R. Tharpe and Rosa B. Tharpe, his wife, and Susan A. R. Rutledge and W. H. Rutledge, her husband, parties of the first part, and R.A. Tharpe, party of the second part, WITNESSETH: That the parties of the first part for and in consideration of the sum of $180.00 cash in hand paid by the party of the second part do hereby grand, bargain, sell and convey with general warranty unto the said party of the second part all their right, title and interest in and to all the real estate that was devised by the will of Elizabeth A. Tharpe to Robert A. Tharpe, William R. Tharpe, Eliza J. Lankford, Chas. H. Tharpe, E. T. Tharpe and Susan A. R. Rutledge which will is duly recorded in Charlotte County Clerk's Office in Will Book No. 2, page 386, and the land therein devised to the said parties is described as containing fifty acres, more or less, lying on Sandy Creek in the County of Charlotte, in the State of Virginia. It being the intention of the parties of the first part to this deed to convey all their interest in the land thus devised whether the same shall by actual survey turn out to be a much greater area that fifty acres. And the parties of the first part hereby covenant that they have a right to convey the said land to the grantee, that they have done no act of encumber the said land; and that they will execute such other and further assurances of the same as may be requisite.
