All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Janet King JPerdue192@aol.com March 14, 2009, 12:06 am Source: Chesterfield Co., Va Will Bk. 13, Pg. 569 Written: December 27, 1836 Recorded: February 13, 1837 In the name of God amen, I Nancy Perdue of Chesterfield County being weak in body but of sound and perfect mind and memory, thanks be to Almighty God for the same, do make and ordain this my last will and testament in manner and form following Viz; First, I recommend my soul to God that gave it, and my body to the Earth to be buried in a decent and Christian like manner at the decretion of my executors hereafter named: And as it hath pleased Almighty God to bless me with a few worldy goods I shall dispose of them in the following manner: First - I give, devise and bequeath unto my daughter Elizabeth Smith one negro woman named Amiah and all her increase hereafter to her and her heirs forever. Secondly - I give, devise and bequeath unto my daughter Sally A. Ferguson one negro boy named Lawson to her and her heirs forever. Thirdly - I give, devise and bequeath unto my son James M. Perdue, one negro boy named Gilbert, to him and his heirs and in case that my said son James shall be having no lawful heir then my will and desire is that the said boy Gilbert is sold, and the money equally divided amongst my legatees. Fourthly - I give, devise and bequeath to my son William H. Perdue one negro boy named David, to him and his heirs, and in case my said son William should have no lawful heir, my will and desire is, that the said boy David is sold, and the money equally divided amongst the legatees. Fifthly - and lastly, I give, devise and bequeath unto my son John O. Perdue one negro boy named Edward, my ox and cart and all my lands, my household & kitchen furniture, except my spining wheel, which I give unto my grand daughter Frances Ann Ferguson and my loom to my grand daughter Jane Ferguson which they are to come in possession of at the age of Fifteen years old. And in case my said son John should die without any lawful heir, my will and desire is that the said boy Edward be sold and one hundred dollars, given unto my daughter in law Mickey Perdue and the remainder of the money be equally divided among the legatees. The remainder of the stock of cattle and sheep, are to be sold and a payment of Twenty dollars to be made unto my daughter Elizabeth Smith and the remainder of the money equally divided between my five children, and also I constitute and appoint my aforesaid son James M. Perdue & John O. Perdue my whole and sole executors to this my last will and testament revoking all others by me (crossed out) her heretofore by me made: In witness whereof I have set my hand and seal this twenty seventh day of December, one thousand eight hundred and thirty six. Gill, Joseph Gill ) In Chesterfield county court February 13th, 1837, The last will and testament of Nancy Perdue deceased was presented in court, and proved by the oaths of William E. Gill and Joseph Gill subscribing witnesses and ordered to be recorded. On the motion of James M. Perdue and John O. Perdue exectors in the said will named who made oath thereto and entered into bond with security, conditioned as the law towit; a certificate is granted them for obtaining probate thereof in due form Teste Clarke Pondexter, clerk Pursuant to an order of Chesterfield county court we the subscribing commissioners having been sworn for that purpose have appraised the estate of Nancy Perdue in current money as above stated, Sworn under our hands this 13th March 1837.
