Will of former Charlotte Co., VA resident: John Elam 1824 Submitted by Annette E. Wetzel 23 Nov 1998 Will of John Elam, Edgefield District, South Carolina In the name of God, Amen, I, John Elam of the State of S. Carolina and District of Edgefield, being weak in body but of Sound and perfect mind and memory, blessed be almighty God for the Same, do make and publish this my last will and testament, in manner and form, following, that is to Say: First I Leave to my beloved wife Mary Elam during her life all my property both real and personal, and at her death my will is that my Executors hereinafter mentioned Shall sell all my property both real and personal except my negroes the Land on one two and three Years credit with Intrest from the day of Sale and the property on a credit of one year and my will is that they Shall devide the Lands into any size tracts So as to be the most to the interest of my Estate and the money arising from the Sale of my property to be divided in the following manner, First, I give to my Son in law John Buckhalter the sum of Fifty Dollars, the one half the balance I give to my daughter Mary Davis, and the orher half I give to my Eight grand children, James Buckhalter, Tandy Buckhalter, Christina (?) Buckhalter, Polly Buckhalter, Elizabeth Buckhalter, Martha Buckhalter, Susannah Buckhalter and Martin Buckhalter; share and share a like Except the Sum of one hundred Dollars which I leave to the Children of my grandaughter, Jane Terry. And my will is that my negroes Shall be put into two lotts, as Equal in value as my Executors probably can. One Lott to be marked with the Letter "P" and the other Lott to be marked with the Letter "S" and my Executors to have them drawn for and the Lott in part marked "P" I give to my daughter Mary Davis and the other lott a part marked "S" I leave to my Daughter Susannah Buckhalter during her life and at her Death I will them to the Eight Youngest Children of my daughter Susannah Buckhalter and to the Children of my grand daughter Jane Terry, that is to say [my] will is that the Children of my Grand daughter Jane Terry one tenth part and the balance to be divided equally between the other Eight children of my Daughter Susannah Buckhalter, but my will is that the part of my negroes Given to my grand children at the death of their mother Susannah Buckhalter Shall not be sold for the purpose of making a division But that They Shall be put into as many Shares as there are Children. Say, nine Shares as Equal as possible and that they Shall Draw for them, but in case any of my Grand Children should happen to die before they become of age my will Is, that their share part Shall be Equally Divided between the Survivors - and in case any Dispute Should happen to arise respecting the right of any of my property my will is that my Executors shall make any arrangement in Settlement that they may think Most to the Interest of my Estate and Lastly I do hereby Nominate constitute and appoint my Worthy Friend George B. Elam, Daniel Brunson, and Charles Hammond Executors to this my last will and Testament.
