Spears - 1863 (Will Book 23, page 196, Chesterfield Co.VA.) I James H. Spears of the County of Chesterfield do make and publish this my last will and testament in the following manner first, my will is that all my Just debts be paid by my executor and executrix herein after named. Secondly I give to my wife Jane one third part of all my estate both real & personal during her natural life. Item, I give the whole of the balance of my Estate both real & personal to my two sons James H. and Thomas ____ Spears but the whole of my said Estate to be kept together untill my youngest son arrives at the age of twenty one years unless my wife Jane should think proper to marry then at the happening of such an event the third part of my Estate to be assigned to her during her natural life the remaining two thirds to be taken possession of by my Brother William Spears whom I hereby appoint as their Guardian to manage control the Estate until the youngest becomes twenty one years of age at which time the whole of my Estate including the third part given to my wife to be equally divided between my said two sons unless my wife Jane should be still living in that event the portion given to her to go to my said two sons & their heirs forever after her death, but should both of my said two sons die without having arrived at age of twenty one years or without having married and had issue born to them then in that event the whole of my Estate I give to my wife Jane & her heirs forever. Lastly I do hereby constitute & appoint my brother William & my wife Jane sole Executor or executrix to this my last will & testament hereby revoking & disannulling all and every former will made by me. And from the full confidence placed in them by me I do hereby request the Court to suffer them to qualify as Executor & Executrix without giving security In testament whereof I have hereunto set my hand & seal this the 27 day Jany.1863. Spears dec. was presented in Court & proved by the oath of Wm. Goode and David H. Hancock subscribing witnesses thereto and ordered to be recorded. On the motion of Jane Spears Executrix therein named who entered into bond without security none being required and took the oath required by law Certificate is granted her for obtaining probat of said will in due form.
