DEED BOOK 10, p. 65. This indenture made this twenty fourth day of April in the year of our Lord Eighteen hundred and four between Hamlett Collier and Elizabeth Collier his wife of the one part and William Towler (all of the County of Charlotte) of the other part, Witnesseth that the said Hamlett Collier and Elizabeth Collier his wife for and in consideration of the sum of one hundred and fourty pounds Current money of Virginia to them in hand paid before the sealing and delivery of these presents the receipt whereof they do hereby acknowlege doth grant bargain and sell enfeoff and confirm unto the said William Towler his heirs and assigns forever one certain piece tract or parcel of land lying and being in the County aforesaid containing by actual survey twenty five and one half acres and bounded as followeth, viz. Beginning at a new made corner in Childries line Spanish oak thence along his line S. 88. E. 50. poles to a new made corner and oak on said line thence a new line S. 12. W. 74. poles to a corner [?] oak thence N. 88. W. 50. poles to a new made corner pointers thence N. 12. E. 74. poles to the beginning -- To have and to hold the aforesaid tract or parcel of Land together with all houses thereinto appertaining belonging to the said William Towler his heirs and assigns forever -- To him and their only proper use and [?] free and clear from all or any bill, claim, dower, challenge or demand of the said Hamlett Collier and Elizabeth Collier his wife their heirs executors or administrators and of all and every other person or persons whatsoever claiming by from or under them and the said Hamlett Collier and Elizabeth Collier his wife for themselves their heirs exors. and admis. do covenant promise and agree to and with the said William Towler that they shall and will at any time hereafter require and lastly the said Hamlett Collier and Elizabeth Collier his wife for themselves their heirs exors. admis. do hereby covenant forever to Warrant and defend the aforesaid tract or parcel and premises with all the appurtenances to the said William Towler his heirs executors administrators against them their heirs executors administrators and against all and every other person and persons whatsoever -- In Witness whereof we have hereunto set our hands and affixed our Seals the day and year above written. This Indenture was proved in Court by the oath of Collier Hutcheson, Edward Towler and Thomas Cox to be the act and deed of the said Hamlett Collier and Elizabeth Collier his wife and ordered to be recorded. Son of John Collier, who lived in Charlotte Co. from 1767 to 1795, emigrated to Ky. and left a will in Nicholas Co. in 1820. His mother was Hannah Hamlett daughter of James Hamlett and Obedience ?, who lived in Charlotte, and later Lunenburg County. Hamlett Collier's wife was Elizabeth Towler, daughter of Japheth Towler (and Elizabeth Bradley), who left a will in Charlotte Co. in 1798. William Towler, the grantee of this deed was her brother, as was Edward Towler, one of the witnesses; Collier Hutcheson was a cousin of Hamlett Collier, son of Frances Collier (sister to John Collier, Hamlett's father) and Charles Hutcheson, of Mecklenburg Co.]. To all persons to whom these presents shall come I Clement Jameson son and heir at law of William Jameson deceased of the County of Charlotte in the State of Virginia, do send Greeting Whereas a suit was instituted in the High Court of Chancery by Elizabeth Towler widow, James Towler, Benjamin Towler, Anne Towler, William Towler, Elizabeth Towler, the daughter, Luke Towler and Edward Towler, the five last of whom being infants appeared by their mother and [?] friend the before mentioned Elizabeth Towler widow, devisees of Japheth Towler deceased Plaintiffs against James Jameson and Richard Cameron surviving partners of Buchanan, Hastie & Co., and me the said Clement Jameson son and heir at law of William Jameson dec'd. Defendants, and whereas also the said James Jameson and Richard Cameron surviving partners of Buchanan, Hastie & Company aforesaid as Plaintiffs , also instituted a suit in the said High Court of Chancery, agains Elizabeth Towler widow and one of the devisees of Japheth Towler deceased, James Towler, Benjamin Towler, Anne Towler, William Towler, Elizabeth Towler, Luke Towler and Edward Towler, children and devisees of the said Japheth Towler, to such of whom are infants, the said Elizabeth Towler widow was assigned guardian, Henry Isbell, Ambrose Hammond and me the said Clement Jameson, Defendants, and such proceedings were had in the said suits that on the first day of March in the year one thousand Seven hundred and ninety nine, it was adjudged ordered decreed, that I the said Clement Jameson as a Defendant in the said first suit, should at the costs of the Plaintiffs in that suit execute a release of all my right, to the Land under the Deed from Isbell to