Martin - 1863/1889 (Will Book 28, page 26, Chesterfield Co.VA.) In the name of God. I Joseph E. Martin of the County of Powhatan State of Virginia do make and ordain this my last will and testement in manner and form following to wit. 1st. I wish all of my just debts to be paid with due dispatch. 2nd. I leave to my beloved wife Louisa D. Martin dureing her natteral life or widow hood all of my estate both real and personal to hold dureing her natural life or widow hood. 3rd. I desire that wife shall Edecate all of my children out of the funds of my Estate and to be furnished with clothing & any other Expence may enure for their benefit. 4th. If any one or more of my children should mary befer the death of my wife Louisa then I wish and desire that my said wife may lend them any part or parcel of my Estate she may deem proper to loan to any of them. 5. I desire all of my estate to come together at the death of my wife Louisa D. Martin both real and personally in the first place I give and bequeath to my daughter Susan A. Martin one sixe of the negrres I may have & one sixe of the land and stock and crop & household and kitchen furniture. I also give and bequeath to Rosa B. Martin one sixe as the above portion I give Susan A. Martin. I give & bequeth to Phenie Martin one six.- of the above named pution I give Rosa B. Martin. I give and bequeath to Mary F. Martin one sixe as the the above named potion of Pfhine Martin. I also give and bequeath to J_s. D. Martin one sixe of the remainder of my estate including the tract of land in Chesterfield County where I formerly resided any other property I have not disposed of I desire to be Equitable divide among all of my children I have mentioned in my will. Lastly I appoint my wife Louisa D. Martin my Executrix to this my will and desire that the Court may not require any security to this my last will and Testament. Given under my hand and seal this 22 day of July 1861. Jos. E. Martin (Seal) At a Court of Quarterly Session begun and held for the County of Powhatan at the Court House thereof on Monday the 7th day of December 1863.The foregoing writing perporting to be the last will and Testament Jos. E. Martin decd. was presented in Court and there being no subscribing witnesses to the same R.F. Graves Ben C. Watkins and Luther R. Swift were duly sworn in open Court and upon their oaths say that they are well acquainted with the hand writing of the said Joseph E. Martin deceased and verily believe that the said will and the signature thereto are wholly in the hand writing of the said Martin and thereupon the same is ordered to be recorded as his last will and testament. And on the motion of Louisa D. Martin the Executrix named in the said will who made oath thereto according to law and Entered into and acknowledged a bond in the penalty of fifty thousand dollars without security (the will so directing) conditioned as the law directs, a Certificate is granted her for obtaining a probate of the said will in due form.
