nathaniel Wilson purchases 66 acres of land formerly owned by neighbor Reuben Allen (land adjoined Wilson's). Whereas Reubin Allen of the County of Charlotte on the 209th day of November 1827 conveyed by Deed to Thomas Pugh and Anderson Allen trustees for Isham Harvey & Co. a certain tract or parcel of Land lying and being in the County of Charlotte adjoining the Lands of Nathaniel Wilson, Zedekiah Vaughan, and Henry E. Scott containing sixty six acres be the same more or less which said deed was recorded on the Clerk's Office of the County Court of Charlotte on the 3rd day of December 1827 and the said Thomas Pugh after having advertised the said Land agreeable to the Conditions specified in the said deed and on the 18th day of December 1829 sell to the highest bidder at public auction on the premises the aforesaid tract of Land and Nathaniel Wilson became the purchaser thereof. Now this Indenture made this 16th day of February 1830 between Thomas Pugh acting as Trustee under the Deed aforesaid of the one part and Nathaniel Wilson of the other part Witnesseth that the said Thomas Pugh, Trustee, for and in consideration of the sum of one hundred and thirty two dollars and sixteen cents to him in hand paid by the said Nathaniel Wilson the receipt whereof is hereby acknowledged has bargained and sold and by these presents doth bargain and sell unto the said Nathaniel Wilson a parcel or Tract of Land lying and being in the County of Charlotte adjoining the lands of Zedekiah Vaughan, Henry E. Scott, and the said Nathaniel Wilson containing sixty six acres to the same more or less. To have and to hold the said Tract or parcel of Land free from the claim of the said Thomas Pugh acting as Trustee for John Harvey & Co. under the deed aforesaid.