William Jameson to those claiming under Japheth Towler dec'd. either as heirs or devisees, all which premises will more fully and at large appear and reference to the proceedings and decrees in the said suits remaining of record in the said Court, Now these presents witness, that I the said Clement Jameson for and in consideration of the premises, and in order to carry into full and compleat effect the said recited decree, have remised, released, and forever quit claimed, and by these presents remise, release and forever quit claim unto those claiming under the said Japheth Towler deceased, either as heirs or devises all the estate, right, title, interest, use, trust, claim and demand whatsoever hath at law and in equity of me the said Clement Jameson, as son and heir of the said William Jameson of in to or out of all the land aforesaid and every part and parcel thereof with all and singular the appurtenances, so that neither I the said Clement Jameson my heirs or assigns, or any other person or persons in trust for me or them, or in my or their name or names shall or will, can or may, by any ways or means whatever hereafter have, claim challenge, or demand any right title or interest of in to or out of the said land and every part or parcel thereof with the appurtenances, But that I the said Clement Jameson my heirs and assigns and every one of them, from all estate, right, title, interest, property claim and demand of in to or out of the said land and premises and every part and parcel thereof am, is, are and shall be by these presents forever excluded and debarred. In Testimony whereof I the said Clement Jameson, have hereunto set my hand and affixed my seal this seventh day of August in the year of our Lord one thousand Seven hundred and ninety nine. This Deed of Release was proved in Court by the oath of Clement Read, Thomas Read Jr., and Robert Price to be the Act and Deed of the said Clement R. Jameson, and ordered be Recorded. Teste Thomas Read Truly recorded Thomas Read --------------------------------------------------------------------------- JOSIAH FOSTER to JAPHETH TOWLER CHARLOTTE COUNTY, VA. DEED BOOK 4, p. 263. This Indenture made this third day of december one thousand seven hundred and Eighty one between Josiah Foster of Charlotte County of the one part and Japheth Towler of Goochland County of the other part, Witnesseth that the said Josiah Foster for and in consideration of the sum of fifty pounds Current money of Virginia to him in hand paid by the said Japheth Towler the receipt whereof the said Josiah Foster doth hereby acknowledge, hath given granted bargained and Sold, and by these presents doth give grant Bargain sell deliver and confirm to him the said Japheth Towler one Certain Tract or parcel of land situated lying and being in the County of Charlotte Containing two hundred and Eighty two acres be the same more or less, and bounded as follows beginning at James Mullins Corner, along his line to Childres Corner pine along his line to Hutson's line, along Hutson's line, to Covinton's line and along his line to the first Station. Together with all and singular the priveleges and appurtenances thereunto belonging or in any wise appurtaining to, to have and to hold the above said land -- premises with all the appurtenances unto the said Japheth Towler his heirs Executors or administrators, forever to have and to hold use occupy possess and enjoy the same with every part and parcel thereof to him the said Japheth Towler, his heirs or assigns forever to the only proper use and behalf of him the said Japheth Towler he his heirs and assigns forever against the said Foster his heirs or assigns and against the Claim [?] of all other persons whatsoever shall or may by these presents warrant and forever defend. In witness whereof the said Josiah Foster hath hereunto set his hand and seal the day and year first above written. Josiah Foster Memorandum that on the day and year first within mentioned Quiet and peaceable possession and seizin of the within mentioned Land and premises with all the appurtenances was given and made by Josiah Foster unto Japheth Towler according to the true intent and meaning of the within written Deed: In presence of the Witnesses thereunto subscribed. Josiah Foster In presence of us Received December the 3rd 1781 of Mr. Japheth Towler the sum of fifty pounds Virginia Currency in full payment of the consideration money for the above sold land and [?] Josiah Foster. At a Court held for Charlotte County the 3rd day of December 1781. The within written Indenture and Memorandum and Receipt hereon Indorsed was acknowledged by the said Josiah Foster to be his act and Deed and ordered to be recorded and Elizabeth the wife of the said Josiah she being first privately Examined according to law, Relinquished her Right of Dower in and to the land and premises Conveyed by said Indenture.
