In the name of God amen I Josiah Hundley of the County of Chesterfield and State of Virginia do make and constitute this as my last will and testament in the manner and form following to wit. First. My will and desire is that my just debts be paid. 2d. I loan to my Daughter Eliza M. Watkins Wife of John J. Watkins my negro woman named Patience during her natural life and at her death I give the said negro woman Patience and her increase from this date to the children of my said Daughter Eliza M. Watkins to them and their heirs forever said negro woman to be supervised and managed by my Grand son Joel B. Watkins for the especial benefit of my said Daughter as trustee for that purpose that being all my estate that I intend my Daughter Eliza M. Watkins to have at my death as I have paid a considerable amount of money for her which I think equivalent to her portion of my Estate. 3. I desire at my Death that all my negros except the before mentioned Patience be sold by my Executors hereafter named and the amount arising from such sale together with all the balance of my Estate of every description whatsoever not especially given away in my Will be equally divided between all my children then living, and the decendants of such of them as may have died the decendants taking by _________________ the above to which their parents would have been entitled to if living except Eliza M. Watkins who is provided for in the foregoing clause of this Will. 3d.(sic) I desire at my death that all my estate as is given to my Daughter Judith T. Watkins be managed and supervised by my Grandson Joel Watkins for her bebefit as she may direct. 5. My will and desire is that the portion of my estate given to the children of my son Josiah Hundley dec'ed. be managed and supervised my son Richard O. Hundley as trustee for their benefit. 6. If either of my children should die without issue of his or her body then I desire that his or her portion of my Estate on dying shall be equally divided between my surviving children and the decendants of such as may have died the decendants receiving such portions as their parents would have received if living. 7. I desire it to be particularly understood that the interest or portion in my Estate given by my Will to my children Fanny A.Poindexter Mary C. Brumall, Patrach(?)O. Hundley and Rebecca P. Spears is given to them on condition that they relinquish to my estate all right and title to the hire or profits that have arisen from a certain negro named Moses who is now dead which said negro they inherited from their grand mother P_ilby. 8. My will is that all claims by Bonds or accounts that I hold against any of my children shall be considered as due me and a portion of my Estate. 9. I give and bequeath my horse and buggy to William E. Spears to him and his heirs. 10. I appoint my son Richard II Hundley and William E. Spears Executors to this my Will and request that they be permitted to qualify as such without giving security. As Witness my hand and seal this November the 8th 1850. Hancock In Chesterfield County Court December the 9th 1850 the last will and testament of Josiah Hundley dec'd. was presented in Court and proven by the oaths of Wm. A. Martin & William Winfree subscribing witnesses thereto and ordered to be recorded. And in said Court March 10th 1851. On motion of Wm. E. Spears one of the Executors in said Will named who entered into bond without security (none being required) conditioned as the law directs and took the oath required by law Certificate is granted him for obtaining probat of said Will in due form.
